href="https://www.concurrences.com/en/dictionary/abuse-of-a-dominant-position">abuses of dominant position</a>, self-preferencing is a conduct that falls under the more general category of abusive leverage, as it assumes an <a href="https://www.concurrences.com/en/dictionary/undertaking-notion">undertaking</a> abusing its dominant position in a given market to extend that position in a closely related market (<a href="https://www.concurrences.com/en/dictionary/upstream-market">upstream</a>, downstream or adjacent), to the detriment of competitor on the latter market. In particular, by using its <a href="https://www.concurrences.com/en/dictionary/market-power">market power</a> on the dominated market the dominant undertaking gives a preferential treatment to its own product on the non-dominated market and this might be capable of having exclusionary effect, absent any objective justification or proof of efficiencies.</p></div> </div> <div class="definition-section"> <h3 id="part-texte" class="definition-section-title">Commentary</h3> <div class="crayon article-texte-111800 texte surlignable"><p>Self-preferencing is a relatively new type of abusive conduct (at least formally), often associated to the market power held by digital platforms and to risks deriving from their vertical and conglomerate integration.</p> <p>In fact, its first mentioning derives from the <i>Google Search (Shopping)</i> Decision (2017), in which the European Commission held that Google had abused its dominant position in thirteen national markets for general search services, by positioning and displaying more favourably, in its general search results pages, its own comparison shopping service compared to competing comparison shopping services (paragraph 341).</p> <p>In particular, while competing comparison shopping services could appear only as generic search results and were prone to the ranking of their web pages in generic search results on Google’s general search results pages being demoted by certain algorithms, Google’s own comparison shopping service was prominently positioned, displayed in rich format and was never demoted by those algorithms (paragraph 344).<br class='autobr' /> The conduct decreased traffic from Google’s general search results pages to competing comparison shopping services and increased traffic from Google’s general search results pages to Google’s own comparison shopping service and was capable to have <a href="https://www.concurrences.com/en/dictionary/anticompetitive-objet-or-effect">anti-competitive effects</a> in the national markets for comparison shopping services.</p> <p>The European Commission argued that Article 102 TFEU prohibits abusive leveraging (paragraph 334 of the Decision) but, nonetheless, it did not qualified Google’s conduct as any known leveraging practice, rejecting Google’s argument that the conduct could have been considered abusive only if the criteria established in the <i>Bronner case</i> (Case C-7/97, EU:C:1998:569) were fulfilled.</p> <p>This conclusion is shared by the General Court in its judgment of November 2021, which confirmed the Commission’s Decision.<br class='autobr' /> In fact, the General Court noted that leveraging is a generic term in relation to the impact which a practice identified on one market may have on another market, and by this term can be addressed several different practices that are capable of being abusive, such as <abbr title='Dead link'>tying</abbr> and <a href="https://www.concurrences.com/en/dictionary/refusal-to-deal">refusal to deal</a>, letting go without saying that the list might not be exhaustive as it is not the one contained in Article 102 TFEU (paragraph 163).</p> <p>Given that leveraging practices of a dominant undertaking are not prohibited as such by Article 102 TFEU and that the actual scope of the special responsibility imposed on a dominant undertaking must be considered in the light of the specific circumstances of each case (paragraph 165), practices may be found abusive that are not included among those already assessed in the decisional practice of the European Commission and in the case law of the European Court of Justice.</p> <p>Based on that, the General Court did not rely on a specific test to find Google’s conduct abusive, but let it understand that the analysis of the specific circumstances of the case is fundamental to assess whether the dominant undertaking’s conduct deviates from competition on the merits, without any objective justification or proof of efficiencies.</p> <p>In November 2021, the Italian Competition Authority fined Amazon as it had abusively leveraged its dominant position in the Italian market for intermediation services on marketplaces to favour the adoption of its own logistics service (FBA) by sellers active on Amazon.it to the detriment of the logistics services offered by competing operators, as well as to strengthen its own dominant position.</p> <p>More specifically, Amazon conditioned sellers’ access to a set of exclusive benefits essential for gaining visibility and increasing sales on the platform to buying Amazon’s logistics service. Among those benefits, sellers using Amazon’s logistics service were not subject to the performance indicators Amazon applied to other sellers, which could even lead to the suspension of non-compliant sellers’ account. This in turn, along with FBA-sellers being given access to the Prime badge for their offers, allowed FBA-sellers to get a greater probability of winning the so called Buy Box, which accounts for a very high portion of customer purchase on Amazon.it. <br class='autobr' /> In other words, Amazon gave a preferential treatment to its own logistics service, whose performance was not subject to the metrics used to monitor the performance of competing logistics services (paragraphs 745-749 of the Decision).</p> <p>Self-preferencing practices are also dealt with by Regulation (EU) 2022/1925 (<a href="https://www.concurrences.com/en/dictionary/digital-markets-act">Digital Markets Act</a>), that imposes on gatekeepers obligations clearly shaped in the wake of European Commission’s decisional practice.</p> <p>Gatekeepers are often vertically integrated (Recital 51) and they “<i>should not engage in any form of differentiated or preferential treatment in ranking on the core platform service, and related indexing and crawling, whether through legal, commercial or technical means, in favour of products or services it offers itself or through a business user which it controls</i>” (Recital 52).</p> <p>Based on that, Article 6, paragraph 5, forbids gatekeepers from “<i>treat[ing] more favourably, in ranking and related indexing and crawling, services and products offered by the gatekeeper itself than similar services or products of a third party. The gatekeeper shall apply transparent, fair and non-discriminatory conditions to such ranking</i>”.</p> <p>It is clear that the Digital Markets Act introduces for gatekeepers a <i>per se</i> rule for self-preferencing practises, while the antitrust enforcement approach remains based on the principles followed by the European Commission and the General Court as stated in the <i>Google Search (Shopping)</i> Decision and the following judgment, according to which self-preferencing is not abusive <i>per se</i>, as it might not be capable to have anti-competitive effects and undertakings could always prove an objective justification or efficiencies.</p> <p>By not giving this opportunity to gatekeepers, the Digital Markets Act does not allow to seize potential pro-competitive features of self-preferencing, according to the specific circumstances of the case.
