The self-reflexive turn that has prompted literary scholars to study the emergence of their own discipline-along with related questions such as the assignment of aesthetics to a distinctive sphere, the processes of canon-formation, and the professionalization of authorship-has also spawned a significant amount of research on the interaction between copyright law and the production and circulation of literature. 1 These developments have been compounded by a broader interest in the cross-fertilization between law and literature. ideas about originality as a prerequisite for copyright protection. But when eighteenth-century commentators such as Blackstone and Hargrave spoke of originality for purposes of copyright, they were referring to a prohibition against reprinting books, not a demand for novelty. Recognizing that full-scale copies were prohibited, while partial copies were permitted, is crucial for an understanding of eighteenth-century literary culture, which had room for abridgements, unauthorized sequels, highly imitative parodies, and anthologies that reprinted some poems and excerpted others. The public domain was not understood as the residue of material that was not eligible for copyright protection; rather, all work was presumptively available for use by other writers unless it fell within the narrow bounds of copyright protection. The chapter begins by showing that arguments in favor of a public domain were implicit in the efforts by Locke and others to eliminate the Licensing Act in the 1690s. The second section discusses the eighteenth-century debate over copyright, emphasizing the limited scope of legal protection and the correspondingly wide reach of the public domain. This section focuses on the case law concerning the permissibility of abridgements, the legal writings of Blackstone and Hargrave, and the aesthetic writings of Richard Hurd and Samuel Johnson. As these sources reveal, literary critics were willing to defend imitative writing, and legal thinkers found little to criticize and much to praise in practices such as abridgement. The third section discusses the kinds of imitations that were allowed to flourish under this legal regime, and shows that imitative practice was crucial for the development of the modern novel in the 1740s. Finally, a short section at the end looks at why writers sometimes call for a strong originality requirement that demands more than Feist (in the U.S.) or C.C.H. Why is there a time limit on copyright? This book goes back to the beginning on this question by focusing on a pivotal eighteenth-century court debate in England from a social and cultural point of view. Its historical investigation of the issues of copyright is based on detailed documentary research. The book explores the relationships among the booksellers, lawyers, members of the nobility, and writers who formed the backdrop to the eighteenth-century publishing industry, a backdrop that offers many insights in considering the issues of copyright today. It is also a history of publishing culture, introducing the ideas and debates about literary works prevailing at that time and the people who figured in those debates. “It is difficult to treat ‘monopoly’ or ‘piracy’ as a clear dichotomy of good and bad,” writes Yamada in his conclusion. “Both were ultimately acting in the pursuit of economic gain, and both claimed to either represent the rights of authors or the convenience of readers to defend their own position. This book tries to illustrate how their head-on clash in the courtroom, intertwined with the interpersonal relationships among lawyers and judges. This approach may seem curious to scholars of law who may be interested primarily in a detailed analysis of the logical structure of court debates. In particular, the article explores the problematics of juridical textuality in the Romantic period – the extent to which the law comes to be regarded as text– and seeks to set this within the context of developing conceptualisations of ‘literature’ as a juridically defined commodity. The modern understanding of ‘literature’ began to be shaped in the Romantic era by a juridical re-formulation of the relation between the author, the text, the reader and the publisher: creative, original writing –‘literature’– becomes a commodity copyrighted to an author/publisher. This development is accompanied by the State’s recognition of the growing cultural and political power of new and diverse textual forms in an era of the mass production and consumption of ‘literature’, and the article considers alongside the contemporaneous formulation of copyright regulations the draconian censorship of textual production in this period.
