you ("you," "your") and H2, Inc. ("H2", "we," "our" or "us") governing your use of H2’s Smart Cable ("Product"). Please read this Agreement carefully before using the Product.</p> <h2 id="product-use" data-v-34923cd1><a href="#product-use" aria-hidden="true" tabindex="-1" data-v-34923cd1><span class="icon icon-link" data-v-34923cd1></span></a>Product Use</h2> <p data-v-34923cd1>This product is for you to use along with Health2Sync Mobile Application ("App") to sync blood glucose data from your blood glucose meter to the App. You should read Terms of Use and Privacy Policy carefully before you start to use the Product. You understand and acknowledge that Terms of Use and Privacy Policy are incorporated into this Agreement by reference and you agree to the Terms of Use and Privacy Policy by starting to use the Product. In the event there is any conflict or inconsistency between the terms hereof and the Terms of Use/Privacy Policy, the latter shall prevail.</p> <h2 id="warranty" data-v-34923cd1><a href="#warranty" aria-hidden="true" tabindex="-1" data-v-34923cd1><span class="icon icon-link" data-v-34923cd1></span></a>Warranty</h2> <p data-v-34923cd1>Subject to your compliance with H2's instructions of Product use (including without limitation Health2Sync Smart Cable User Guide and Health2Sync Mobile Application User Guide), H2 warrants the Product against defects in material and workmanship under ordinary consumer use for twelve (12) months from the date of original retail purchase of the Product. During this warranty period, if a defect arises in the Product, and you follow the instructions for returning the Product, H2 will, at our sole option and to the extent permitted by law, either (i) repair the Product using either new or refurbished parts, (ii) replace the Product with a new or refurbished Product; or (iii) refund to you all or part of the purchase price of the Product. This limited warranty applies to any repair, replacement part or replacement Product for the remainder of the original warranty period "or for ninety(90) days, whichever period is longer." All replaced parts and Products for which a refund is given shall become H2's property. This limited warranty applies only to hardware components of the Product that are not subject to accident, misuse, neglect, fire or other external causes, alterations, repair or commercial use. You are obligated to obey any instruction that H2 provides to activate and validate your warranty.</p> <h3 id="limitations" data-v-34923cd1><a href="#limitations" aria-hidden="true" tabindex="-1" data-v-34923cd1><span class="icon icon-link" data-v-34923cd1></span></a>LIMITATIONS.</h3> <p data-v-34923cd1>TO THE EXTENT PERMITTED BY LAW, THE WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES AND REMEDIES, AND WE SPECIFICALLY DISCLAIM ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND AGAINST HIDDEN OR LATENT DEFECTS. IF WE CANNOT LAWFULLY DISCLAIM STATUTORY OR IMPLIED WARRANTIES, THEN TO THE EXTENT PERMITTED BY LAW, ALL SUCH WARRANTIES SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY
