class="ds-related-work--abstract ds2-5-body-sm">The most striking ontological difference between intellectual property and tangible property is that ownership of intellectual property appears to be a matter of controlling token instantiations of a type. But there are two challenges to this way of understanding intellectual property. The first challenge arises from the following problem. If intellectual objects (symphonies, inventions and so on) are types, not tokens, they are also abstract objects, which cannot enter into causal relations. However, since intellectual objects are created objects, it seems that they can enter into causal relations. After responding to this challenge, calling into question the proposition that abstract types cannot be caused, a second, jurisprudential challenge to intellectual property is considered. To choose publishing instead of patenting and openness instead of enclosure was hardly a radical choice at the time. Traditionally, we associate academic publishing with " pure science " and Mertonian ideals of openness , sharing and transparency. Patenting on the other hand, as a byproduct of " applied science " is intimately linked to an increased emphasis and dependency on commercialization and technology transfer within academia. Starting from the Curies' mythological decision I delineate the contours of an increasing convergence of the patent and the paper (article) from the end of the nineteenth-century until today. In Part 1, I show that late nineteenth-century cultural developments in the urban Northeast gave rise to a stigma surrounding the "ornamental" and "decorative" works under the then-exclusive purview of design-patent protection. Among the politically dominant segments of American society, the creation, appreciation, and consumption of design "for its own sake" grew increasingly intertwined with notions of decadence, effeminacy, and sexual "deviance." In Part 2, I examine influential design-patent decisions from the 1870s through the 1930s against that cultural backdrop. My close reading of these decisions demonstrates that federal judges, particularly in pivotal cases decided by the Second Circuit, increasingly used design-patent disputes as a vehicle for the performance and endorsement of gendered values.
