just a little over a year after the U.S. invasion of Iraq and before the sectarian violence began, the Iraqi Association of University Teachers (AUT) reported that <a href="https://web.archive.org/web/20130126160855/http://www.timeshighereducation.co.uk/story.asp?storyCode=191084&amp;sectioncode=26" class="external" target="_blank">250 academics had been killed</a>. Award-winning British journalist Robert Fisk <a href="https://web.archive.org/web/20130126160855/http://www.thetruthseeker.co.uk/article.asp?ID=2042" class="external" target="_blank">had warned</a> early that year of the assassinations of Iraqi academics, but few U.S. newspapers picked up on the story.&#160; By the end of 2006, according to<a href="https://web.archive.org/web/20130126160855/http://www.independent.co.uk/news/education/higher/iraqs-universities-are-in-meltdown-427316.html" class="external" target="_blank"> <em>The Independent</em></a>, over 470 academics had been killed. Another British paper, <em>The Guardian</em>, <a href="https://web.archive.org/web/20130126160855/http://www.guardian.co.uk/education/2006/dec/12/internationaleducationnews.highereducation" class="external" target="_blank">reported</a> that about 500 academics were killed just from the Universities of Baghdad and Basra alone.</p> <p>Based on multiple sources, the B<em>Russell</em>s Tribunal sifted through such reports and <a href="https://web.archive.org/web/20130126160855/http://www.brusselstribunal.org/Academics.htm" class="external" target="_blank">published on its website</a> the names of over 400 murdered academics and when they were killed. Although the exact total number of assassinated academics is not really known, the indefatigable advocate for human rights Dirk Adriaensens gives a detailed analysis of the data available so far in his contribution to the book <em><a href="https://web.archive.org/web/20130126160855/http://us.macmillan.com/culturalcleansinginiraq" class="external" target="_blank">Cultural Cleansing in Iraq</a></em>. According to Adriaensens, most of those killed were from the Universities of Bagdad (57 percent) and Basra (14 percent). In addition, 35 percent died in detention after being arrested/kidnapped by some security forces. The modus operandi for the killings was a professional, well-organized assassination. Fifty-four percent of the deaths occurred as a targeted killing, at point-blank range with hand guns or automatic weapons. The killing of academics did not follow any sectarian agenda since the murdered were Sunni and Shia. No one has taken responsibility for the killings, and no one has been arrested.</p> <p>The reports of these murdered Iraqi academics have been around for a few years, mostly in the foreign press and on websites. I admit to an initial skepticism about their veracity. I was even more concerned about who was responsible for these heinous crimes and why. Iraqis living in Iraq knew of these murders first-hand, but did not know the culprits. Their suspicions fell naturally on the occupying power.</p> <p>Along with these tragic deaths was the concomitant wave of death threats and intimidation against other Iraqi academics, which resulted in tens of thousands of Iraqi academics literally running abroad for their life. <em>The Washington Post </em>recently described the <a href="https://web.archive.org/web/20130126160855/http://www.washingtonpost.com/wp-dyn/content/article/2010/11/23/AR2010112306747.html" class="external" target="_blank">plight of one Iraqi family</a> living in the United States after the husband, a professor, was assassinated and the wife, a physician, survived but gravely wounded. For some, the escape abroad was only temporary. A<a href="https://web.archive.org/web/20130126160855/http://iraqiacademicsunderattack.wordpress.com/2010/10/27/two-iraqi-academics-killed-after-their-returning-to-iraq-english-arabic-castellano/" class="external" target="_blank"> professor and a dean</a> who left and returned in the past six months to Iraq were professionally assassinated.&#160; Iraq has suffered the decapitation of its intellectual class on a staggering scale, which has thrown the country back to the dark ages.</p> <p>According to the new revelations of Wikileaks, in some cases the United States, through the military, contractors, and others, killed innocent Iraqi civilians including women and children. As a matter of policy we handed over Iraqi detainees to Iraqi security forces with full knowledge that they would be subjected to torture, rape, and murder. Moreover, when our military received the reports of torture, rape, and murder it chose to ignore them. Such a policy is contrary to international law, U.S. laws, and American values.</p> <p>It&#8217;s not clear whether the U.S. government or the U.S. military knows who assassinated the Iraqi academics. We don&#8217;t know if U.S. officials or military commanders looked the other way when local security forces committed those crimes. But the Wikileaks documents raise many disturbing questions about a possible U.S. role in these assassinations. Even the Gulf Cooperation Council, and its half-dozen U.S.-friendly Arab members, has <a href="https://web.archive.org/web/20130126160855/http://www.google.com/hostednews/afp/article/ALeqM5hiUt15hxCn1JG0tU8iLw_Oj6yb8A?docId=CNG.1c29e0b64ef02ac621d8a8911f61ba89.191" class="external" target="_blank">called on</a> the Obama administration to &quot;open a serious and transparent investigation&quot; into possible &quot;crimes against humanity.&quot;</p> <p>The evidence so far is sufficient to warrant a thorough investigation by an independent body. The city of Fallujah, about 60km west of Baghdad, still has no functioning sewage system: Waste pours onto the streets and seeps into drinking water supplies. </p> <p>The city’s infrastructure was in ruins after two fierce battles between US forces and Sunni militants in 2004. In a bid to garner local support for the 2003 US-led invasion of Iraq, US officials pledged to build a sewage treatment plant at a cost of US$35 million. </p> <p>Work began in July 2004 and was supposed to be completed in 18 months, but continuing violence, design changes and the replacement of incompetent contractors delayed the project and costs ballooned to over $100 million. </p> <p>Six years on and with US forces preparing to withdraw from Iraq next month, not a single house is connected to the system. The US army has decided to hand over the partially finished project to a local contractor with the promise of providing the necessary funding to complete it. </p> <p>&quot;The project is in its final stages and is expected to be handed over by the end of this year,&quot; Sheikh Hameed al-Alwan, head of Fallujah local council, told IRIN. &quot;But unfortunately the plant will work only partially as its backbone, which is the main pipeline that sends all the waste to the main processing unit, will not be constructed because of the lack of funds.&quot; </p> <p>Without this vital pipeline, the plant will serve only a fraction of the city’s 580,000 residents, al-Alwan said, adding that the worst affected would be those in suburban areas. “Our only hope is that the Americans can secure the money to complete it, especially after the Iraqi government has said it does not have enough to allocate to it.” </p> <h3>Foul smells </h3> <p>Foul-smelling sewage has run through the rutted and pockmarked streets of Fallujah for more than three years. Residents currently depend on underground septic tanks which are in many cases leaking waste onto the streets from where it eventually ends up in the River Euphrates, a main drinking water source for Fallujah and other downstream cities. </p> <p>Abdul-Sattar Kadhum al-Nawaf, director of Fallujah general hospital, said the sewage problem had taken its toll on residents’ health. They were increasingly affected by diarrhoea, tuberculosis, typhoid and other communicable diseases. </p> <p>Al-Nawaf said that although he did not have specific numbers, 10-15 percent of patients at his hospital had water or sewage-related diseases. </p> <p>Experts say the Fallujah plant is just one of many abandoned, incomplete or hastily finished projects around the country. </p> <p>Anbar-based analyst Khudhair Jassim Ali, who lectures at the university, said that a lack of funds, corruption and a lack of cooperation between the government and companies working on projects have delayed badly needed infrastructure projects. </p> <p>&quot;The government should follow up with these projects to take over from those parties that will leave Iraq, whether US forces or NGOs. What has remained of Iraq is still being devastated by bombings, assassinations, corruption, millions of evictions and continued infrastructure destruction. Yet the world that caused all this is trying to draw a rosy picture of the situation in Iraq.”</em></p> <p>-Maki Al-Nazzal, Iraqi political analyst</p> </blockquote> <p>As Afghanistan has taken center stage in U.S. corporate media, with President Barack Obama announcing two major escalations of the war in recent months, the U.S. occupation of Iraq has fallen into the media shadows.</p> <p>But while U.S. forces have begun to slowly pull back in Iraq, approximately 130,000 American troops and 114,000 private contractors still remain in the country (Congressional Research Service, 12/14/09)-along with an embassy the size of Vatican City. Upwards of 400 Iraqi civilians still die in a typical month (Iraq Body Count, 12/31/09), and fallout from the occupation that is now responsible, by some estimates, for 1 million Iraqi deaths (<strong>Extra!</strong>, 1/2/08) continues to severely impact Iraqis in ways that go uncovered by the U.S. press.</p> <p>From early on in the occupation of Iraq, one of the most pressing concerns for Iraqis-besides ending the occupation and a desperate need for security-has been basic infrastructure. The average home in Iraq today, over six and a half years into the occupation, operates on less than six hours of electricity per day (<strong>AP</strong>, 9/7/09). “A water shortage described as the most critical since the earliest days of Iraq’s civilization is threatening to leave up to 2 million people in the south of the country without electricity and almost as many without drinking water,” the <strong>Guardian</strong> (8/26/09) reported; waterborne diseases and dysentery are rampant. The ongoing lack of power and clean drinking water has even led Iraqis to take to the streets in Baghdad (<strong>AP</strong>, 10/11/09), chanting, “No water, no electricity in the country of oil and the two rivers.”</p> <p>Devastation wrought by the occupation, coupled with rampant corruption among the Western contractors awarded the contracts to rebuild Iraq’s demolished infrastructure, are to blame (<strong>International Herald Tribune</strong>, 7/6/09). Ali Ghalib Baban, Iraq’s minister of planning, said late last year (<strong>International Herald Tribune</strong>, 11/21/09) that the billions of dollars the U.S. has spent on so-called reconstruction contracts in Iraq has had no discernible impact. “Maybe they spent it,” he said, “but Iraq doesn’t feel it.”</p> <p>Last January, the <strong>Los Angeles Times</strong> ran a story (1/26/09) that highlighted the lack of electricity: “As elections near, people say it’s hard to have faith in leaders when they don’t even have electricity,” was the subhead. But most other large U.S. papers have avoided the topic-unless it is brought up in such a way as to blame Iraqis for the problem, as the <strong>New York Times</strong> (11/21/09) did with its piece, “U.S. Fears Iraqis Will Not Keep Up Rebuilt Projects.”</p> <p>Further complicating matters, a drought that is now over four years old plagues most of Iraq. In the country’s north, lack of water has forced more than 100,000 people to abandon their homes since 2005, with 36,000 more on the verge of leaving (<strong>AP</strong>, 10/13/09).</p> <p>Corporate media coverage of the ongoing Iraqi refugee crisis-the U.N. estimates that more than 4.5 million Iraqis in all have been displaced from their homes (UNHCR.org, 1/09)-continues to be scant. The stories that do appear tend to be local stories about Iraqi refugees in the newspaper’s home city (e.g., <strong>Chicago Tribune</strong>, 10/25/09).</p> <p>For Iraqis who remain in the country, another critical story is cancer. The U.S. and British militaries used more than 1,700 tons of depleted uranium in Iraq in the 2003 invasion (<strong>Jane’s Defence News</strong>, 4/2/04)-on top of 320 tons used in the 1991 Gulf War (<strong>Inter Press Service</strong>, 3/25/03). Literally every local person I’ve ever spoken with in Iraq during my nine months of reporting there knows someone who either suffers from or has died of cancer.</p> <p>The lead paragraph of an article by Jalal Ghazi, for <strong>New America Media</strong> (1/6/10), is blunt:</p> <p>Forget about oil, occupation, terrorism or even Al-Qaeda. The real hazard for Iraqis these days is cancer. Cancer is spreading like wildfire in Iraq. Thousands of infants are being born with deformities. Doctors say they are struggling to cope with the rise of cancer and birth defects, especially in cities subjected to heavy American and British bombardment.</p> <p>Ghazi reported that in Fallujah, which bore the brunt of two massive U.S. military operations in 2004, as many as 25 percent of newborn infants have serious physical abnormalities. Cancer rates in Babil, an area south of Baghdad, have risen from 500 cases in 2004 to more than 9,000 in 2009. Dr. Jawad al-Ali, the director of the Oncology Center in Basra, told <strong>Al Jazeera English</strong> (10/12/09) that there were 1,885 cases of cancer in all of 2005; between 1,250 and 1,500 patients visit his center every month now.</p> <p>Babies born to U.S. veterans of the 1991 war are showing birth defects very similar to affected Iraqi babies (<strong>Sunday Herald</strong>, 3/30/03), and many U.S. soldiers are now referring to Gulf War Syndrome 2, alleging they have developed cancer because of exposure to depleted uranium in Iraq (<strong>New America Media</strong>, 1/6/10).</p> <p>How has this ongoing story been covered by the corporate media? It hasn’t, at least not in the last five years, with the exception of an article in <strong>Vanity Fair</strong> (2/05) and a few isolated <strong>Associated Press</strong> stories, like “Sickened Iraq Vets Cite Depleted Uranium” (8/13/06). While smaller publications like the<strong> Washington Report on Middle East Affairs</strong> (11/05) and the<strong> Public Record</strong> (10/19/09) have taken it on, none of the other big outlets have touched the story.</p> <p>While U.S. newspapers have been following the lead-up to the Iraq elections, there has been virtually no coverage of the mass arrests Prime Minister Nouri Al-Maliki’s government is busy conducting in predominantly Sunni areas of Iraq. As the Iraqi daily <strong>Azzaman </strong>(1/4/10) reported:</p> <p>Iraqi security forces have launched a wide campaign in Sunni Muslim-dominated neighborhoods of Baghdad and towns and cities to the north and west of the capital…. The campaign is said to be the widest by the government in years and has led to an exodus of people to the Kurdish north.</p> <p>Family members of those being arrested are not told where their loved ones are being held, only that those arrested will remain behind bars until after the elections. These sweeps have collected members of the formerly U.S.-backed Awakening Councils, Sunni militias once paid off by the U.S. to stop their attacks on occupation forces. The cutoff of U.S. support for the Councils is another underreported story.</p> <p>Meanwhile, the hardship for Iraqis continues unabated, along with the need to find alternative sources for accurate information-or any information-about an occupation that continues to involve as many troops as when Iraq dominated U.S. headlines in 2004 (Congressional Research Service, 7/2/09).</p> <p><em>Dahr Jamail is an independent journalist who has been reporting about the U.S. occupation of Iraq for more than six years. الوزراء بحضور عوائل ضحايا الحادث والجرحى، إن “رئيس الوزراء أصدر أمرا الى مكتب الاستشارات القانونية التابع لمجلس الوزراء بمتابعة قضية بلاك ووتر والدفاع عن الضحايا، والحصول على تعويض لهم”. <br/>واضاف الدباغ ان “الحكومة لن تتساهل في قرار المحكمة الامريكية القاضي بتبرئة عناصر بلاك ووتر من التهم التي وجهت اليهم” في اطار قضية الهجوم على مدنيين عراقيين في ساحة النسور ببغداد ، مبينا ان الحكومة ومنذ وقوع الحادث اخذت بنصيحة وزارة العدل الامريكية التي رفعت دعوى ضد الشركة وقامت بمتابعة القضية”. <br/>ونقل الدباغ رفض الحكومة واستغرابها من القرار الذي صدر عن المحكمة الامريكية بحق عناصر الشركة، معربا عن اعتقاده ان “المحكمة حكمت شكلا وليس موضوعا”. <br/>وكانت محكمة امريكية قد أسقطت التهم عن خمسة حراس امنيين امريكيين من شركة بلاك ووتر متهمين بقتل 17 مدنيا عراقيا على الاقل في ساحة النسور ببغداد عام 2007. align="right"> <p>أعرب مدير عام رصد الأداء وحماية الحقوق في وزارة حقوق الإنسان كامل أمين عن خيبة أمل الوزارة مما وصفه بالقرار المتسرع للمحكمة الاتحادية الأميركية في تبرئة عناصر شركة بلاك ووتر الأمنية المتهمين بقتل 17 مواطنا عراقيا في ساحة النسور منتصف أيلول/ سبتمبر عام 2007. <br/>وقال أمين في حديث اذاعي إنه تمت مخاطبة السفارة الأميركية في العراق للحصول على النص الرسمي لقرار المحكمة ، مرجحا قيام القضاء الأميركي بتنسيق آلية المحاكمة بما يتناسب والإفلات من عقوبة القتل. <br/>إلى ذلك وصف رئيس لجنة حقوق الإنسان النيابية محمد الحيدري قرار المحكمة بالمتحيز، مطالبا بإعادة المحاكمة في العراق. <br/>وتسعى الحكومة العراقية إلى استشارة بعض المتخصصين في القضاء الأميركي لمعرفة الآلية القضائية للمحاكم الأميركية وإمكانية تحريك دعاوى العائلات المتضررة لفتح ملف شركة بلاك ووتر مرة أخرى في ظل تأكيدات align="right"> <p>عدت نقابة المحامين العراقيين، السبت، قرار محكمة أمريكية بإسقاط التهم عن عناصر بلاكووتر في قضية مقتل عراقيين، انه لايستند على أسباب قانونية مقنعة، وعدم احترام الشعب العراقي واستهانة بهم، ودعت المنظمات القانونية والحقوقية والإنسانية الى عدم السكوت والتصدي بحزم لقرار المحكمة الاتحادية الأمريكية، بحسب بيان للنقابة. <br/>ونقل البيان عن نقيب المحامين ضياء السعدي ان “إسقاط التهم عن الجناة، وبدون أسباب قانونية مقنعة، جاء على خلفية عدم احترام الشعب العراقي وحقه في الحياة واستهانة غير مقبولة بدم أبنائه ، مشيرا الى ان الزعم بوجود حالة من الدفاع الشرعي تكذبه الوقائع والادلة المتحصلة نتيجة التحقيقات التي اجرتها السلطات العراقية والأمريكية ، لعدم توفر شروط وأركان حالة الدفاع الشرعي طبقا للقواعد القانونية” <br/>وبين ان “الجناة لم يلزموا ابتداء بقواعد استخدام السلاح عندما استهدفوا عراقيين مدنيين عزل من السلاح تواجدوا بالصدفة في منطقة مدنية ، ومما يعزز ذلك اعتراف احد الجناة بالذنب لارتكابه جريمة القتل”. <br/>ودعا السعدي “انهاء كافة العقود المبرمة مع الشركات الامنية الخاصة، فضلا عن تواجدها لانه غير مرغوب به في العراق”. مشددا على “وجوب احترام السيادة الوطنية ، القانونية والقضائية ، وعدم انتهاك احكام المادة 6 من قانون العقوبات العراقي النافذ رقم 111 لسنة 1969 المتعلقة بالاختصاص الاقليمي ، والتي نصت بوضوح على تطبيق القانون العراقي للنظر في الجرائم التي تقع في الاراضي العراقية”. <br/>وكان القاضي الاتحادي في الولايات المتحدة الامريكية اصدر الجمعة قرارا باسقاط التهم عن عناصر شركة بلاك ووتر الذين اتهموا بقتل 17 عراقيا في ايلول سبتمبر من عام 2007، بعد ان اطلقوا عليهم النار بشكل عشوائي في ساحة النسور بالعاصمة ودون وجود اي تهديد بحسب ما اسفرت عنه التحقيقات التي اجرتها السلطات العراقية. <br/>وأعلن الناطق الرسمي بإسم الحكومة العراقية علي الدباغ في أمس الجمعة، أن الحكومة العراقية بدأت بإتخاذ ما يلزم لمقاضاة شركة بلاك ووتر بشأن جريمة ساحة النسور في بغداد عام 2007، مبينا أن الحكومة العراقية تعتبر الحكم الصادر من قبل القاضي الإتحادي الامريكي مُجحفاً وغير مقبول”، داعيا “وزارة العدل الامريكية لإستئنافه لأنه يسبب ضرراً بالغاً لحقوق الضحايا وذويهم.</p> </p></div> </div> بلاك ووتر لانهم لن يحبذوا ذلك لاعتقادهم بضرورة معاقبة الذين ارتكبوا الحادث. <br/>واكد اوديرنو انه قلق حيال هذا الأمر لأن من الواضح أن هناك أبرياء قضوا في هذا الهجوم ، فمقتل الأبرياء يقص مضاجع In January 2008, the Iraqi government barred Blackwater from providing security detail to US diplomatic staff in the country, citing the firm&#8217;s use of excessive force.</p> <p>A US congressional investigation into Blackwater operations appeared to corroborate Baghdad&#8217;s accusations that the firm routinely used &quot;excessive&quot; and &quot;pre-emptive&quot; force. In November 2007, FBI investigators found that 14 of the 17 killings had been &quot;unjustified&quot; and violated &quot;deadly force rules&quot; for security contractors operating in Iraq. </p> <p>However, Urbina threw out the case last week saying that US justice department prosecutors had improperly used sworn statements that had been given under a promise of immunity.</p> <p>While the Iraqi government said it regretted the judge&#8217;s decision and vowed to appeal the ruling, ordinary Iraqis are left wondering at the apparent double standards of a legal system which could pioneer rendition, imprisonment and torture based on far less evidence, but fumble a case like this.</p> <p>However, Mohammed Kinani, whose nine-year-old son Ali was killed in the shooting, told Al Jazeera that Urbina&#8217;s dismissal does not signal the end of the criminal or civil cases brought against Blackwater.</p> <p>&quot;The FBI has been investigating this case for 27 months and there are witnesses to the event as well as forensic evidence which indicate that this is not the end of the road,&quot; he said.</p> <h3>&#8216;Utter devastation&#8217;</h3> <p>Kinani, his sister, her three children and Kinani&#8217;s son were in a car in Nisour Square on September 14 when Blackwater guards instructed them to stop.</p> <p>&quot;A few minutes after several cars in the square stopped, they opened fire on us,&quot; Kinani said. &quot;My son was hit, my sister was lightly injured, my car was hit by dozens of rounds. A man in front of me was killed and lying in a pool of his own blood and every few moments they would fire on him again &#8230; they continued pumping bullets into us.</p> <p>&quot;They utterly devastated everything in front of them. As if they were bent on revenge.&quot;</p> <p>Haitham Ahmed, whose wife and son were killed in the shooting, told the Associated Press that the way the prosecution handled the case raises doubts over whether the US justice system could deliver a fair verdict.</p> <p>&quot;If a judge &#8230; dismissed the trial, that is ridiculous and the whole thing has been but a farce,&quot; he said.</p> <p>Dahlia Wasfi, an Iraqi-American who is currently writing a book about the &quot;illegal occupation of Iraq&quot;, says that Iraqis have largely given up on waiting for justice &quot;or democracy, for that matter&quot;, from Washington.</p> <p>&quot;There are over 1.3 million dead Iraqis who deserve justice. There are over 5 million displaced Iraqis who have the right of return to a safe country who deserve justice. What the United States has to understand is that without justice, there will be no peace,&quot; she says.</p> <h3>Immunity to impunity?</h3> <p>But Blackwater Worldwide, since renamed Xe Services, is not the only security contractor operating in Iraq. </p> <p>Since the US-led invasion and occupation in 2003, more than 100 private security firms have set up shop in Iraq, many of their names and mandates unknown to the media. All have been granted immunity from Iraqi prosecution under an agreement signed by Paul Bremer, the Coalition Provisional Authority head, and the Iraqi Governing Council, an interim political body established after the fall of Baghdad, in 2004. Despite the handing of sovereignty to Iraqis on June 30, 2004, this immunity exemption remains in effect today.</p> <p>In fact, private security firms in Iraq, much like Blackwater, took over major tasks and operations, which had previously been primarily assigned to US forces. The hope at the time had been that US forces would remain in their barracks, avoid improvised explosive devices (IEDs) and ambushes, reduce the body count, and keep the US public firmly behind the war. In effect, private security firms become the de facto military presence in Iraq &#8211; outnumbering the official count of non-US military &quot;coalition&quot; forces.</p> <p>As of November 2007, Blackwater had earned more than $485mn in government contracts.</p> <p>&quot;Iraqis are certainly aware &#8211; far more aware than Americans &#8211; that there are numerous groups, armies, and militias working under the occupation to devastate Iraqi society and terrorise them. Blackwater and its henchmen are known in Iraq; in March 2008, Iraqi doctors in Falluja named an outbreak of severe malarial infection &#8216;Blackwater Fever&#8217; because it&#8217;s so lethal,&quot; says Wasfi.</p> <h3>Cursory investigations</h3> <p>The US government has no means of monitoring who the private security contractors are, what they do or how much they are paid and, in June 2009, a US congressional Wartime Contracting Commission found that the US military had failed to provide adequate oversight of private contractors in Iraq and Afghanistan.</p> <p>Iraqis have grown tired of the explanations repeatedly offered as justification for the killing of civilians and say US investigators have only offered cursory investigations, usually siding with the accounts of private security firms.</p> <p>Amnesty International USA has also been critical of the way the US government has handled accusations of impropriety by private security contractors, saying that &quot;the US justice department has largely failed in its obligation to prosecute US contractors for serious human rights violations, and worse, it appears to have taken steps to undermine access to justice&quot;.</p> <p>In his ruling, Judge Urbina said that lead prosecutor Ken Kohl and others &quot;purposefully flouted the advice&quot; of senior justice department officials who told them not to use the statements that he eventually ruled as impermissible.</p> <p>Whether the prosecution&#8217;s faux pas was the result of incompetence or willful sabotage is immaterial at this point; the Blackwater case was seen as a test of future Iraq-US relations, particularly given that US combat troops are to fully withdraw from Iraq by 2011.</p> <p>The case also marked the culmination of years of frustrated efforts by Iraqi civilians and politicians to hold accountable not only private contractors, but the US military as well, for excessive use of force.</p> <p>Kinani says his family is still distraught about the killing of his son but that he derives strength from knowing that the Nisour Square incident not only brought Iraq&#8217;s Shias and Sunnis together but also revealed what ordinary civilians were facing under occupation.</p> <p>&quot;The killings in Nisour Square woke the Iraqi and US authorities to the horrors of what such security firms were doing in Iraq,&quot;
