signs possessing distinctiveness in terms of capability to distinguish goods or services of one undertaking from those of other undertakings. Such signs can be in diverse forms including words, letters, combinations of colors, numbers, or any combination of these forms. The fundamental condition for any sign to be eligible for trademark protection is distinctiveness. A sign may possess distinctiveness inherently or acquire it through use. This harmonized definition of trademark is found with some variations in national laws of all members of the World Trade Organization.</p></div> </div> <div class="definition-section"> <h3 id="part-texte" class="definition-section-title">Commentary</h3> <div class="crayon article-texte-113725 texte surlignable"><p>The conditions of trademark registration and enforcement vary in national laws according to relevant public policies.</p> <p><strong>Signs/Marks</strong></p> <p>The U.S federal law 15 U.S. Code § 1127 and section 9 of Restatement (Third) of Unfair Competition, 1995 define a trademark as including any word, name, symbol, or device, or any combination thereof. In Qualitex Company v. Jacobson Products Company (1995) the US Supreme Court stated that a sign on account of its ontological status can’t be denied trademark protection if the sign has distinctiveness. Thus, non-conventional signs such as scent, flavor, color, moving images etc. can also qualify for trademark protection if they are able to carry a meaning. In the EU, EUTM Directive and EUTM Regulations define a trademark as consisting of any signs including personal names, shapes, or packaging of goods. In Ralf Sieckmann v. Deutsches Patent- und Markenamt (2002), the European Court of Justice ruled that any sign can be subject matter of trademark protection including signs which cannot be visually perceived but can be represented. In Dyson Ltd v Registrar of Trade Marks (2007), the ECJ restricted what constitutes a sign and ruled that a claimed sign not capable of being perceived by one of the five senses is not a sign.</p> <p><strong>Distinctiveness</strong></p> <p>A sign devoid of distinctiveness is not a trademark. TRIPS Agreement does not define the term ‘distinctiveness’ but refers to it in the context of the ability of a sign to ‘distinguish’ goods/services of one undertaking from others. In US law, the definition of trademark explicitly requires two functions of a trademark ‘to indicate source’ and ‘to identify and distinguish’ goods on which it is affixed. The EU definition of trademark explicitly refers to one function of a trademark which is the capability of a sign to distinguish goods/services. However, in Koninklijke Philips Electronics v. Remington Consumer Products (2002), the ECJ, relying on jurisprudence and the preamble of the directive, ruled that the essential function of a trademark is to identify the origin of goods and to enable a consumer to distinguish the goods from other goods. Thus, in contrast to the TRIPS Agreement, the distinctiveness of signs in US and EU laws can be understood in the terms of capability to distinguish goods/services (differential distinctiveness) and indicate source/origin of goods on which they are applied (source distinctiveness). Some commentators emphasis that differential distinctiveness facilitates source distinctiveness.</p> <p>Similarly, article 9 of Trademark Law of the People’s Republic of China requires a trademark to be readily distinguishable. As per section 9(1)(a) read with section 2(1)(zb) of Trade Mark Act, 1999 (India) ‘distinctiveness’ is capability of a sign to distinguish goods/services. The source distinctiveness is not a statutory requirement, but it assists consumers in differentiating products (ITC v. Phillip Morris (2010). Source distinctiveness of an infringing mark cannot be used as a defense to infringement action. (Stiefel Laboratories v. Ajanta Pharma (2014)).</p> <p><strong>Spectrum of Distinctiveness</strong></p> <p>In EU, distinctiveness is assessed by reference to the associated goods, the perception of an average consumer and the overall impression of a sign (Mag Instrument v. Office of Harmonisation in the Internal Market (2004). A sign should be perceived as an indication that goods come from a single source, that it is a ‘badge of origin’. In addition to it, a sign should not be descriptive and generic. In a classic American case Judge Friendly classified signs into four categories in an ascending order reflecting how much a sign is distinctive: (1) generic; (2) descriptive; (3) suggestive; and (4) arbitrary and fanciful. Generic signs are the antithesis of trademarks and cannot be trademarked under any circumstances. These marks identify a category or class name of associated goods instead of source of goods. Whether a sign is generic can be ascertained by asking the genus of the concerned goods or service and whether the relevant public understands the sign to refer to that genus (H. Marvin Ginn Corp. v. International Ass’n of Fire Chiefs (1986).</p> <p>Descriptive signs connote the immediate idea of characteristics of the associated goods. Neither generic nor descriptive signs can serve to distinguish and identify the source of goods; therefore, they are not inherently distinctive. Non-conventional signs like colors are also not inherently distinctive because either they are a part of features of goods or functional in nature. In the US, a color sign can never be inherently distinctive (Wal-Mart Stores, Inc. v. Samara Brothers, Inc. (2000). In the EU, a color per se is not inherently distinctive except in exceptional circumstances where the number of goods or services to which the sign is applied are restricted (Libertel Grope BV v. Benelux-Merkenbureau (2003).</p> <p>Suggestive signs when applied to goods, requires some imagination to reach a conclusion as to the characteristics of the goods (In re N.C. Lottery (2017). Whether a sign is descriptive or suggestive can be ascertained if there is incongruity in the sign. Arbitrary and fanciful signs have no relationship with the associated goods and are distinctively stronger than suggestive signs (Nautilus Grp. v. Icon Health & Fitness (2004). These three types of signs are inherently distinctive due to their intrinsic nature which serves to identify a particular source.</p> <p><strong>Acquired Distinctiveness/Secondary Meaning</strong></p> <p>Some signs not inherently distinctive may acquire distinctiveness if they develop a secondary meaning in the minds of the public identifying the source of the product instead of the product itself. Secondary meaning can be acquired through consistent and extensive use of the sign causing a consumer to understand the sign has come to identify associated goods as originating from a particular undertaking. The legal issue here is whether a relevant class of people identifies goods as originating from a particular undertaking. In answering this issue, several factors must be considered such as geographical area, market share, length, and intensity of use (Windsurfing Chiemsee Produktions v Walter Huber (1999). In the US, signs having acquired distinctiveness have a lesser degree of trademark protection in comparison to inherently distinctive signs (TCPIP Holding Co. v. Haar Communications, Inc.
