헌법불합치 결정을 내린 직후, 필자를 비롯한 기후 소송 대리인단과 청소년, 시민, 아기 청구인단은 헌법재판소 정문 앞에서 소리 높여 외쳤다. 과연 이번 기후 소송은 우리에게 어떠한 과제를 남겼을까. </span><br /><br /><span style="text-justify:inter-ideograph">이제 국회와 정부는 탄소중립 목표 시점인 2050년까지 중간적 감축목표를 정해야 한다. 감축목표는 기후 위기로부터 국민의 기본권을 충분히 보호하고, 미래에 지나친 부담을 넘기지 않도록 설정되어야 한다. 헌법재판소는 감축목표가 기후 위기에 대한 보호조치로 필요하고, 최소한의 조건을 갖추려면 ‘과학적 사실’과 ‘국제적 기준’에 근거해 ‘전 지구적 감축 노력에서 우리나라가 기여해야 할 몫’에 부합해야 한다고 결정문에서 수차례 강조했다.</span><br /><br /><strong>헌재 ”감축 노력 소홀하면 기후 위기 대응 실패” </strong><br /><br /><span style="text-justify:inter-ideograph">첫 번째 조건인 ‘과학적 사실’은 이미 주어져 있다. 헌법재판소는 전 지구적 탄소 예산(온난화를 일정한 수준으로 제한하기 위한 이산화탄소 배출 허용 총량)을 과학적 사실의 중요한 사례로 들었다. 기후변화에 관한 정부 간 협의체(IPCC)의 2023년 제6차 보고서에 따르면 온난화를 1.5<span style="font-family:"맑은 고딕 Semilight"">℃</span>로 제한할 확률이 50%인 탄소 예산은 2020년 기준 5000억 톤 남아 있다. 문제는 세계 각국의 현행 감축목표를 모두 달성해도 대부분의 탄소 예산을 소진해 2030년 이후에는 2년 치 배출량 정도만 남게 된다는 것이다.</span><br /><br /><span style="text-justify:inter-ideograph">두 번째 조건인 ‘국제적 기준’ 역시 합의되어 있다. 2023년 12월 제28차 유엔기후변화협약 당사국총회(COP28)가 공인한 전 지구적 감축 경로를, 헌법재판소는 ‘전 지구적 행동 기준에 관한 국제적 합의’로 지목했다. 이에 따르면 전 세계는 1.5℃ 목표를 달성하기 위해 온실가스배출량을 2019년 수준 대비 2030년까지 43%, 2035년까지 60% 감축해야 한다. 그러나 유엔환경계획은 현행 감축목표에 따른 2030년 배출량과 전 지구적 감축 경로 사이에 330억 톤의 격차가 있다고 밝혔다. </span><br /><br /><span style="text-justify:inter-ideograph">과학적 사실과 국제적 기준은 세계 각국이 </span>‘<span style="text-justify:inter-ideograph">온실가스배출량을 깊이 있고, 신속하며, 지속적으로 감축</span>’<span style="text-justify:inter-ideograph">해야 하는 </span>‘<span style="text-justify:inter-ideograph">긴급한 필요성</span>’<span style="text-justify:inter-ideograph">이 있다고 합의하도록 이끌었다. 헌재가 “기후 위기의 위험상황은 전 지구적 연대로 대응해야” 하고, “어떤 국가가 자국의 온실가스 감축 노력만으로는 전 지구적 기후 위기에 대응하기 어렵다는 이유로, 또는 다른 나라의 감축 노력이 불충분하다는 이유를 들어 감축 노력을 소홀히 한다면 결과적으로 모든 국가의 온실가스 감축 노력이 불충분하게 되어 전 지구적 차원의 기후 위기 대응은 실패하고 환경권은 실효적으로 보장될 수 없게 된다”고 경고한 취지도 이와 다르지 않다.</span><br /><br /><strong>한국, 더 많은 감축분 기여해야 </strong><br /><br /><span style="text-justify:inter-ideograph">마지막 조건인 ‘전 지구적 감축 노력에서 우리나라가 기여해야 할 몫’을 정하는 것이 핵심 과제다. 파리기후변화협약은 선진국과 개도국을 아울러 더 많은 국가가 기후 위기 대응에 동참하도록 유도하기 위해 각국이 감축목표를 포함한 국가온실가스 감축목표(NDC)를 자발적으로 정하도록 했다. 그러나 국가가 NDC를 자발적으로 정한다는 것이 감축목표를 아무런 제한 없이 임의적으로 설정해도 된다는 의미는 아니다.<br /><br />파리협정은 각국이 NDC를 수립할 때 “공동의, 그러나 차이가 있는 책임과 각자 역량(Common But Differentiated Responsibilities and Respective Capabilities)”을 반영해야 한다는, 이른바 ‘CBDR/RC 원칙’을 규정했다. 온실가스배출 ‘책임’이 크고 기후 위기 대응 ‘역량’이 강한 선진국이 전 지구적 감축 노력에서 더 많은 몫을 기여해야 한다는 원칙이다.</span><br /><br /><span style="text-justify:inter-ideograph">대한민국은 명실상부한 선진국이다. IPCC가 제시한 선진국</span>·<span style="text-justify:inter-ideograph">개도국 분류 기준(유엔 통계국 분류, 세계은행 분류, 유엔개발계획 인간개발지수) 전부에서 선진국 또는 최고 등급에 해당한다. 온실가스배출에서도 연간 배출량 5위, 1인당 배출량 6위, GDP당 배출량 4위로 그 책임이 막중하다(2020년 OECD 통계 기준). 파리협정이 규정한 CBDR/RC 원칙에 따른다면 대한민국의 감축목표는 헌재가 지목한 국제적 기준인 1.5<span style="font-family:"맑은 고딕 Semilight"">℃ 전 지구적 감축 경로의 전 세계 평균 감축률보다는 적어도 높은 수준으로 설정되어야 할 것이다.</span></span><br /><br /><span style="text-justify:inter-ideograph"><strong>2035 NDC, 첫 번째 시험대 </strong></span><br /><br /><span style="text-justify:inter-ideograph">이제 국회와 정부는 ‘전 지구적 감축 노력에서 우리나라가 기여해야 할 몫’에 대해 숙고하고, 이에 부합하도록 감축목표를 설정할 헌법상 권한과 책임이 있다. 우리 정부가 내년까지 수립해야 하는 2035 NDC는 헌법불합치 결정 이후 마주한 첫 번째 시험대다.<br /><br />현행 2030 NDC는 기준연도인 2018년의 총배출량과 탄소중립 목표 연도인 2050년의 배출량 ‘0’을 직선으로 연결하고, 그 선상에서 중간목표를 설정하는 이른바 ‘선형 감축 경로’에 따라 설정되었다. 이러한 선형 감축 경로는 과학적 사실이나 국제적 기준에 전혀 근거하지 않은 임의적 방식이다. 2035 NDC는 헌법재판소의 결정 취지에 따라 1.5<span style="font-family:"맑은 고딕 Semilight"">℃</span> 목표를 달성하기 위한 전 지구적 감축 노력의 공정 배분을 고려하는 하향식(top-down) 접근법을 도입해 설정해야 할 것이다.</span><br /><br /><span style="text-justify:inter-ideograph">폭염, 홍수, 가뭄, 물·식량 부족, 해수면 상승, 생태계 붕괴 등 기후 위기 위험으로부터 국민과 미래세대의 생명, 건강, 환경에 대한 기본권을 보호할 수 있는 합헌적 수준으로 2035 NDC를 비롯한 탄소중립 시점까지
