prospects for industrial competitiveness and economic growth. It may involve supporting specific firms or industries (“vertical” policies) or deploying across-the-board investment, targeting for example infrastructure or skills (“horizontal” policies). Its instruments range from subsidies and tax breaks to trade protection and intellectual property rights, as well as competition policy.</p></div> </div> <div class="definition-section"> <h3 id="part-texte" class="definition-section-title">Commentary</h3> <div class="crayon article-texte-112362 texte surlignable"><p>A conventional rationale behind industrial policy is that it remedies market failures such as for example in providing public goods or subsidizing activities which would otherwise not attract sufficient private investment.</p> <p>Earlier examples of well-known industrial policy efforts include the Pentagon’s Defense Advanced Research Projects Agency, created in 1958 following the Soviet Union’s launch of Sputnik, the first artificial satellite, and which has been credited with paving the way for the modern internet and the Global Positioning System (GPS). In Europe, the aerospace operator Airbus, a consortium formed in 1970, is the result of a collaborative effort by the British, French, German and Spanish governments to challenge American companies such as Boeing.</p> <p>While the 1980s saw a turn against heavy state involvement, there has been a renewed debate about the role of industrial policy in the context of recent challenges such as the 2008 financial crisis, the digital transition, climate change, the rise of China, the COVID-19 pandemic, and global chain disruptions.</p> <p>Some of these challenges have led to the latest examples of industry policy efforts in the EU and US, such as the EU’s <i>Important Projects of Common European Interest</i> (IPCEI), Europe’s state aid tool of choice to support the European Commission’s industrial goals, including on semiconductors and hydrogen, and the US’ Inflation Reduction Act, which for example promotes investment in domestic clean energy.</p> <p>While competition and industrial policy are sometimes portrayed as foes, they can be complementary given the role of competition as a driver for growth, innovation and productivity. Industrial policies stand to gain from embedding competition principles, in particular in times of economic distress. Competition policy can act as a catalyst for countries’ efforts, contributing to an inclusive recovery by delivering prices that are more competitive and enhancing new employment creation. However, this position has not always gathered support.</p> <p>In the US, the National Industrial Recovery Act of 1933 was enacted as a response to the Great Depression. This policy measure allowed firms to agree on prices and quantities in certain sectors, as long as companies raised wages above market-clearing levels. Economists have argued that this approach may have aggravated the impact of the Great Depression, rather than contributing to the economic recovery.</p> <p>More recently, in 2019, the proposed merger of the railway operations of the German conglomerate Siemens and French company Alstom was at the heart of the EU’s industrial policy debate. The discussion focused on how the EU should support its economy, and whether it should promote so-called <i>European champions</i> in order for its industry to compete against China’s state-backed firms. The European Commission reviewed the merger under the EU Merger Control regime and eventually blocked the deal in February 2019, arguing that it would have left consumers in the EU worse-off, by significantly impeding competition in the markets for rail signaling systems and very high-speed trains.</p> <p>In the aftermath of the Siemens/Alstom case, the EU issued <i>A New Industrial Strategy for Europe</i> (2020), where it upheld an independent EU competition policy, while simultaneously turning its attention to trade defense mechanisms and paving the way for the Foreign Subsidies Regulation (2022). The latter intends to address distortions in the Internal Market caused by foreign subsidies.</p> <p>If governments are to engage in industrial policy, they should adopt a competitively neutral policy. This is one of the eight key recommendations highlighted by Tirole (2017) for industrial policy design.</p> <p>In this respect, competition authorities may play an important role in informing governments and policymakers to ensure that industrial policy initiatives do not negatively impact competition. This is particularly important when governments prepare responses to economic shocks.</p> <p>For example, in 2021 the Portuguese Competition Authority (AdC) published a report on “<i>The role of competition implementing the economic recovery strategy</i>”, highlighting a set of principles to promote competition, efficiency and innovation to strengthen the path to an inclusive and sustainable economic growth. The Portuguese economic recovery strategy aimed at restoring the ability of firms to resume their activity, defining a set of investments to mitigate the business-financing gap, given solvency issues. In particular, the strategy foresaw direct and debt financing to firms. The AdC’s report emphasized the need to promote competition and efficiency when deploying State support, recommending that the latter should be proportionate, well targeted, and should not result in adverse effects on competition. The AdC highlighted that State support should be based on objective criteria and, if possible, applicable to all firms in a given sector. This is desirable in order to ensure competitive neutrality and minimize distortions between competing firms in the market.
