I ZR 112/23 (Manhattan Bridge)</a>).</p> <p>Für Plattformen wie YouTube oder Uploaded haben der Europäische Gerichtshof (EuGH) und in der Folge der BGH strenge Maßstäbe aufgestellt (Urt. v. 22.06.2021, Rs. <a href="https://dejure.org/dienste/vernetzung/rechtsprechung?Text=C-682/18" title="C-682/18 (2 zugeordnete Entscheidungen)">C-682/18</a> und <a href="https://dejure.org/dienste/vernetzung/rechtsprechung?Text=C-683/18" title="C-683/18 (2 zugeordnete Entscheidungen)">C-683/18</a> – YouTube und Cyando). Diese Maßstäbe sollen nach Ansicht des BGH auch auf Online-Marktplätze übertragbar sein. Das Urteil kann nun massive Auswirkungen auf Plattformen wie Ebay, Amazon, Kleinanzeigen und viele weitere Seiten haben, bei denen Anbieter lediglich die Plattform zur Verfügung stellen und Händler diese dann nutzen, um ihre Produkte zu verkaufen.</p> <h2 id="geschuetztes-foto-in-verkaufsangebot-auf-online-marktplatz" class="wp-block-heading">Geschütztes Foto in Verkaufsangebot auf Online-Marktplatz</h2> <p>Im konkreten Fall ging es um eine große Online-Handelsplattform. Zwei verschiedene Verkäufer boten darauf jeweils einen tragbaren Fernseher an. Doch auf der Verpackung der Fernseher prangte das Foto eines Fotografen, der kein Einverständnis zur Nutzung dieses Fotos für die Werbung der Händler gegeben hatte. Daraufhin ließ er jedoch nicht die Händler, sondern die Plattform abmahnen, wobei allerdings nur das Foto eines der beiden Verkäufer genannt wurde, die es genutzt hatten. Da dieses Foto nach Erhalt der Abmahnung nicht mehr zu finden war – der Verkäufer hatte es wohl entfernt – ging die Plattform davon aus, dass sich die Angelegenheit erledigt habe und teilte dies den Anwälten des Fotografen so mit. id="sharehoster-rechtsprechung-auch-auf-online-marktplaetze-anwendbar" class="wp-block-heading">Sharehoster-Rechtsprechung auch auf Online-Marktplätze anwendbar</h2> <p>Das Landgericht Nürnberg-Fürth hat der Klage weitgehend stattgegeben (Az. 19 O 8496/21). Die Plattform hafte zwar nicht als Täterin, sondern nur als Störerin. Dennoch hafte sie auf Schadensersatz, da sie es unterlassen habe, Vorsorgemaßnahmen zu ergreifen, um gleichartige Rechtsverstöße zu verhindern. Sie hätte also proaktiv ihre Plattform nach kerngleichen Rechtsverletzungen durchsuchen müssen, nachdem sie einmal auf eine solche Rechtsverletzung aufmerksam gemacht worden war.</p> <p>Anders sah es das Oberlandesgericht Nürnberg-Fürth (Az. <a href="https://dejure.org/dienste/vernetzung/rechtsprechung?Text=3%20U%202910/22" title="OLG Nürnberg, 01.08.2023 - 3 U 2910/22: Täterschaftliche Haftung des Betreibers eines Platformb...">3 U 2910/22</a>): Es ging sogar davon aus, die Plattform hafte als Täterin – wenn auch letztlich im geringeren Umfang als das LG geurteilt hatte. Der Grund für die Annahme einer täterschaftlichen Haftung: Sie habe die Verkehrspflichten verletzt, da sie trotz Hinweises nicht unverzüglich die erforderlichen Maßnahmen ergriffen habe, um den Zugang zu dem angeblich urheberrechtsverletzenden Inhalt und kerngleichen Verletzungshandlungen zu verhindern. Die jüngste höchstrichterliche Rechtsprechung, die die Video-Sharing-Plattform „YouTube“ und die Sharehosting-Plattform „uploaded“ betroffen habe, sei auf den vorliegenden Fall übertragbar. Das OLG hat die Revision aber wegen der grundsätzlichen Bedeutung der Frage zugelassen, ob diese Rechtsprechung tatsächlich auf Verkaufsplattformen übertragbar sei.</p> <h2 id="oeffentliche-zugaenglichmachung-und-die-rolle-des-plattformbetreibers" class="wp-block-heading">Öffentliche Zugänglichmachung und die Rolle des Plattformbetreibers</h2> <p>Der BGH hat am 11. Juli 2024 entschieden, dass der Betreiber eines Online-Marktplatzes für die öffentliche Zugänglichmachung eines urheberrechtlich geschützten Fotos hafte, wenn er nach einem Hinweis des Urhebers nicht unverzüglich Maßnahmen zur Vermeidung weiterer Verletzungen ergreife.</p> <p>Plattformbetreiber, so der BGH, müssten bei der Bereitstellung von urheberrechtlich geschützten Inhalten durch Dritte zwar grundsätzlich nicht als unmittelbare Täter haften, jedoch aus einer sogenannten Verkehrspflicht heraus verantwortlich sein können. Eine solche Verkehrspflicht liege vor, wenn der Plattformbetreiber nach einem klaren Hinweis auf eine Urheberrechtsverletzung keine angemessenen Vorkehrungen treffe, um vergleichbare Verstöße zu verhindern. Der Fotograf, dessen Werk ohne Erlaubnis auf der Plattform in zwei Verkaufsangeboten durch Drittanbieter verwendet wurde, hatte den Plattformbetreiber zuvor auf die Verletzung hingewiesen. In dieser Situation hätte die Plattform durch geeignete Maßnahmen sicherstellen müssen, dass das Foto weder im aktuellen noch in zukünftigen Angeboten verwendet werde.</p> <p>Betreiber eines Online-Marktplatzes sollen grundsätzlich verpflichtet sein, nach einem klaren Hinweis auf eine Rechtsverletzung die dort eingestellten Angebote im Rahmen des technisch und wirtschaftlich Zumutbaren auf gleichartige Verletzungen hin zu überprüfen und rechtsverletzende Inhalte zu sperren oder zu löschen. Bei Übertragung der für Video-Sharing- und Sharehosting-Plattformen geltenden Rechtsprechung müsse den Besonderheiten von Online-Marktplätzen jedoch Rechnung getragen werden, die zwar eine zentrale Rolle für die Verbreitung urheberrechtlich geschützter Inhalte spielen können, aber nicht hauptsächlich darauf ausgerichtet seien. Zudem seien immer auch die Gegebenheiten der geltend gemachten Rechtsverletzung zu berücksichtigen. Soweit nicht der angebotene Gegenstand selbst urheberrechtsverletzend sei, sondern das Angebot lediglich in einer urheberrechtsverletzenden Weise präsentiert werde (wie im hier entschiedenen Fall), erstrecke sich die Prüfungspflicht des Plattformbetreibers im Regelfall allein auf gleichartig präsentierte Angebote, nicht aber auf jegliche Darstellungen des urheberrechtlich geschützten Werks.</p> <p>Die Plattform hätte laut BGH nach dem Hinweis des Fotografen mindestens überprüfen müssen, ob das urheberrechtlich geschützte Bild weiterhin oder in neuen Angeboten verwendet wurde. Da diese Überprüfung unterlassen wurde, liege eine Pflichtverletzung vor und die Plattform hafte für die öffentliche Zugänglichmachung.</p> <h2 id="keine-haftung-fuer-die-vervielfaeltigung-des-lichtbildwerks" class="wp-block-heading">Keine Haftung für die Vervielfältigung des Lichtbildwerks</h2> <p>Eine Haftung der Plattform für die Vervielfältigung des Bildes auf den Servern wurde vom BGH hingegen verneint. Nach der Rechtsprechung sei der Plattformbetreiber nicht automatisch für die von Nutzern hochgeladenen Vervielfältigungen verantwortlich. Der BGH führte aus, dass die Vervielfältigung als rein technischer Vorgang auf die Verkäufer zurückzuführen sei, die die Bilder eigenständig und ohne aktive Beteiligung der Plattform hochgeladen hatten. Die Plattform stelle zwar die technische Infrastruktur zur Verfügung, führe aber selbst keine aktive Handlung zur Herstellung der Bilddateien aus, weshalb die Haftung für die Vervielfältigung als rein technischem Vorgang allein bei den Verkäufern liege. Eine Störerhaftung des Plattformbetreibers, die zur Entfernung oder Sperrung verpflichtet hätte, greife daher nicht.</p> <p>Der BGH konkretisiert die Rolle und Verantwortung von Plattformbetreibern im Onlinehandel. Er stellt klar, dass die Betreiber nach einem konkreten Hinweis auf eine Urheberrechtsverletzung eine gesteigerte Prüfungspflicht haben und geeignete Maßnahmen ergreifen müssen, um zukünftige, gleichartige Verletzungen zu verhindern. Eine Haftung für die anfängliche Vervielfältigung des Werkes durch die Verkäufer ist jedoch ausgeschlossen, solange die Plattformbetreiber nur eine rein technische Rolle ohne aktive Teilnahme an der Erstellung der Bilddateien einnehmen.
