Не можете да замените минималния период на платен годишен отпуск с надбавка, освен когато служебното правоотношение приключва.</p> <h3>Нощна смяна</h3> <p>При нощен период от 7 часа вашите служители могат да работят <strong>най-много 42 часа седмично</strong> през нощта — между 11 вечерта и 6 сутринта.</p> <h3>Време за почивка</h3> <p>Вашите служители <strong>не могат да работят повече от 31 последователни дни</strong>.</p> <p>Ако работният график показва, че вашите работници имат по-малко работни, отколкото почивни дни, трябва да им дадете същия брой последователни почивни дни, колкото дните, през които са работили последователно. Например, ако служителите ви работят 10 последователни дни, трябва да им дадете 10 последователни почивни дни. Тя ползва 4 пълни почивни дни и прехвърля 0,5 към следващия си период на почивка.</p> <p><strong>Сезонен работен график </strong></p> <p>По време на натоварения туристически сезон (не повече от 9 месеца) Елиза работи до 12 часа в денонощието и до 72 часа седмично.</p> <p>Ако Елиза работи 10 дни през този период, тя получава 10 дни x 0,2 почивни дни = 2 почивни дни.</p> <p>За всеки период от 31 дни Елиза трябва да ползва най-малко 2 пълни почивни дни.</p> </div> <h3>Водене на документация</h3> <p>Като работодател трябва да <strong>водите документация</strong> за продължителността на работното време и периодите на почивка на всеки работник.</p> <p>Трябва да включвате най-малко следната информация:</p> <ul> <li>име на кораба</li> <li>име на работника</li> <li>име на компетентния капитан</li> <li>дата</li> <li>работен или почивен ден</li> <li>начало и край на работното време или периодите на почивка.</li> </ul> <p>Тази <strong>документация трябва да се пази на борда</strong> поне до края на референтния период и да се проверява редовно от членовете на екипажа. Трябва също така да <strong>предоставите на вашите служители копие</strong> от документацията, което те трябва да съхраняват в продължение на най-малко една година.</p> <h3>Оценки на здравословното състояние</h3> <p>Трябва да осигурите на всички работници безплатни годишни медицински прегледи при спазване на лекарската тайна. Ако нощен работник страда от здравословни проблеми, свързани с нощния труд, трябва да го прехвърлите винаги, когато това е възможно, на дневна работа.</p> <h3>Взаимно признаване на свидетелствата за правоспособност</h3> <p>Когато наемате служители, те трябва да ви предоставят свидетелство за правоспособност (СП), за да докажат, че притежават необходимите умения и знания за съответната длъжност. Не можете да откажете да приемете СП, издадено в друга страна от ЕС.</p> <p>Ако наемате член на екипажа от държава, която не е членка на ЕС, трябва да се уверите, че квалификациите му са признати съгласно правилата на ЕС, като подложите квалификациите на оценка за еквивалентност и получите необходимите одобрения.</p> <p>Няколко държави от ЕС са въвели електронна проверка на СП като безопасен, бърз и икономически ефективен начин да се гарантира, че наемате квалифицирани членове на екипажа.</p> <h3>Изисквания във връзка с обучението</h3> <p>Трябва да гарантирате, че всички работници преминават задължително обучение по здраве и безопасност при работа. Това включва специално обучение относно аварийните процедури, оказването на първа помощ и пожарната безопасност. В насоките на ЕС също така силно се насърчава продължаващото професионално развитие (ППР).
