Additionally, it acts as a safeguard against monopolistic tendencies, ensuring a dynamic marketplace that aligns with principles of sustainable management and social responsibility.</p></div> </div> <div class="definition-section"> <h3 id="part-texte" class="definition-section-title">Commentary</h3> <div class="crayon article-texte-117398 texte surlignable"><p><strong>Sustainability through innovation </strong></p> <p>Sustainability thrives in a competitive market as businesses strive to introduce the most innovative and environmentally friendly practices. This drive for innovation in sustainability is often accelerated by competitive pressures, encouraging companies to not only comply with the necessary standards but to surpass them in pursuit of market differentiation and consumer preference. Indeed, market forces play a significant role in driving eco-innovation. The rise in consumer demand for sustainable products has led companies to innovate to meet these new preferences. A case in point is the development of renewable energy technologies, such as solar and wind power, which have been bolstered by both consumer interest and lately numerous supportive governmental policies.</p> <p>Several countries, such as Germany, Spain, the UK, China, and Japan, have embraced Feed-in Tariffs (FiTs) to stimulate renewable energy growth. Succinctly, FiTs are policy mechanisms that accelerate investments in renewable energy. A FiT establishes a long-term contract between an energy generator and a utility company. The terms of the contract define a set price that the utility will pay for energy generated by the renewable resource over a period of time (typically 20 years). In some cases, the contract may also include an annual recalibration to account for inflation. These FiTs not only encourage diverse energy market participation but also drive innovation in sustainable technologies. By offering incentives for green energy production, they catalyse advancements in renewable sectors, aligning with competition law’s objectives.</p> <p><strong>Barriers to sustainability</strong></p> <p>This is not a classic <a href="https://www.concurrences.com/en/dictionary/entry-barriers">barrier to entry</a> approach, but more of a barrier to becoming sustainable. Thus, fair competition is the key to overcoming anticompetitive barriers, allowing businesses to freely embrace sustainable practices without facing unjust market restrictions, due to overly complicated legislation.</p> <p>Moving on to a few practical examples, under the Brazilian Antitrust Law, the Administrative Council for Economic Defense (CADE) actively dismantles barriers to fair competition, particularly in the agricultural sector. They achieve this by promoting transparency and market access, supporting sustainable certification programmes, and promoting private-public partnerships. This approach not only facilitates entry for smaller businesses but also promotes sustainable farming practices and environmental conservation.</p> <p>In South Korea, the Korea Fair Trade Commission (KFTC) employs the Monopoly Regulation and Fair Trade Act to combat abuses of market dominance, especially in industries like electronics and automotive. KFTC fosters an inclusive market for innovation by ensuring larger companies do not hinder sustainable technology development. Notably, this approach extends to the <a href="https://www.concurrences.com/en/dictionary/fintech">fintech</a> sector. The integration of fintech has the potential to advance sustainability goals through green finance initiatives and eco-friendly investment platforms.</p> <p>These regulatory actions by both CADE and KFTC serve as examples of how competition law can be strategically used to remove market barriers and enable sustainability, particularly through emerging sectors like <a href="https://www.concurrences.com/en/dictionary/fintech">fintech</a>. Alongside these measures, unified efforts play an increasingly major role, as further elaborated.</p> <p><strong>Sustainability through collective efforts</strong></p> <p>Competition law promotes joint action by market players to address sustainability challenges collectively. Certain jurisdictions have explored exemptions in antitrust laws for collaborations focused on environmental protection.</p> <p>For instance, in Australia, the Competition and Consumer Act 2012 allows companies to seek authorisation from the Australian Competition and Consumer Commission (ACCC) for conduct that may otherwise breach competition laws, if the public benefits (i.e., protecting the environment) outweigh the anti-competitive detriments.</p> <p>Similarly, in Europe, this approach is reinforced through the 2023 EU Guidelines on horizontal cooperation agreements. They recognise that certain collaborations between competitors, especially those aimed at environmental sustainability, can be beneficial in specific circumstances (see Articles 5 “Efficiencies”, 6 “Ancillary Restraints”, and 10 “Environmental Agreements” of the Guidelines). These are a legal basis for competitors to work together on research and development, standard-setting, and joint production initiatives that have a positive environmental impact. However, there is a clear difference between promoting collaborative efforts in favour of sustainability and openly <a href="anti-competitive collaborations">anti-competitive collaborations</a>. This is best illustrated in the European Commission’s decision, the BMW, Daimler, and Volkswagen emissions collusion case. These manufacturers were fined for restricting competition in the development of emission-reducing technology. Contrastingly, in T-Mobile/Tele2 Netherlands (2020) and Veolia Environnement/SITA France (2021), the General Court and the EU Commission respectively approved the merger and the joint venture, acknowledging potential environmental benefits, as per Article 5 of the Guidelines.</p> <p>Collaborative efforts towards sustainability require a unified international approach to address global challenges effectively and ensure a smooth transition to a more environmentally conscious future. As the interconnectedness of economies and ecosystems becomes increasingly apparent, no single country or organisation can tackle these issues in isolation. Therefore, fostering collaboration and coordination on an international scale is essential. As Simon Holmes points out in his book “<a href="https://www.concurrences.com/en/all-books/competition-law-climate-change-environmental-sustainability">Competition Law, Climate Change & Environmental Sustainability</a>”, there is much more that businesses can do within the current legal frameworks, if we are to fight climate change and move towards a more sustainable future, at the necessary pace. While there is room for improvement in existing legislations and government actions, urgent focus is required to catalyse convergent efforts towards sustainability.</p> <p><strong>The global dimension</strong></p> <p>Achieving sustainability hinges on a concerted international effort that integrates competition law with environmental standards. The linchpin lies in forging a global consensus on these standards within competition law frameworks. By establishing uniformity, we level the playing field for multinational corporations across jurisdictions, advancing consistent enforcement of eco-friendly practices. An integral part of this is the adoption of global standards, such as the UN Global Compact’s principles, the OECD Guidelines for Multinational Enterprises, as well as the UN Sustainable Development Goals. These are aimed at encouraging businesses to work together in areas such as climate action, green energy, or responsible production, mandating the necessity of a common approach, in line with competition law considerations.</p> <p>Integrating these principles into international trade agreements furthers the commitment to sustainable economic growth, and developing nations, in particular, stand at a crucial juncture. Often experiencing rapid industrialisation and economic expansion, they have the opportunity to shape their competition laws with environmental goals in mind from the outset. Providing support to these countries in drafting legislation that incorporates said goals is thus crucial for inclusive progress, and for the avoidance of long-term ecological damage.</p> <p>However, non-uniform regulations across different countries create imbalances and can disadvantage developing economies trying to compete on a global market. Stringent environmental regulations in one country could increase production costs, making it difficult to compete with producers in other countries with laxer regulations, even if the latter’s practices are less sustainable. This highlights the need for cross-border harmonisation of environmental standards and competition law principles, without impeding the development aspirations of emerging economies.</p> <p>Sustainability regulations are reshaping markets, creating exciting "green" opportunities while requiring compliance that can impact competition. In this emerging field, dominant players could exploit new markets, strict costs could disadvantage smaller players, standardisation might stifle innovation, while greenwashing risks misleading consumers, highlighting once again the crucial role of competition law. Accurately defining markets, carefully evaluating mergers, tackling abuse of dominance, and protecting consumers from misleading claims are key areas of focus.
