The narrowest definition denotes the factors preventing competitors from upward mobility – i.e., gaining market share. In this sense, "mobility barriers" are synonymous with "barriers to (market) expansion". The broadest definition refers to the factors that deter firms from switching or expanding to other markets. In this sense, "mobility barriers" is a generic term encompassing entry/exit barriers and barriers to moving within the industry for firms already active in at least one market.</p></div> </div> <div class="definition-section"> <h3 id="part-texte" class="definition-section-title">Commentary</h3> <div class="crayon article-texte-117742 texte surlignable"><p>Originating in industrial organisation economics, the term "mobility barriers" was proposed to evolve the definition of "entry barriers". In his seminal work, Joe Bain referred to "entry barriers" as the extent of competitors’ capability to raise their prices above costs without prompting potential competitors to enter the market (absolute cost advantage). This definition of entry barriers assumed that potential entrants were starting their market activities from scratch (see Caves and Porter, 1977). Hence, the concept overlooked at least two real-life market issues.</p> <p>First, firms already active in one market could enter another by switching or expanding business activities. As a result, not every potential entrant started production from zero. Second, markets frequently involved groups of firms with significantly different capabilities (e.g. different market shares) – referred to as "strategic groups". Hence, established market participants attempting to switch from one strategic group to another (e.g. by increasing their market shares) could face constraints similar to those encountered by new market entrants. The concept of "mobility barriers"/"barriers to mobility" was proposed to remedy these gaps.</p> <p>Mobility barriers can be defined in several ways. The narrowest definition addresses only the second gap highlighted in the previous paragraph (switching between strategic groups). This definition differentiates "entry" from "mobility" based on whether the firm is in or outside the market. In this way, barriers to entry concern the factors that deter firms from entering markets altogether, while mobility barriers refer to the obstacles that prevent already established market players from upward mobility – i.e., from increasing their market presence. If defined this way, mobility barriers become synonymous with "barriers to (market) expansion" – a concept that is frequently used by competition enforcers worldwide (alongside the concept of market entry) as one of the factors to assess the market power of existing market competitors (see the notion of <a href="https://www.concurrences.com/en/dictionary/entry-barriers">"barriers to entry").</a></p> <p>Other literature defines mobility barriers that address only the first gap identified above. For example, when discussing the mobility barriers in the European Civil Aviation Market, Pitelis (2022) clarifies that "[a] barrier to mobility is regarded as a characteristic of an airline market that prevents [an established] carrier from entering a new route". This definition focuses on the barriers that deter the entry of experienced firms but overlooks the barriers to expansion.</p> <p>Finally, most of the literature uses the notion of mobility barriers that addresses both above-mentioned issues. Namely, in addition to the upward mobility obstacles, this term refers to the factors that obstruct players of one market from entering another, either by switching markets or by expanding/diversifying their business portfolio. This overarching definition looks at the advantages of incumbent firms (i.e. firms already operating in a particular market) as opposed to firms that want to move to or scale up in the same market. Gilbert’s (1989) definitions of "barriers to entry" and "barriers to mobility (of capital)" reflect this well. Here, barriers to entry refer to benefits derived from the first mover advantage – i.e. "additional profit that a firm can earn as a sole consequence of being established in an industry". However, when discussing mobility barriers, Gilbert discusses the importance of assessing the obstacles of both entry and exit that could complicate the movement of capital from one market to another. Similarly, when Olusoga, Mokwa and Noble (1995) discuss various definitions of mobility barriers, they broadly refer to two main scenarios: a) costs incurred by entrants that were already established in another industry to move to a new industry or a new segment of the same industry; b) costs incurred by market participants to switch from one strategic group to another to increase their market presence.</p> <p>While widely used in industrial literature, the term "mobility barriers" is rarely (if at all) seen in legal literature and case law. One reason for this is that, in a vast majority of instances, the analysis of mobility barriers can be covered by the analysis of barriers to entry/expansion and exit. To note: factors such as sunk costs, economies of scale, reputation of the actual competitors, and structural characteristics of the market can be considered as both entry and mobility barriers.</p> <p>Therefore, if a particular market power analysis requires assessing these factors, this can be done under the "barriers to entry" concept already well-established in the law. For example, the EU Commission recently assessed whether high investment costs were barriers to entry in the <i>Amazon case</i> (para 65). Considering the substantial amount of investment required to enter the relevant market in this case, one could say that high investment costs could have also been barriers to mobility – i.e. they could deter both the firms established in other markets, as well as competitors (if any) desiring to expand their market shares.</p> <p>A similar assumption could be made about some of the entry deterrent factors that have emerged with the uprise of the digital economy. For example, in the EU Commission’s<i> Google Shopping case</i>, potential competitors noted needing a large quantity of data to develop an alternative search engine that could compete with Google (paras 286-289). Here, Google had the first-move advantage in the relevant market. Consequently, neither potential competitors that already operated in other digital markets (i.e. had prior experience in the industry) nor the existing competitors in the relevant market of search engines could scale up to match the strength and efficiency of the market leader – Google – in terms of the search engine functions.
