section__title--margin">Terms of Use</h1></header><main><div class="card--bordered card--wide terms__card"><p>ShareTheMeal (the “Service” or “we”) is an initiative of the World Food Programme (“WFP”). WFP is an international organization of the United Nations.</p> <p>The access to and use of the Service constitutes acceptance by you or the entity you represent (“User”) of the following terms and conditions of use (the “Terms of Use”). If you do not agree to these Terms of Use, you may not access or use the Service.</p> <p>The ShareTheMeal app can be downloaded from the Apple App Store for iOS and from Google Play and Amazon for Android. Please note that the Apple App Store, Google Play and Amazon are no service of the WFP and are subject to separate terms of the respective third-party service providers.</p> <p>The Service is protected by intellectual property laws worldwide. Nothing in these Terms of Use shall be deemed to confer any third-party rights or benefits on any such content.</p> <p>The Service allows Users to make donations in support of WFP’s projects that aim to provide children in specific regions with food as displayed in the Service. Donations can be made via credit card, Apple Pay, Google Pay, PayPal and other payment methods (each a “Payment Method”). By providing information related to a Payment Method, User represents, acknowledges and agrees that User: (i) is permitted to use that Payment Method; and (ii) shall be the solely responsible for any fee charged by the User’s financial institution or other payment method provider for the transaction.</p> <p>Donations are processed through third-party payment processors such as Braintree, PayPal and Stripe. We cooperate with local fundraising organisations such as Maecenata Foundation, Adalbertstrasse 108, 80798 Munich, Germany and World Food Program USA, 1725 I Street NW, Suite 510, Washington, DC 20006 (a 501(c)(3) public charity) that will forward donations to WFP.</p> <p>We take every reasonable care to ensure that all donations and related transactions are conducted via a secure connection. However, the security of information and payments transmitted via the internet cannot be guaranteed. The User acknowledges and agrees that: (i) donations are at User’s own discretion and risk; and (ii) we have no liability whatsoever for (a) any loss the User may suffer if a third party obtains unauthorized access to any information provided by the User and (b) any act or omission by the User’s financial institution, credit card or other payment method provider, telecommunications services providers or any third party in connection with the donations to WFP and transactions related thereto.</p> <p>Our collection, retention and use of personal information through the Service is described in the <a href="privacy">Privacy Policy</a>.</p> <p>The Service integrates third-party services such as Facebook and contains links to third-party webpages. Third-party services and webpages are not under our control and are subject to the respective third-party’s terms and conditions.</p> <p>The Service is provided “as is” and “as available", without warranty of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose and non-infringement. We do not make any warranties or representations as to accuracy or completeness. We periodically change, improve or update the Service.</p> <p>The mention or omission of specific companies, their products or brand names in the Service does not imply any endorsement or judgement on the part of WFP.</p> <p>WFP’s name, emblem and abbreviation (the “WFP Marks”) are the exclusive property of WFP and are protected under international law. Unauthorized use of the WFP Marks is prohibited. The WFP Marks may not be reproduced or used in any manner without WFP’s prior written permission.</p> <p>We reserve the exclusive right in our sole discretion to (i) alter, limit or discontinue the Service in any respect; (ii) deny user access to the Service without notice (iii) modify these general Terms of Use.</p> <p>Under no circumstances shall WFP, its staff, officials, employees, information or content providers be liable for any loss, damage, liability or expense incurred or suffered that is claimed to have resulted from the use of the Service, including, without limitation, any fault, inaccuracy, error, omission, interruption or delay deletion, defect, alteration or use, with respect thereto, infection by virus or any other contamination of by anything which has destructive properties, communication line failure, regardless of cause. Under no circumstances, including but not limited to negligence, shall WFP be liable for any direct, indirect, incidental, special or consequential damages, even if WFP has been advised of the possibility of such damages.</p> <p>Nothing in these Terms of Use shall imply a waiver, express or implied, by WFP, the United Nations and the Food and Agriculture Organization of the United Nations of any privileges and immunities enjoyed by them pursuant to the 1946 Convention on the Privileges and Immunities of the United Nations, the 1947 Convention on the Privileges and Immunities of Specialized Agencies, customary international law, other relevant international or national agreements, and under domestic law.</p> <p>We reserve the right to seek all remedies available by law for any violation of these Terms of Use including any rights of WFP in the Service. No waiver by WFP of any provision of these Terms of Use shall be binding except as set forth in writing and signed by its duly authorized representative.</p> <p>These Terms of Use and any dispute arising therefrom shall be exclusively governed by international principles of international law, to the exclusion of any single national system of law.</p> <p>Any dispute, controversy or claim arising out of or relating to these Terms of Use (including the Privacy Policy), or the breach, termination or invalidity hereof or to the use of the Service by the User or any content available therein shall be settled by Arbitration in accordance with the UNCITRAL Arbitration Rules then in force. The arbitral tribunal, which shall be composed of 1 (one) arbitrator, shall be empowered to order: (i) the return or destruction of goods or any property, whether tangible or intangible, or of any confidential information provided hereunder; (ii) the termination hereof; or (iii) that any other protective measures be taken with respect to the goods, services or any other property, whether tangible or intangible, or of any confidential information provided hereunder, as appropriate, all in accordance with the authority of the arbitral tribunal pursuant to Article 26 (‘the Interim Measures’) and Article 34 (‘the Form and Effect of the Award’) of the UNCITRAL Arbitration Rules. The arbitral tribunal shall have no authority to award punitive damages. WFP and the User shall be bound by any arbitration award rendered as a result of such arbitration as the final adjudication of any such dispute. The language of any such proceedings shall be English.</p> <p>To the extent that there exists more than one language version of these Terms of Use and there is any inconsistency between the versions,
