This article uses the 1818 Select Committee on the Copyright Acts to examine how the theory and practice of legal deposit entail a (shifting) calibration of the catholic and the selective. I focus on two sets of documents. The first is the minutes of the select committee, where I trace the different modes of literary value put forward by library representatives. In particular, I consider the difficulty librarians face when asked to comment on individual texts (rather than the principle of deposit). The second group of documents comprises parliamentary returns from the Bodleian Library and the Cambridge University Library listing deposit items that these libraries rejected between 1814 and 1817. I have traced many of the roughly 500 texts listed and present strategies drawn from the computational humanities for exploring the different authors, genres, and forms represented. group of major London booksellers who sought to monopolize the right to copy books in perpetuity. Why is there a time limit on copyright? This book goes back to the beginning on this question by focusing on a pivotal eighteenth-century court debate in England from a social and cultural point of view. Its historical investigation of the issues of copyright is based on detailed documentary research. The book explores the relationships among the booksellers, lawyers, members of the nobility, and writers who formed the backdrop to the eighteenth-century publishing industry, a backdrop that offers many insights in considering the issues of copyright today. It is also a history of publishing culture, introducing the ideas and debates about literary works prevailing at that time and the people who figured in those debates. “It is difficult to treat ‘monopoly’ or ‘piracy’ as a clear dichotomy of good and bad,” writes Yamada in his conclusion. “Both were ultimately acting in the pursuit of economic gain, and both claimed to either represent the rights of authors or the convenience of readers to defend their own position. This book tries to illustrate how their head-on clash in the courtroom, intertwined with the interpersonal relationships among lawyers and judges. This approach may seem curious to scholars of law who may be interested primarily in a detailed analysis of the logical structure of court debates. In 1991, when the journal Book Research Quarterly became Publishing Research Quarterly, Beth Luey (1991: 3) explained that it was less a “lack of confidence” in the book’s future, than a belief in the activities of publishing, whatever the medium. In this talk, I will discuss three topics that pertain to publishing and research. First of all, the promising increase of enquiries into Publishing Studies as a discipline in its own right; but also the caveats of its Universal claims. I will then proceed to suggest the importance of economy in this emergent discipline, and especially an economy of surplus and excess that produces such profuse materials for reading. (He importantly points out, for example, that the first citations in the OED for the word literature establish it "as a category that excludes women and the common people" [75].) If I have one quarrel with Rhodes's work here, though, it is that Common declines the opportunity to put its important observations into conversation with current debates in the humanities beyond the field of early modern studies. In the past decade or so, since at least the publication of Michael Hardt and Antonio Negri's Commonwealth (2009), scholars working largely in political philosophy and economics (but also in literary and cultural theory) have revitalized the notion of the commons at a moment when the privatization amplified by neoliberalism continues an unrelenting assault on the notion of common property. Clearly our late capitalist moment, marked by increasing precarity and division of wealth, as well as the appropriation of populist energies for elitist, even tyrannical, state power, is but the latest chapter in an ongoing narrative that begins (in part) with the period Rhodes recounts. Perhaps it is asking too much of a scholar of the sixteenth century to engage with this body of work and concerns. But it is a shame that Rhodes, like so many working in early modern studies, makes the antiquarian gesture of quarantining the period from more contemporary issues. Despite these limitations, though, Rhodes's study is smart, ambitious, and essential.
