We undertook a number of public comment periods that ensured broader community participation in the effort.<br \/>\r\n<br \/>\r\nIn large part, \u2018Sub Pro\u2019 was about coming up with solutions to problems that were experienced during the 2012 New gTLD Program. If you take the time to read the report you\u2019ll see that many of the recommendations are accompanied by implementation guidance that is intended to enhance and hopefully expedite ICANN org\u2019s implementation of the recommendations from the Final Report.<br \/>\r\n<br \/>\r\nWe have been told by the ICANN Board that they have been receiving regular updates on the progress of the work of Sub Pro and undertaking \u2018deeper dives\u2019 on many of the discrete elements of the report as evidenced by input provided by the ICANN Board during public comment periods.<br \/>\r\n<br \/>\r\nSo, what will be different? Not a lot really.\u00a0<\/p>\r\n\r\n<ul>\r\n\t<li>There will still be an Applicant Guidebook that is intended to be streamlined to include information only relevant to the application process\u2014the context and history elements will be separable. The Applicant Guidebook must be published four months before the start of the application submission period, which is to be open for a period of between 12 to 15 weeks.<\/li>\r\n\t<li>dotbrand applications will be recognized in the next process, along with community, geographic and standard applications. In addition, the report also recommends additional requirements for strings associated with regulated industries in accordance with GAC advice from 2012 that resulted in additional safeguards for such strings.<\/li>\r\n\t<li>Application windows will be conducted in rounds and to mitigate the possibility of extended periods between application windows, ICANN org is required to publish the date or specific criteria for opening a subsequent round at the time the next application submission period commences.<\/li>\r\n\t<li>The application fee has not been determined, but the principle of cost neutral has prevailed. The burden will be on ICANN org to decide the application fee, which again will be challenging as while they will be able to estimate the costs associated with implementing the program\u2014the number of applications at this time remains a mystery.<\/li>\r\n\t<li>As a means to streamline the technical component of the application process, back-end registry service providers (RSPs) will be afforded the opportunity to be \u2018pre-approved\u2019 as an RSP before the application window opens. This will enable applicants to choose a pre-approved RSP and negate the need to separately respond to the technical questions and undertake the necessary testing should they wish.\u00a0<\/li>\r\n\t<li>The resolution of contention sets was a controversial topic within the WG and is the only topic that did not result in consensus designations on two of the recommendations: private resolution including private auctions; and ICANN auction of last resort using a second priced sealed bid auction.<\/li>\r\n<\/ul>\r\n\r\n<p>On a personal level, I wish it hadn\u2019t taken five years to get through this policy process, but I cannot fault the dedication and tenacity of those who participated over the period. In the process of preparing for our session and sharing our individual perspectives, it became apparent to us that the best way to progress the next round would be through the release of an updated version of the applicant guidebook, originally released for the previous round of applications.\u00a0<br>\u00a0\u00a0<br>ICANN has recently made some good progress toward moving the next round of the new generic top-level domain (gTLD) program forward in 2021, including the submission to, and acceptance of, the Subsequent Procedures PDP Working Group (SubPro WG) Final Report by the Generic Names Supporting Organisation (GNSO) Council.\u00a0<br><br>Despite the recent progress, for many in the ICANN community, doubt remains as to the next steps, timelines and ultimately in ICANN\u2019s ability to launch this program and that\u2019s exactly where this idea of a preliminary applicant guidebook can help.\u00a0<br><br>Rather than just vocalising frustration and doubts about the process, the panel wanted to clearly outline a path forward that can work for ICANN, the community and future applicants, along with providing real world insight from potential future applicants.\u00a0<br><br>For those that missed the session, here is an overview of the discussion. It includes frank feedback provided to ICANN from some of the world\u2019s largest brands, who shared their interest in potentially obtaining their own TLD and their perspectives on the process to date.\u00a0\u00a0<\/p><h4 style=\"margin-block: 0.5rem 1rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: var( --e-global-typography-392b9e0-font-weight ); line-height: var( --e-global-typography-392b9e0-line-height ); font-size: var( --e-global-typography-392b9e0-font-size ); text-transform: var( --e-global-typography-392b9e0-text-transform );\">The Community Has Done the Work<\/h4><p style=\"margin-block: 0px 0.9rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 600; color: rgb(0, 0, 0); font-size: 16px; line-height: 24px;\">Tasked with the challenging responsibility of debating the successes and failures of policy and implementation protocols from the 2012 round, the community-led SubPro WG spent over five years painstakingly working through the key changes required for the next round.\u00a0<br><br>The report is incredibly detailed and as outlined in the session by Brand Registry Group (BRG) Executive Director Martin Sutton, includes approximately 120 recommendations.\u00a0<br><br>However, Sutton, a member of the SubPro WG himself, shared that deeper analysis shows that 80 of the recommendations were minor and 33 were moderate in nature, requiring small tweaks to existing processes, agreements or language in the 2012 new gTLD applicant guidebook.\u00a0<br><br>That means just nine of these recommendations are considered substantive changes to the 2012 process and even within those nine, some key recommendations for implementation were provided to the ICANN Board which reinforces the notion that the work has been done and ICANN should proceed based upon the report without delay or further policy work.\u00a0<br>\u00a0<\/p><h4 style=\"margin-block: 0.5rem 1rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: var( --e-global-typography-392b9e0-font-weight ); line-height: var( --e-global-typography-392b9e0-line-height ); font-size: var( --e-global-typography-392b9e0-font-size ); text-transform: var( --e-global-typography-392b9e0-text-transform );\">The Demand Is Real<\/h4><p style=\"margin-block: 0px 0.9rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 600; color: rgb(0, 0, 0); font-size: 16px; line-height: 24px;\">Having global powerhouse brands such as Uber and eBay on a panel talking about their interest in the next round and potentially owning their own TLD is significant and shouldn\u2019t be taken lightly.\u00a0<br><br>Most organizations avoid \u201cgoing public\u201d with their interest due to competitive concerns. Having completed dozens of feasibility studies or preliminary evaluations for organizations interested in acquiring their own TLD in the next round, I can personally attest to the fact that many future applicants are indeed waiting quietly on the sidelines for the opportunity.\u00a0<br><br>If we consider the public comments from Uber and eBay along with the amount of new businesses, mergers and acquisitions and demand from existing applicants who may wish to participate again since the 2012 round, it is seemingly obvious that demand exists.<br><br>Comments from ICANN\u2019s Chair in recent communications around uncertainty on industry demand are indeed disappointing after so much progress from the community. The reality is that exact demand cannot be accurately measured until an application period is opened, but similarly, indicative demand requires ICANN to provide some solid information to the community before that can be obtained.\u00a0<\/p><h4 style=\"margin-block: 0.5rem 1rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: var( --e-global-typography-392b9e0-font-weight ); line-height: var( --e-global-typography-392b9e0-line-height ); font-size: var( --e-global-typography-392b9e0-font-size ); text-transform: var( --e-global-typography-392b9e0-text-transform );\">The Current State of the Program Is in a Substantially Better Place Than Ever Before<\/h4><p style=\"margin-block: 0px 0.9rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 600; color: rgb(0, 0, 0); font-size: 16px; line-height: 24px;\">As part of the session, I outlined a historical analysis of the applicant guidebook from the 2012 round. For the purposes of brevity, I won\u2019t discuss every change from each guidebook iteration here, suffice to say that the first iteration in late 2008 was substantially different from the ninth and final version released in January 2012 \u2013 predominantly due to the addition of vastly needed expansions on policy and implementation processes such as the Rights Protection Mechanisms, Prioritization Draw and other key topics.\u00a0<br><br>But what can we learn from a guidebook that evolved substantially, yet still yielded almost 2000 applications for new top-level domains?<br><br>Put simply, we must remember that the final applicant guidebook from the previous round is the starting point for the next round.\u00a0<br><br>We\u2019re not starting from scratch here. We\u2019re taking a very good 2012 program and through the work of the SubPro WG, adding our collective experience of the last round to develop an even more robust program for future applicants and future generations of internet users.\u00a0<\/p><h4 style=\"margin-block: 0.5rem 1rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: var( --e-global-typography-392b9e0-font-weight ); line-height: var( --e-global-typography-392b9e0-line-height ); font-size: var( --e-global-typography-392b9e0-font-size ); text-transform: var( --e-global-typography-392b9e0-text-transform );\">Summary<\/h4><p style=\"margin-block: 0px 0.9rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 600; color: rgb(0, 0, 0); font-size: 16px; line-height: 24px;\">Maintaining the stability and security of the internet is one of ICANN\u2019s mission critical roles \u2013 but so too is the responsibility of ensuring competition and evolving the internet to create level playing fields for all stakeholders.\u00a0<br><br>Detailed analysis indicates that the level of changes required in the next guidebook from the work of the Subsequent Procedures Working Group are relatively minor in comparison to the historical precedence of the previous applicant guidebook. I took a great deal of confidence from the discussions between the Board and various other community groups about future meetings, that the ICANN org is aware of, and sensitive to, the vast array of issues that need to be considered to make a sound decision about the path forward.<br \/>\r\n<br \/>\r\nIn my role as Head of Registry Policy for GoDaddy Registry, some of the topics of greatest interest to me are DNS abuse and subsequent procedures, so I\u2019ll focus on these two areas.<br \/>\r\n<br \/>\r\nNow, whether you deal with ICANN every day or you\u2019re just a casual observer, you\u2019ll know that the ICANN community loves a good acronym. Listening to conversations around the watercooler can be confusing if you don\u2019t know your RySG from your RrSG; your GNSO from your ccNSO; BRG from PDP\u2026 well, you get the picture.\u00a0<br \/>\r\n<br \/>\r\nFortunately, ICANN has provided a great tool to help decipher what all these terms mean. So, as you\u2019re working your way through this blog \u2013 or any other ICANN related blog \u2013 you may find it helpful to refer to the\u00a0<a data-track-eid-click=\"\" data-track-name=\"icann-acronyms-and-terms_link\" data-tracked=\"\" href=\"https:\/\/www.icann.org\/en\/icann-acronyms-and-terms?nav-letter=a&page=1\" rel=\"noopener noreferrer\" target=\"_blank\">ICANN Acronyms and Terms glossary<\/a>.<br \/>\r\n\u00a0<\/p>\r\n\r\n<h4>DNS Abuse<\/h4>\r\n\r\n<p>In my opinion, the discussion around DNS abuse has taken on a more collaborative and congenial tone. I recall some of the plenary sessions on the topic from the policy forum last year, and as a contracted party, it always seemed that we were on the defensive. I want to congratulate my colleagues in the\u00a0<a data-track-eid-click=\"\" data-track-name=\"_link\" data-tracked=\"\" href=\"https:\/\/www.rysg.info\/\" rel=\"noopener noreferrer\" target=\"_blank\">RySG<\/a>\u00a0and\u00a0<a data-track-eid-click=\"\" data-track-name=\"_link\" data-tracked=\"\" href=\"https:\/\/rrsg.org\/\" rel=\"noopener noreferrer\" target=\"_blank\">RrSG<\/a>\u00a0that have largely risen to the challenge and reached out to other parts of the community to understand the areas of concern and work towards addressing those.\u00a0<br \/>\r\n<br \/>\r\nThe RySG and RrSG had quite a lengthy discussion with the Board earlier this week about DNS abuse. It was reassuring to know that the Board has established a caucus group on the topic and is looking holistically at the issue. As one of our RySG members noted, we know the policy development process is a lengthy one, and the outcomes are not always optimal because of the compromises made along the way.<br \/>\r\n<br \/>\r\nOpen engagement and dialogue among the community striving toward a common goal of security and stability of the DNS and agreeing on the role we have to play and what we can practically do to achieve that goal may be more rewarding and tangible than drawing lines in the sand.<br \/>\r\n\u00a0<\/p>\r\n\r\n<h4>Subsequent Procedures<\/h4>\r\n\r\n<p>Like many others in the community, I have spent five years dedicated to the Subsequent Procedures Policy Development Process Working Group (Sub Pro PDP WG) that considered what, if any, changes needed to be made to the 2012 New gTLD Program to enable a subsequent new gTLD program to proceed. I was very pleased as a WG member to sign off on the final report in January this year.<br \/>\r\n<br \/>\r\nOne of the things we often discussed in the WG was the need for \u2018predictability for applicants.\u2019 Now that the final report has been approved by the\u00a0<a data-track-eid-click=\"\" data-track-name=\"council_link\" data-tracked=\"\" href=\"https:\/\/gnso.icann.org\/en\/about\/council\" rel=\"noopener noreferrer\" target=\"_blank\">GNSO Council<\/a>\u00a0and forwarded to the Board, I would encourage the Board to recognize that for potential applicants of future rounds, that predictability for applicants needs to start now.\u00a0<br \/>\r\n<br \/>\r\nPredictability was a point made by several participants, including representatives from Uber and Ebay, during a discussion about getting ready for the next new gTLD round that the\u00a0<a data-track-eid-click=\"\" data-track-name=\"_link\" data-tracked=\"\" href=\"https:\/\/brandregistrygroup.org\/\" rel=\"noopener noreferrer\" target=\"_blank\">BRG<\/a>\u00a0hosted. It would be exceptionally beneficial for potential applicants if ICANN could identify a \u2018date certain\u2019 for the start of the next application window so that potential applicants, whether they be brands, geographics or IDNs, can kick off internal discussions and start to move forward.\u00a0<br \/>\r\n<br \/>\r\nThe presentations were well-considered and made me realize that while I had been engrossed in the Sub Pro PDP WG, I had forgotten that the outputs of that effort were either building on, enhancing or substantiating the many years of policy, implementation, application development and evaluation that resulted in the 2012 new gTLD program. So, none of this is new or ground-breaking\u2014we\u2019ve been here before.<br \/>\r\n<br \/>\r\nMembers of the\u00a0<a data-track-eid-click=\"\" data-track-name=\"_link\" data-tracked=\"\" href=\"https:\/\/gac.icann.org\/\" rel=\"noopener noreferrer\" target=\"_blank\">GAC<\/a>\u00a0and\u00a0<a data-track-eid-click=\"\" data-track-name=\"_link\" data-tracked=\"\" href=\"https:\/\/atlarge.icann.org\/\" rel=\"noopener noreferrer\" target=\"_blank\">ALAC<\/a>\u00a0actively participated in Sub Pro and provided input via the various public comment periods. The GAC was congratulated on a number of occasions for their contribution to the discussion.\u00a0<br \/>\r\n<br \/>\r\nHowever, I\u2019d have to say that I found the discussion between the GAC and the ALAC about Sub Pro quite discouraging as they considered whether or not to send consensus advice to the Board on those issues where concerns remain. When is \u2018done\u2019 \u2018done\u2019? After five years of community discussion with many twists and turns and compromises, I would have hoped that we could respect the policy development, and dare I say it, multistakeholder process and accept the outcome.<br \/>\r\n<br \/>\r\nAlso discouraging were continuing discussions by the GAC and the ALAC about holding the next round of new gTLDs at bay until the issue of DNS abuse is resolved. It\u2019s impossible to resolve an issue if you can\u2019t articulate the problem.<br \/>\r\n\u00a0<\/p>\r\n\r\n<h4>ICANN Community Excellence Award<\/h4>\r\n\r\n<p>I would also like to take this opportunity to acknowledge the recipients of the ICANN Community Excellence Award: Marilyn Cade and Rafik Dammak. Like many, I have my memories of Marilyn and recognize her significant contribution. Is it finally time for those interested in applying for a new gTLD to mobilize and get excited? Or should they continue to sit patiently whilst this near decade long process continues?<br><br>Here\u2019s an attempt to explain what this really means in \u2018non-policy\u2019 speak - and what you should be doing about it if you\u2019re thinking about applying in the second round of New gTLDs.<\/p><h2 style=\"margin-block: 0.5rem 1rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 700; line-height: 1.2; color: rgb(51, 51, 51); font-size: 30px;\"><span style=\"font-weight: bolder;\">The Good News<\/span><\/h2><p style=\"margin-block: 0px 0.9rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 600; color: rgb(0, 0, 0); font-size: 16px; line-height: 24px;\">Firstly, a situation such as this where the GNSO Council approves a report unanimously and sends it to the ICANN Board is a very significant step forward as it moves the process all the way to the final decision makers.<br><br>Over my 14 years in the industry, I can\u2019t recall the GNSO unanimously approving things this quickly unless they are mission critical or based upon a change of international law. Equally rare would be a situation where something like this would pass through without multiple revisions or iterations.\u00a0<br><br>Given that this has taken ten years, I think it\u2019s reasonable to say the new gTLD program isn\u2019t mission critical, so I think it\u2019s more likely that this swift approval represents a big tick for the consensus driven content of the Working Group\u2019s report and for their efforts in meeting the needs of the individual constituencies along the way.\u00a0<br><br>Yes, it\u2019s true that the community driven Subsequent Procedures Working Group took five years to finalize the report. And yes, it\u2019s also true to say that after all that time and hundreds of conference calls, there really wasn\u2019t a huge number of changes that were recommended in the report.\u00a0\u00a0<br><br>However, despite being relatively few in number, the proposed changes that were recommended were significant and absolutely needed to overcome some horrible situations and\/or delays in the 2012 round.\u00a0\u00a0<br><br>For example, included in the new changes is a recommendation that the ICANN Board formally agree to opening up future rounds after this next one, and also a recommendation that whenever the Board approve a round, they must also approve a timeline for the round subsequent.\u00a0<br><br>Another key change from the report that will impact future applicants includes the formalization of a specific process for .brand TLDs and a long overdue \u2018pre-approval\u2019 for backend operators to speed up technical testing and ensure that the review processes can be as quick as possible.\u00a0<br><br>So, with all of that said, will the ICANN Board look to facilitate a prompt approval to keep the process moving quickly?<\/p><h2 style=\"margin-block: 0.5rem 1rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 700; line-height: 1.2; color: rgb(51, 51, 51); font-size: 30px;\"><span style=\"font-weight: bolder;\">The Balancing Argument<\/span><\/h2><p style=\"margin-block: 0px 0.9rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 600; color: rgb(0, 0, 0); font-size: 16px; line-height: 24px;\">It\u2019s important to remember that despite the GNSO\u2019s prompt approval, the Board\u2019s decision to approve the recommendations and open up the program is significantly more complex one.\u00a0<br><br>Whereas the GNSO was simply agreeing to the policy, the Board needs to firstly consider a range of factors around when the program should go ahead, the price for an application, the suitability of auctions to handle contention in applications, and then consider all of the operational elements and financial allocations that a Board approval will trigger.\u00a0<br><br>So, what does that mean in reality?<br><br>On the assumption that the Board approves the recommendations to open the second round, a number of high-level key elements need to be undertaken, including:<\/p><ul style=\"margin-block: 0px; border-style: initial; border-color: initial; outline: 0px; font-size: 16px; vertical-align: baseline; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; margin-bottom: 20px; color: rgb(51, 51, 51);\"><li style=\"margin-block: 0px; border-style: initial; border-color: initial; outline: 0px; vertical-align: baseline; background: transparent; font-weight: 600; color: rgb(0, 0, 0); line-height: 24px;\">Directing the CEO to implement the program \u2013 including allocating the necessary resources<\/li><li style=\"margin-block: 0px; border-style: initial; border-color: initial; outline: 0px; vertical-align: baseline; background: transparent; font-weight: 600; color: rgb(0, 0, 0); line-height: 24px;\">Generating a new Applicant Guidebook that implements the new recommendations\u00a0<\/li><li style=\"margin-block: 0px; border-style: initial; border-color: initial; outline: 0px; vertical-align: baseline; background: transparent; font-weight: 600; color: rgb(0, 0, 0); line-height: 24px;\">Updating the baseline Registry Agreement<\/li><li style=\"margin-block: 0px; border-style: initial; border-color: initial; outline: 0px; vertical-align: baseline; background: transparent; font-weight: 600; color: rgb(0, 0, 0); line-height: 24px;\">Building the technical systems to support the application process (the Round 1 systems are end of life)<\/li><li style=\"margin-block: 0px; border-style: initial; border-color: initial; outline: 0px; vertical-align: baseline; background: transparent; font-weight: 600; color: rgb(0, 0, 0); line-height: 24px;\">Engaging the necessary third-party dispute resolution organizations<\/li><li style=\"margin-block: 0px; border-style: initial; border-color: initial; outline: 0px; vertical-align: baseline; background: transparent; font-weight: 600; color: rgb(0, 0, 0); line-height: 24px;\">Building a communications program<\/li><\/ul><p style=\"margin-block: 0px 0.9rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 600; color: rgb(0, 0, 0); font-size: 16px; line-height: 24px;\">Each of these has been done before in some way so it\u2019s reasonable to assume that things should move with some level of speed. But there are many elements to the steps described above and it\u2019s possible this could take 12 months or so to implement.<\/p><h2 style=\"margin-block: 0.5rem 1rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 700; line-height: 1.2; color: rgb(51, 51, 51); font-size: 30px;\"><span style=\"font-weight: bolder;\">Did this wake up the naysayers?<\/span><\/h2><p style=\"margin-block: 0px 0.9rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 600; color: rgb(0, 0, 0); font-size: 16px; line-height: 24px;\">Outside of this Board approval process is the \u2018hidden\u2019 challenges that exist in this multi-stakeholder community and plagued the first round.\u00a0<br><br>For those with good memories, you may recall the numerous last-minute delays that happened in the first round that were caused by all sorts of scaremongering and \u2018fake news\u2019 campaigns put out by some groups that took years to resolve and dampened the appetites of many possible applicants in the process. Well, these groups still exist, and it will be interesting to see their tactics following this recent announcement.<br><br>The ICANN Board will have to make sure they take a strong stance against those with commercial interests that are not aligned with the new gTLD Program from trying to derail the process in order to keep it moving forward.<\/p><h2 style=\"margin-block: 0.5rem 1rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 700; line-height: 1.2; color: rgb(51, 51, 51); font-size: 30px;\"><span style=\"font-weight: bolder;\">What\u2019s next?<\/span><\/h2><p style=\"margin-block: 0px 0.9rem; font-family: \"GD Sherpa\", Helvetica, Arial, sans-serif; font-weight: 600; color: rgb(0, 0, 0); font-size: 16px; line-height: 24px;\">The ICANN Board will begin to consume the 400-page report over the coming weeks and involve the community as necessary through Public Comment processes. No-one knows when the Board is actually going to approve the report but for future applicants, it seems like now might be a good time to start the internal conversations on the feasibility of a new gTLD for your organization.
