class="sr-only">Waarschuwing</h4> <p> Een EU-land mag evenwel besluiten bepaalde spoorwegdiensten vrij te stellen van de EU-regeling voor de rechten van treinreizigers. Deze uitzonderingen kunnen van toepassing zijn op stads-, voorstads-, regionale en binnenlandse langeafstandstreinen, en treinen die uitsluitend voor historische of toeristische doeleinden worden gebruikt. EU-landen kunnen ook vrijstelling verlenen voor internationale treinen die van hun grondgebied naar niet-EU-landen reizen, als het grootste deel van de reis buiten de EU plaatsvindt en er ten minste één tussenstop in een niet-EU-land wordt gemaakt. EU-landen kunnen grensoverschrijdende internationale treinreizen tussen EU-landen echter niet van de regels vrijstellen. In naar behoren gemotiveerde gevallen mag de spoorwegmaatschappij drie maanden over dat antwoord doen. </p> <p> Ontvangt u geen antwoord van de spoorwegmaatschappij, dan kunt u een klacht indienen bij <span class="nolink">de bevoegde nationale autoriteit in uw land</span> <a href="https://transport.ec.europa.eu/document/download/e416e1e2-af3e-40c9-b54c-931e0b8fa76c_en" target="_blank" class="language" title="English">en</a> . Als u van de spoorwegmaatschappij een antwoord heeft gekregen waar u niet tevreden mee bent, kunt u binnen drie maanden na de afwijzing van uw klacht door de spoorwegonderneming een klacht indienen bij de bevoegde nationale autoriteit in uw land. U moet uw klacht richten tot de nationale autoriteit die de vergunning aan de spoorwegonderneming heeft afgegeven. De klachtenprocedure van de nationale autoriteit mag maximaal drie maanden duren (of zes maanden voor complexe zaken). U krijgt dan een niet-bindend juridisch advies over de verdere mogelijkheden. </p> <p> U kunt ook proberen uw geschil op te lossen via buitengerechtelijke procedures of een <a title="Instantie voor alternatieve geschillenbeslechting (ADR)" href="https://europa.eu/youreurope/citizens/consumers/consumers-dispute-resolution/out-of-court-procedures/index_nl.htm" data-master-href="https://europa.eu/youreurope/citizens/consumers/consumers-dispute-resolution/out-of-court-procedures/index_en.htm" data-linkid="8f18ff28-46b3-45f0-b191-f967f3603c28">instantie voor alternatieve geschillenbeslechting</a>. Alleen EU-ingezetenen hebben toegang tot procedures voor alternatieve geschillenbeslechting. </p> <p> Kiest u voor formele gerechtelijke stappen, dan kunt u een schadeclaim indienen via de <a title="Europese procedure voor geringe vorderingen" href="https://europa.eu/youreurope/citizens/consumers/consumers-dispute-resolution/formal-legal-actions/index_nl.htm" data-master-href="https://europa.eu/youreurope/citizens/consumers/consumers-dispute-resolution/formal-legal-actions/index_en.htm" data-linkid="823e158d-f7d1-4e5e-98a3-db1e0d31439d">Europese procedure voor geringe vorderingen</a>. U kunt ook een rechtszaak beginnen in het land waar de spoorwegmaatschappij geregistreerd is. De termijn waarbinnen u een zaak tegen een spoorwegmaatschappij bij de nationale rechter aanhangig kunt maken, verschilt in de EU van land tot land. </p> <p> Voor hulp en advies over problemen in verband met de rechten van treinreizigers kunt u ook terecht bij een <a title="Europees Consumentencentrum" href="https://commission.europa.eu/live-work-travel-eu/consumer-rights-and-complaints/resolve-your-consumer-complaint/european-consumer-centres-network-ecc-net_nl" data-linkid="d1150869-fa5c-4de5-8392-cf361f1e5240">Europees consumentencentrum</a> bij u in de buurt. </p> </div><a id="cancelled" name="cancelled"></a><h2> Uw trein werd geannuleerd </h2> <p> Als u vertraging oploopt door een geannuleerde trein en als gevolg daarvan met een vertraging van meer dan 60 minuten op uw eindbestemming aankomt, hebt u recht: </p> <ul> <li> op terugbetaling, binnen 30 dagen, van het volledige bedrag van uw ticket, of van het deel van de reis dat niet is gemaakt, en een terugreis naar uw oorspronkelijke vertrekpunt, als u als gevolg van de door de geannuleerde trein veroorzaakte vertraging niet in staat bent het doel van uw reis te verwezenlijken, <strong>of</strong> </li> <li> om uw reis, al dan niet via een omleiding, voort te zetten zodat u onder vergelijkbare voorwaarden uw eindbestemming bij de eerste gelegenheid bereikt, zonder extra kosten, <strong>of</strong> </li> <li> om uw reis op een latere datum van uw keuze onder vergelijkbare voorwaarden, al dan niet via een omleiding, voort te zetten, zonder extra kosten. Dit omvat alternatief vervoer om u naar uw eindbestemming te brengen wanneer de trein geblokkeerd is en de dienst wordt opgeschort. </li> </ul> <h4> Bijstand en alternatieve reisarrangementen </h4> <p> Daarnaast hebt u recht op bijstand in de vorm van maaltijden en verfrissingen (in verhouding tot de wachttijd). U hebt ook recht op een hotel of andere accommodatie — waar en wanneer dat fysiek mogelijk is — als u als gevolg van de geannuleerde trein moet overnachten of uw verblijf moet verlengen, en op vervoer tussen het hotel/de accommodatie en het station. </p> <p> In geval van annulering kan de spoorwegonderneming u desgevraagd toestaan om zelf alternatieve reisarrangementen te maken met andere aanbieders van vervoersdiensten (per spoor of met andere vervoermiddelen), zodat u uw eindbestemming onder vergelijkbare voorwaarden kunt bereiken. In dat geval vergoedt de spoorwegmaatschappij de door u gemaakte kosten. </p> <p> Als de spoorwegonderneming u echter niet binnen 100 minuten na het geplande vertrek van de geannuleerde trein op de hoogte stelt van de beschikbare alternatieve reismogelijkheden, hebt u het recht om zonder toestemming van de spoorwegonderneming zelf alternatieve reisarrangementen te maken met andere openbaarvervoersdiensten, d.w.z. per trein of bus. De spoorwegmaatschappij moet dan de noodzakelijke, passende en redelijke kosten vergoeden die u hebt gemaakt om deze alternatieve regelingen te treffen. </p> <p> Zelfs als u besluit de reis zoals gepland voort te zetten of een alternatieve vervoersoplossing te accepteren, hebt u mogelijk recht op een schadevergoeding als u 60 minuten of meer te laat aankomt. U hebt ook recht op een hotel of andere accommodatie — waar en wanneer dat fysiek mogelijk is — als u als gevolg van de vertraagde trein moet overnachten of uw verblijf moet verlengen, en op vervoer tussen het hotel/de accommodatie en het station. </p> <p> Als u bij vertrek op de hoogte wordt gebracht van het feit dat uw trein met een vertraging van 60 minuten of meer op uw eindbestemming aankomt, kan de spoorwegonderneming u desgevraagd toestaan om zelf alternatieve reisarrangementen te maken met andere aanbieders van vervoersdiensten (per spoor of met andere vervoermiddelen), zodat u uw eindbestemming onder vergelijkbare voorwaarden kunt bereiken. In dat geval vergoedt de spoorwegmaatschappij de door u gemaakte kosten. </p> <p> Als de spoorwegonderneming u echter niet binnen 100 minuten na het geplande vertrek van de vertraagde trein op de hoogte stelt van de beschikbare alternatieve reismogelijkheden, hebt u het recht om zonder toestemming van de spoorwegonderneming zelf alternatieve reisarrangementen te maken met andere openbaarvervoersdiensten, d.w.z. per trein of bus. U hebt ook recht op een hotel of andere accommodatie — waar en wanneer dat fysiek mogelijk is — als u als gevolg van de gemiste verbinding moet overnachten of uw verblijf moet verlengen, en op vervoer tussen het hotel/de accommodatie en het station. </p> <p> Uw rechten in geval van een gemiste aansluiting zijn van toepassing als u een doorgaand ticket voor uw treinreis hebt. U moet vóór de aankoop van uw ticket(s) op de hoogte worden gebracht of het daarbij om een doorgaand ticket of doorgaande tickets gaat. Als u met individuele vervoersbewijzen reist, zijn deze rechten niet van toepassing, maar er kunnen regelingen zijn tussen uw spoorwegonderneming en andere spoorwegondernemingen om de voortzetting van uw reis te waarborgen in geval van een gemiste aansluiting (bv. HOTNAT (Hop on the next available train - neem de volgende beschikbare trein) of AJC (Agreement on Journey Continuation — de overeenkomst over het voortzetten van de reis)). </p> <p> Als u bij vertrek op de hoogte wordt gebracht van het feit dat uw trein met een vertraging van 60 minuten of meer op uw eindbestemming aankomt, kan de spoorwegonderneming u op verzoek toestaan om zelf alternatieve reisarrangementen te maken met andere aanbieders van vervoersdiensten (per spoor of met andere vervoermiddelen), zodat u uw eindbestemming onder vergelijkbare voorwaarden kunt bereiken. Andere grote of omvangrijke bagage, zoals voorwerpen of dieren die waarschijnlijk hinder, ongemak of schade voor andere passagiers veroorzaken, moet als geregistreerde bagage worden verzonden (overeenkomstig de algemene vervoersvoorwaarden van uw spoorwegonderneming). Deze bagage wordt vervoerd in het bagagewagen van de trein. </p> <p> Als uw geregistreerde bagage verloren gaat of beschadigd raakt, hebt u recht op schadevergoeding, behalve in bepaalde omstandigheden, bijvoorbeeld wanneer uw bagage niet goed verpakt of niet geschikt voor vervoer was. Ook als er vertraging optreedt bij de aflevering van uw geregistreerde bagage, hebt u recht op schadevergoeding, tenzij deze te wijten was aan een fout van uw kant of aan omstandigheden waarop de treinexploitant geen vat heeft. </p> <p> Als uw rolstoel of ander mobiliteitshulpmiddel door de spoorwegonderneming of stationsbeheerder wordt beschadigd of verloren gaat, hebt u recht op een schadevergoeding voor de kosten van vervanging of reparatie. De kosten van een tijdelijke vervanging worden eveneens gedekt, indien deze kosten redelijk zijn.
