Write to us at:<br/> <code>Cradducks Farm, Goudhurst Road, Staplehurst, Kent, TN12 0HQ, United Kingdom</code>. </p> <p> We are the data controller for the purpose of the Data Protection Act 1998 and we will be bound by the <a href="/privacy-policy">Privacy Policy</a> in relation to the storage and use of your personal data. </p> <hr class="dashed"/> <h3>Agreed definitions</h3> <p> <b>Anonymous User</b> - any person or machine that accesses our service that has not completed our account registration process or is not signed in to their account using their account credentials. </p> <p> <b>Registered User</b> - any person or machine that has provided valid and active credentials on behalf of a person who has completed the registration process. </p> <p> <b>Uploaded Content</b> - any content (usually digital images) uploaded or submitted to any part of our Service. </p> <p> <b>Processed Content</b> - content generated and served by our Service as a result of processing Uploaded Content. </p> <hr class="dashed"/> <h3>1. Uploaded images</h3> <p> You retain all rights to images you submit to our Service (Uploaded Content) as well as the resulting processed images (Processed Content). You permit Zara 4 and its connected service providers the right to temporarily store and modify your images so as to provide the Service to you. </p> <p> You permit Zara 4 and its connected service providers the right to permanently store meta data related to any Uploaded Content and resulting Processed Content. For example (but not exclusively) file size, file type, timestamps, colour samples, and content hashes. </p> <p> Uploaded Content and Processed Content will be accessible for up to 24 hours, after which point they are scheduled to be permanently deleted. We offer no guarantee that deletion will occur at this point as under some circumstances (including compliance with law enforcement) it is necessary for us to retain Uploaded Content and Processed Content for longer periods of time. </p> <p> Processed Content for Anonymous Users will be publicly accessible (visible to any person) until they are deleted from our servers. Processed Content for Registered Users should (under normal circumstances) only be accessible to the Registered User who submitted the Uploaded Content, however we offer no guarantee that any Uploaded Content or Processed Content will be private or protected. </p> <hr class="dashed"/> <h3>2. Quotas and limits</h3> <p> You acknowledge and agree that Zara 4 imposes limitations on the size of Uploaded Content and the number of requests you may submit to the Service. </p> <p> Zara 4 may change the quotas and limitations imposed upon all users including all Anonymous User and Registered Users. Alterations to quotas and limitations are at the sole discretion of Zara 4. </p> <hr class="dashed"/> <h3>3. Material on our site</h3> <p> All copyright, database rights, trade marks and design rights in our site and in the material published on it belong to us, our licensors or our users. </p> <p> You may download material from our site for the sole purpose of using our site, but you must not copy, transmit, modify, republish, save, pass off or link to any content or material on our site that you do not own without our prior written consent. </p> <p> You may forward material from our site to third parties by using the 'Send to Friend' tool. By using this tool you confirm that you have obtained prior consent to receiving material from our site from any third parties to whom you send material. </p> <hr class="dashed"/> <h3>4. Claims</h3> <p> Although we may provide the technical platform to enable online payment, we are not responsible for the payment solutions themselves. In particular, we are not responsible for any decision taken by Stripe or another provider to decline your payment, based on its risk assessment of you or that transaction. You shall not hold us liable for any losses you suffer as a result of making an online payment. If you need customer support in relation to an online payment, you should contact Stripe or your bank or credit card provider (as applicable). </p> <p> You agree to indemnify and keep us indemnified from and against any and all claims, actions, proceedings, damages, losses, liabilities and expenses (including legal fees) suffered or incurred by us arising out of or in connection with your use of our online payment platform, in particular any claims from Stripe or other payment solution providers resulting from your actions or omissions. </p> <hr class="dashed"/> <h3>5. Our limitation of liability and responsibility</h3> <p> Although we will do our best to prevent intentional misuse of our site and the dissemination of harmful programs via our site, we will not be liable for any loss or damage caused by any intentional misuse of our site or the distribution of viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site. </p> <p> If we are in breach of these terms or otherwise liable to you (including, without limitation, for our negligence), we will only be responsible for any direct damages or losses you incur that result from your use of our site up to the value of the fees (if any) that you have paid to us.
