id="tab1"> <p>MySkillsFuture is a one-stop portal to support Singaporeans in their lifelong learning, with features including the viewing and editing of an individual’s Careers & Skills Passport, course search and recommendation, application for SkillsFuture schemes and claiming for SkillsFuture Credits. The MySkillsFuture.gov.sg website and any subdomains, subpages, applications and services related to or linked from MySkillsFuture.gov.sg (collectively referred to as the “<b>Digital Service</b>”) are provided by SkillsFuture Singapore (“<b>SSG</b>”, “<b>we</b>” “<b>us</b>” or “<b>our</b>”).</p> <p>These terms of use (these “<b>Terms</b>”) govern the Visitors’ (as defined below, “<b>you</b>” or “<b>your</b>”) access to and use of the Digital Service.</p> <h3>Definitions</h3> <p>In these Terms, the following terms shall have the meanings set forth below:<br /> <br /> “<b>Careers & Skills Passport</b>” or “<b>CSP</b>” refers to a personal digital repository comprising a record of your skills, employment, academic qualifications and professional certifications. CSP consolidates available careers, academic, professional and skills data from various sources, including verified data from official Government sources, and functions as a careers and skills planning tool to support your professional development and growth.</p> <p>“<b>Course Directory</b>” refers to the compilation of courses on the Digital Service.</p> <p>"<b>Digital Service</b>” refers to MySkillsFuture.gov.sg and any subdomains, subpages, applications and/or services related to or linked from MySkillsFuture.gov.sg. Examples of such Digital Service include but are not limited to the Course Directory, Careers & Skills Passport and SkillsFuture Credit claims system.</p> <p>“<b>Digital Service Content</b>” refers to all information, text, images, data, links, or other material posted on the sections of the Digital Service: (i) that are publicly available; and (ii) which you have the right to access, whether created by us or provided by a third party for display on the Digital Service.</p> <p>“<b>Individual</b>” refers to an individual user who logs in and accesses the Digital Service using his Singpass.</p> <p>“<b>Interaction</b>” refers to the collection and use of Personal Data between Training Partners and/or other third parties and you.</p> <p>“<b>Personal Data</b>” refers to data, whether true or not, about an individual who can be identified (a) from that data, or (b) from that data and other information to which the agency has or is likely to have access.</p> <p>“<b>Privacy Statement</b>” refers to SSG’s Privacy Statement as amended from time to time and published on MySkillsFuture.gov.sg.</p> <p>“<b>Resources</b>” refers to a repository of articles on SkillsFuture initiatives, personal development, tips and inspirational stories. </p> <p>“<b>Self-Assessment Tool</b>” refers to a set of online assessments that help the Individuals to better understand themselves in terms of career and skills.</p> <p>“<b>Singpass</b>” refers to the common user ID and password used to access the Singapore government’s online services.</p> <p>“<b>Terms</b>” refer to these Terms of Use.</p> <p>“<b>Training Partners</b>” refers to the training partners who have their course(s) listed on the Course Directory.</p> <p>“<b>Users</b>” collectively refer to Individuals, Training Partners and Visitors, and each are referred to as “<b>User</b>”.</p> <p>“<b>User Content</b>” refers to information posted by Individuals and Training Partners in the form of text, images, photographs, video, audio and graphics that are available on the Digital Service.</p> <p>“<b>Visitor</b>” refers to a user who browses the Digital Service without logging in as an Individual or a Training Partner.</p> <p><b>Acceptance of Terms</b></p> <p>Please read these Terms carefully as they create a binding contract between you and SSG.<br /> <br /> If you are an individual, you represent and warrant that you are at least eighteen (18) years old and that you have read, understood and accepted these Terms. In the event that you are below eighteen (18) years of age, you confirm that you have your parent’s or legal guardian’s consent to these Terms.</p> <p>Please review these Terms before using the Digital Service. If you do not agree to these Terms, then you must immediately discontinue your use of the Digital Service.</p> <p>We reserve the right to change these Terms from time to time for any reason. Any time changes are made to these Terms, you will be alerted of the revised Terms and will be required to read, understand and accept the revised Terms. Access to and use of the Digital Service are subject to these Terms, as they are amended from time to time and published on the Digital Service.</p> <h2>Access to the Digital Service</h2> <p>As a Visitor, you can browse, view and use parts of the Digital Service. You must be logged in with your Singpass to gain access to certain parts of the Digital Service. The access to such services will depend on the manner in which you log in using your Singpass, whether as an Individual or Training Partner. SSG may alter, suspend, or discontinue the Digital Service in whole or in part, at any time and for any reason, without notice. The Digital Service may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons.<br /> <br /> You confirm that you are aware of and acknowledge that SSG shall have no liability in respect of such potential alteration, suspension, discontinuance, unavailability and/or removal.<br /> <br /> If you use our Digital Service on your mobile device, your mobile carrier’s normal rates and charges apply. We are not responsible for any charges you incur from your mobile carrier as a result of use of the Digital Service. You are responsible for ensuring that at all times while using the Digital Service you are not in violation of your wireless data service agreement. You are solely responsible for all fees and costs associated with your access to and use of the Digital Service.</p> <h2>Use of Digital Service</h2> <p>You represent, warrant and covenant that:</p> <p>a. You will not reproduce, distribute, publicly display, publicly perform, communicate to the public, create derivative works from or otherwise use and exploit any Digital Service Content or the Digital Service except as permitted by these Terms or the terms and conditions of the relevant Training Partners as applicable;</p> <p>b. You will assume responsibility for controlling how your Personal Data is disclosed or used on the Digital Service, including, without limitation, taking appropriate steps to protect such information; and</p> <p>c. You will not harass and/or solicit personal information from any Users.</p> <p>d. You will assume responsibility for controlling how your Personal Data is used on or disclosed through the Digital Service, including disclosure of your Personal Data to non-SSG platforms, including but not limited to third-party online job portals, and take appropriate steps to protect such information; and</p> <p>e. You will not harass and/or solicit personal information from any Users.</p> <h2>SSG’s Privacy Statement</h2> <p>Our Privacy Statement sets out how we process data, including Personal Data, in our possession or control.</p> <p>Where there is Interaction, it is a direct transaction between the Training Partners and/or any other third party and you and does not involve SSG in any way.</p> <p>SSG will not be responsible for the manner in which Personal Data is collected or used by the Training Partners and/or any third party. SSG does not manage or monitor the collection of Personal Data done by the Training Partners and/or any third party.</p> <p>SSG shall not be responsible for the Interaction between the Training Partners and/or any third party and you. SSG expressly disclaims any liability or claims that may arise from the Interaction. In the event that you have a dispute with any of the Training Partners and/or any third party, you agree that SSG shall not have any liability in respect of such dispute and hereby release SSG (and its officers, directors, agents, subsidiaries, and employees) from any and all claims, demands, or damages (actual or consequential) of every kind, known and unknown arising out of or in any way related with such disputes.</p> <p>By agreeing to these Terms and using our Digital Service, you also acknowledge that the <a href="https://www.myskillsfuture.gov.sg/content/portal/en/footer/privacy-policy.html" target="_blank">Privacy Policy</a> is applicable to our collection, use, disclosure or processing of your data.</p> <h2>Digital Service Content</h2> <p>Subject to these Terms, SSG hereby grants to you a personal, non-transferable, non-exclusive, non-sublicensable right and licence to access and use the Digital Service, and all Digital Service Content therein, solely within the scope of your status as a Visitor.<br /> <br /> SSG reserves the right to make changes to document names and content, descriptions or specifications of products or services, or other information without obligation to issue any notice of such changes.<br /> <br /> Nothing contained on this Digital Service should be construed as granting, by implication, estoppel, or otherwise, any license or right to use this Digital Service through the use of framing or otherwise, except: (a) as expressly permitted by these Terms; or (b) with our prior written permission or the permission of such third party that may own the trademark or copyright of material displayed on this Digital Service.</p> <p>A Course Directory is available on the Digital Service and accessible to all Users. The Course Directory provides information of various courses by Training Partners so as to enable Users to search for and contact the Training Partners if they wish to attend the Training Partners’ courses available.</p> <p>The Course Directory is provided to you as a matter of convenience, and SSG makes no representation or warranty whatsoever in respect of any Training Partners listed in the Course Directory and shall not be responsible for the quality or suitability of any of the Training Partners for any purpose whatsoever. In addition, a listing on the Course Directory does not imply that SSG endorses any of the Training Partners. Engagement of the Training Partners shall be at your own risk and you agree that SSG shall not be responsible whatsoever for any such engagement. You acknowledge that the courses are offered by the Training Partners and agree that SSG shall not be liable for any loss, whether direct, indirect, consequential, incidental or special (and whether arising out of contract, tort or otherwise) which you may suffer arising from any defect, error, fault or failure to perform with respect to the courses provided by the Training Partners.</p> <h2>User Content</h2> <p>If you choose to provide information as an Individual to register for or utilise any services, event, or promotion on the Digital Service, you agree that you will provide accurate, complete, and up to date information as requested on the screens that collect information from you. Please refer to the Privacy Statement for information on our practices for handling personally identifiable information.</p> <p>SSG is not responsible or liable for the conduct of Users or for views, opinions and statements expressed in User Content submitted for display through the Digital Service. Information submitted to the Digital Service is not screened. With respect to such User Content posted on or through the Digital Service, the Digital Service acts as a passive conduit for such distribution and SSG is not responsible for such User Content. Any opinions, advice, statements, services, offers, or other information in the Digital Service provided by Users are those of the respective author(s) or distributor(s) and not of SSG. We neither endorse nor guarantee the accuracy, completeness, or usefulness of any such User Content. You are responsible for ensuring that User Content submitted to or through the Digital Service is not provided in violation of any applicable laws, including without limitation, laws relating to defamation, libel and slander, laws of confidentiality and non-disclosure, and laws relating to copyright, trade secret or other intellectual property rights of another person or entity or of any applicable law. You should verify the data in CSP before sharing it.</p> <h2>Monitoring</h2> <p>SSG has the right, but not the obligation, to monitor User Content submitted through or posted on the Digital Service, to determine compliance with these Terms and any other applicable rules that we may establish, from time to time. SSG has the right in our sole discretion to edit or remove any material submitted to or posted in any online discussion forum or chat room provided through our Digital Service. Without limiting the foregoing, SSG has the right to remove any material that SSG, in our sole discretion, finds to be in violation of these Terms or otherwise objectionable, and you are solely responsible for the User Content that you post on or through the Digital Service.</p> <h2>Links to External Websites</h2> <p>The Digital Service may contain links to websites which are not operated or controlled by SSG, whether for marketing purposes or otherwise. These links are provided to you as a matter of convenience, and SSG does not make any representation or warranty whatsoever in respect of any linked website and shall not be responsible for the content of any linked website. Any non-SSG website accessed from the Digital Service is independent from SSG, and SSG does not have any control over the content of that website. In addition, a link to any non-SSG website from the Digital Service does not imply that SSG endorses or accepts any responsibility for the content or use of such website. The MySkillsFuture.gov.sg website and any subdomains, subpages, applications and services related to or linked from MySkillsFuture.gov.sg (collectively referred to as the “<b>Digital Service</b>”) are provided by SkillsFuture Singapore (“<b>SSG</b>”, “<b>we</b>” “<b>us</b>” or “<b>our</b>”).</p> <p>These terms of use (these “<b>Terms</b>”) govern the Visitors’ (as defined below, “<b>you</b>” or “<b>your</b>”) access to and use of the <a href="/content/dam/Article/2024-Article-Assets/Terms%20of%20Consent%20For%20Collection%20of%20Data_MOM_20241120.pdf">Digital Service</a>.</p> <h3>Definitions</h3> <p>In these Terms, the following terms shall have the meanings set forth below:<br /> <br /> “<b>Careers & Skills Passport</b>” or “<b>CSP</b>” refers to a personal digital repository comprising a record of your skills, employment, academic qualifications and professional certifications. CSP consolidates available careers, academic, professional and skills data from various sources, including verified data from official Government sources, and functions as a careers and skills planning tool to support your professional development and growth.</p> <p>“<b>Course Directory</b>” refers to the compilation of courses on the Digital Service.</p> <p>"<b>Digital Service</b>” refers to MySkillsFuture.gov.sg and any subdomains, subpages, applications and/or services related to or linked from MySkillsFuture.gov.sg. Examples of such Digital Service include but are not limited to the Course Directory, Careers & Skills Passport and SkillsFuture Credit claims system.</p> <p>“<b>Digital Service Content</b>” refers to all information, text, images, data, links, or other material posted on the sections of the Digital Service: (i) that are publicly available; and (ii) which you have the right to access, whether created by us or provided by a third party for display on the Digital Service.</p> <p>“<b>Individual</b>” refers to an individual user who logs in and accesses the Digital Service using his Singpass.</p> <p>“<b>Interaction</b>” refers to the collection and use of Personal Data between Training Partners and/or other third parties and you.</p> <p>“<b>Personal Data</b>” refers to data, whether true or not, about an individual who can be identified (a) from that data, or (b) from that data and other information to which the agency has or is likely to have access.</p> <p>“<b>Privacy Statement</b>” refers to SSG’s Privacy Statement as amended from time to time and published on MySkillsFuture.gov.sg.</p> <p>“<b>Resources</b>” refers to a repository of articles on SkillsFuture initiatives, personal development, tips and inspirational stories. </p> <p>“<b>Self-Assessment Tool</b>” refers to a set of online assessments that help the Individuals to better understand themselves in terms of career and skills.</p> <p>“<b>Singpass</b>” refers to the common user ID and password used to access the Singapore government’s online services.</p> <p>“<b>Terms</b>” refer to these Terms of Use.</p> <p>“<b>Training Partners</b>” refers to the training partners who have their course(s) listed on the Course Directory.</p> <p>“<b>Users</b>” collectively refer to Individuals, Training Partners and Visitors, and each are referred to as “<b>User</b>”.</p> <p>“<b>User Content</b>” refers to information posted by Individuals and Training Partners in the form of text, images, photographs, video, audio and graphics that are available on the Digital Service.</p> <p>“<b>Visitor</b>” refers to a user who browses the Digital Service without logging in as an Individual or a Training Partner.</p> <p><b>Acceptance of Terms</b></p> <p>Please read these Terms carefully as they create a binding contract between you and SSG.<br /> <br /> If you are an individual, you represent and warrant that you are at least eighteen (18) years old and that you have read, understood and accepted these Terms. In the event that you are below eighteen (18) years of age, you confirm that you have your parent’s or legal guardian’s consent to these Terms.</p> <p>Please review these Terms before using the Digital Service. If you do not agree to these Terms, then you must immediately discontinue your use of the Digital Service.</p> <p>We reserve the right to change these Terms from time to time for any reason. Any time changes are made to these Terms, you will be alerted of the revised Terms and will be required to read, understand and accept the revised Terms. Access to and use of the Digital Service are subject to these Terms, as they are amended from time to time and published on the Digital Service.</p> <h2>Access to the Digital Service</h2> <p>As a Visitor, you can browse, view and use parts of the Digital Service. You must be logged in with your Singpass to gain access to certain parts of the Digital Service. The access to such services will depend on the manner in which you log in using your Singpass, whether as an Individual or Training Partner. SSG may alter, suspend, or discontinue the Digital Service in whole or in part, at any time and for any reason, without notice. The Digital Service may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons.<br /> <br /> You confirm that you are aware of and acknowledge that SSG shall have no liability in respect of such potential alteration, suspension, discontinuance, unavailability and/or removal.<br /> <br /> If you use our Digital Service on your mobile device, your mobile carrier’s normal rates and charges apply. We are not responsible for any charges you incur from your mobile carrier as a result of use of the Digital Service. You are responsible for ensuring that at all times while using the Digital Service you are not in violation of your wireless data service agreement. You are solely responsible for all fees and costs associated with your access to and use of the Digital Service.</p> <h2>Use of Digital Service</h2> <p>You represent, warrant and covenant that:</p> <p>a. You will not reproduce, distribute, publicly display, publicly perform, communicate to the public, create derivative works from or otherwise use and exploit any Digital Service Content or the Digital Service except as permitted by these Terms or the terms and conditions of the relevant Training Partners as applicable;</p> <p>b. You will assume responsibility for controlling how your Personal Data is disclosed or used on the Digital Service, including, without limitation, taking appropriate steps to protect such information; and</p> <p>c. You will not harass and/or solicit personal information from any Users.</p> <p>d. You will assume responsibility for controlling how your Personal Data is used on or disclosed through the Digital Service, including disclosure of your Personal Data to non-SSG platforms, including but not limited to third-party online job portals, and take appropriate steps to protect such information; and</p> <p>e. You will not harass and/or solicit personal information from any Users.</p> <h2>SSG’s Privacy Statement</h2> <p>Our Privacy Statement sets out how we process data, including Personal Data, in our possession or control.</p> <p>Where there is Interaction, it is a direct transaction between the Training Partners and/or any other third party and you and does not involve SSG in any way.</p> <p>SSG will not be responsible for the manner in which Personal Data is collected or used by the Training Partners and/or any third party. SSG does not manage or monitor the collection of Personal Data done by the Training Partners and/or any third party.</p> <p>SSG shall not be responsible for the Interaction between the Training Partners and/or any third party and you. SSG expressly disclaims any liability or claims that may arise from the Interaction. In the event that you have a dispute with any of the Training Partners and/or any third party, you agree that SSG shall not have any liability in respect of such dispute and hereby release SSG (and its officers, directors, agents, subsidiaries, and employees) from any and all claims, demands, or damages (actual or consequential) of every kind, known and unknown arising out of or in any way related with such disputes.</p> <p>By agreeing to these Terms and using our Digital Service, you also acknowledge that the Privacy Policy is applicable to our collection, use, disclosure or processing of your data.</p> <h2>Digital Service Content</h2> <p>Subject to these Terms, SSG hereby grants to you a personal, non-transferable, non-exclusive, non-sublicensable right and licence to access and use the Digital Service, and all Digital Service Content therein, solely within the scope of your status as a Visitor.<br /> <br /> SSG reserves the right to make changes to document names and content, descriptions or specifications of products or services, or other information without obligation to issue any notice of such changes.<br /> <br /> Nothing contained on this Digital Service should be construed as granting, by implication, estoppel, or otherwise, any license or right to use this Digital Service through the use of framing or otherwise, except: (a) as expressly permitted by these Terms; or (b) with our prior written permission or the permission of such third party that may own the trademark or copyright of material displayed on this Digital Service.</p> <p>A Course Directory is available on the Digital Service and accessible to all Users. The Course Directory provides information of various courses by Training Partners so as to enable Users to search for and contact the Training Partners if they wish to attend the Training Partners’ courses available.</p> <p>The Course Directory is provided to you as a matter of convenience, and SSG makes no representation or warranty whatsoever in respect of any Training Partners listed in the Course Directory and shall not be responsible for the quality or suitability of any of the Training Partners for any purpose whatsoever. In addition, a listing on the Course Directory does not imply that SSG endorses any of the Training Partners. Engagement of the Training Partners shall be at your own risk and you agree that SSG shall not be responsible whatsoever for any such engagement. You acknowledge that the courses are offered by the Training Partners and agree that SSG shall not be liable for any loss, whether direct, indirect, consequential, incidental or special (and whether arising out of contract, tort or otherwise) which you may suffer arising from any defect, error, fault or failure to perform with respect to the courses provided by the Training Partners.</p> <h2>User Content</h2> <p>If you choose to provide information as an Individual to register for or utilise any services, event, or promotion on the Digital Service, you agree that you will provide accurate, complete, and up to date information as requested on the screens that collect information from you. Please refer to the Privacy Statement for information on our practices for handling personally identifiable information.</p> <p>SSG is not responsible or liable for the conduct of Users or for views, opinions and statements expressed in User Content submitted for display through the Digital Service. Information submitted to the Digital Service is not screened. With respect to such User Content posted on or through the Digital Service, the Digital Service acts as a passive conduit for such distribution and SSG is not responsible for such User Content. Any opinions, advice, statements, services, offers, or other information in the Digital Service provided by Users are those of the respective author(s) or distributor(s) and not of SSG. We neither endorse nor guarantee the accuracy, completeness, or usefulness of any such User Content. You are responsible for ensuring that User Content submitted to or through the Digital Service is not provided in violation of any applicable laws, including without limitation, laws relating to defamation, libel and slander, laws of confidentiality and non-disclosure, and laws relating to copyright, trade secret or other intellectual property rights of another person or entity or of any applicable law. SSG shall not be responsible for any breach of any contractual obligation or infringement of any third-party rights.</p> <p>You acknowledge that the information provided through MySkillsFuture and/or CSP serves as a general information source only, and such information is not to be viewed or relied upon as career advice. You should verify the data in CSP before sharing it.</p> <h2>Monitoring</h2> <p>SSG has the right, but not the obligation, to monitor User Content submitted through or posted on the Digital Service, to determine compliance with these Terms and any other applicable rules that we may establish, from time to time. SSG has the right in our sole discretion to edit or remove any material submitted to or posted in any online discussion forum or chat room provided through our Digital Service. Without limiting the foregoing, SSG has the right to remove any material that SSG, in our sole discretion, finds to be in violation of these Terms or otherwise objectionable, and you are solely responsible for the User Content that you post on or through the Digital Service.</p> <h2>Links to External Websites</h2> <p>The Digital Service may contain links to websites which are not operated or controlled by SSG, whether for marketing purposes or otherwise. These links are provided to you as a matter of convenience, and SSG does not make any representation or warranty whatsoever in respect of any linked website and shall not be responsible for the content of any linked website. Any non-SSG website accessed from the Digital Service is independent from SSG, and SSG does not have any control over the content of that website. In addition, a link to any non-SSG website from the Digital Service does not imply that SSG endorses or accepts any responsibility for the content or use of such website. Use of any external website is subject to its terms of service and privacy policy. You are responsible for exercising caution and good judgment when using external websites. </p> <h2>Links from External Websites</h2> <p>Except as set forth below, caching and links to, and the framing of the Digital Service or any of the User Content and/or Digital Service Content is strictly prohibited.</p> <p>You must secure written permission from SSG prior to hyper-linking to, or framing, the Digital Service or any of the User Content and/or Digital Service Content, or engaging in similar activities. SSG reserves the right to impose conditions when permitting any hyper-linking to, or framing of the Digital Service or any of the User Content and/or Digital Service Content.</p> <p>Under no circumstances shall SSG be considered to be associated or affiliated in whatever manner with any trade or service marks, logos, insignia or other devices used or appearing on websites that link to the Digital Service or any of the User Content and/or Digital Service Content.</p> <p>SSG reserves all rights to disable or block any links to, or frames of any website containing inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topics, names, material or information, or material or information that violates any written law, any applicable intellectual property, proprietary, privacy or publicity rights.</p> <p>SSG reserves the right to disable or block any unauthorised links or frames and disclaims any responsibility for the content available on any other website reached by links to or from the Digital Service or any of the User Content and/or Digital Service Content.</p> <h2>Disclaimer</h2> <p>Under no circumstances will SSG be liable for any loss or damage caused by your reliance on any information communicated or provided on or through the Digital Service, or any information contained therein when you access the Digital Service as an Individual.</p> <p>ALL DIGITAL SERVICE CONTENT AND USER CONTENT AND INFORMATION ON OR ACCESSIBLE FROM THE DIGITAL SERVICE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. Those who choose to access the Digital Service from outside Singapore do so on their own initiative and at their own risk and are responsible for compliance with applicable local laws. By using the Digital Service, you consent to having your Personal Data transferred to and processed in Singapore, subject to the restrictions on such data applicable to SSG.</p> <h2>Termination</h2> <p>SSG reserves all rights to deny or restrict access to the Digital Service by any particular person, or to block access from a particular IP address to the Digital Service, at any time, without ascribing any reasons whatsoever.</p> <p>We may suspend your access to the Digital Service, in our sole discretion, for any reason and at any time, upon electronic notice to you at the e-mail address provided by you during your initial login to the Digital Service. We may discontinue offering the Digital Service at any time.</p> <p>We have no obligation to retain your data including Personal Data for any period of time beyond what may be required by applicable law. Upon termination of your Singpass, your access to the Digital Service will automatically cease. All representations and warranties shall survive termination.</p> <h2>Governing Law</h2> <p>These Terms shall be governed by and construed according to the laws of Singapore and subject to the exclusive jurisdiction of the Singapore Courts.
