The principle of State sovereignty has served as a foundation of the international legal order for centuries because the State is traditionally considered to be the subject as well as the maker of international law. It is, however, a very contentious principle because many attempts have been made to give it a specific content, but this content has to be redefined in the light of modern trends and developments at the international level, which is then reflected at the national level. The concept has therefore always existed within an interstate paradigm, whereby States interact, cooperate and bargain with one another to serve and safeguard their own interests. However, the human rights movement has changed this state of affairs, and the creation of a permanent international criminal court represents a culmination of this movement. It aims to sensitize the world against gross human rights violations through the threat of legal action. The rapid entry of the Rome Statute on July 1, 2002 heralds a new era in international politics. It opens new avenues for the international community to monitor human rights violations within states and bring the delinquent individuals to trial. One of the main reasons for the court to come into existence after the end of the Cold War is that many crimes committed against humanity have been ignored by states either due to 'military necessity' or under the national sovereignty and territorial integrity clause. The ICC does involve a certain sacrifice of sovereignty because it envisages asserting itself when a state refuses or fails to use its national criminal justice apparatus to deal with the perpetrator of crimes against humanity. This paper argues that the ICC challenges the exclusivity of sovereign states. Non-state parties claim that the Court is illegitimate and that its jurisdictional claim over their nationals violates the principle of consent in public international law. This thesis aims to develop interdisciplinary research into international relations and international law by asking the question of how the alleged legitimacy deficit of the ICC can be alleviated. The interdisciplinary methodology is approached through supplementing the legal dogmatic method with international relations theory. When the provisions regarding the jurisdiction of the ICC in the Rome Statute (the Statute) are examined, it is clear that the jurisdiction of the ICC is not universal but a subsidiary jurisdiction. Therefore, the ICC cannot exercise its jurisdiction directly and must give priority to the jurisdiction of the state in case of an international crime mentioned in the Statute. It has been argued that the jurisdictional relationship between the ICC and state parties has a horizontal framework. That is, national systems have priority, but the ICC may take over the jurisdiction when national systems completely fail in prosecution process. Since the relationship between national states and international jurisdictions is not vertical, the principle of universal jurisdiction has not been preferred for the ICC. However, preventing major international crimes requires cooperation between states and international jurisdictions such as the ICC in criminal matters. The subject of the jurisdiction, that is, crimes within the jurisdiction of the ICC, was not dealt with in detail while we aim to critically examine how the ICC use their jurisdiction against the national powers of the states and what kind of mechanism is accepted in this regard. Furthermore, the issue is not only dealt with the perspective of the states’ sovereignty, but also theoretical and practical dimensions of the complementarity principle adopted in the Statute in the legal framework are taken into consideration.
