This study is an attempt to analyze the regimes by which sex work is regulated in different countries and in different States within Mexico. For the particular case of Mexico, commercial sex work or prostitution exists legally but it is a phenomenon with many stereotypes that very few really acknowledge or understand. After putting into context what is commercial sex work, different legal frameworks will be analyzed; this research will conclude with a series of recommendations to raise the awareness of local The intention of such a tripartite typology is that it can serve as a tool for assessing, evaluating and comparing prostitution policies, even in cases where they seem to contain contradictory or incoherent elements. Besides using the prostitution policy typology for analytical purposes, it can also serve as a tool for developing context-sensitive measures against violence, exploitation and trafficking in human beings in the sex work sector. I refer to the inter-relations between national laws concerning prostitution that are inspired by an abolitionist model; municipal measures that are close to prohibitionism; police practices that evoke regulamentarianism; legal measures and national plans for confronting human trafficking and laws concerning migration. Neoliberal governmentality is a practice of ruling people that interweaves aspirations of individuals with the demands of the market. By theorising governmentality in the context of sex work in Tijuana, it is my intention to move beyond the limited discussion of voluntary versus forced prostitution, in order to stress that sex work has become entangled in ambiguous and simultaneous processes: on the one hand, it can generate personal empowerment and agency, and on the other hand, it demands the individual‟s subjection to a neoliberal market regime. The article will explain the liberties allowed by Tijuana‟s sex industry, and elucidate why sex workers prefer managerial sex-work arrangements to personalistic ways of selling sex based on pimps as intermediaries. Despite challenges of selling sex, the income generated from sex work at the US–Mexico border allows many women to create new lifestyles. Sex work is used as a strategic means to realise a project of self-actualisation, which is linked to the desire for economic well-being and upward social mobility. While all policy is about the struggle over values and categories, conceptually prostitution policy can best be understood as an instance of morality politics. Without hypostatizing morality politics, we define it as having six characteristics: it is ruled by an explicit ideology; experts have limited authority as everyone feels they "own" prostitution policy; it is highly emotionally charged; it is resistant to facts; the symbolism of policy formulation is seen as more important than policy implementation; and it is subject to abrupt changes. We then analyze three implications of the adversarial nature of prostitution policy. First, we discuss the cavalier attitude of relevant actors towards precise and reliable numbers. Second, by focusing on "forced prostitution" and "trafficking", we discuss the ideological and obfuscating nature of key concepts in prostitution policy. We suggest instead using the concept of "exploitation". Finally, we focus on policy implementation. We argue that the common concept of policy regime has limited value and that to understand the development of prostitution policy, its outcomes, and its impact on society, attention to the mundane details of policy implementation is required.
