margin-left: auto; margin-right: auto;" src="https://image.nbd.com.cn/uploads/articles/images/1672296/_____20250105120220.jpg" alt="" width="630" data-not-nbd-origin="0" data-imgscale="0.8490566037735849" data-imgwidth="1080" data-imgheight="1272" /></p> <p>2024年12月31日，《北京市自动驾驶汽车条例》（简称北京《条例》）通过，自2025年4月1日起施行，为L3级（一种有人监控的有条件自动驾驶）及以上级别自动驾驶汽车提供制度规范，包括个人乘用车出行场景。</p> <p>而就在北京《条例》通过的前一日，《武汉市智能网联汽车发展促进条例》（简称武汉《条例》）也正式发布，将自2025年3月1日起正式施行。</p> <p>国内首部出台并施行的智能网联汽车管理法规，是《深圳经济特区智能网联汽车管理条例》（简称深圳《条例》），于2022年8月1日起施行。此后近两年半的时间，均未有城市出台相关法规。武汉和北京近日同步为L3及以上级别自动驾驶车辆上路立法，是否意味着自动驾驶的政策环境有大的变化？新能源车企如何应变？对消费者购车又将产生哪些影响？《每日经济新闻》记者（简称每经记者或记者）第一时间展开调查。</p> <p style="text-align: center;">自动驾驶与智能驾驶的区别</p> <p><img class="nbdLazyload" style="display: block; margin-left: auto; margin-right: auto;" src="https://image.nbd.com.cn/uploads/articles/images/1672299/1736068737______20250103160401.jpg" alt="" data-not-nbd-origin="0" data-imgscale="0.7781885397412199" data-imgwidth="421" data-imgheight="541" /></p> <p style="text-align: center;"><strong>1</strong></p> <p style="text-align: center;"><strong>三地《条例》略有不同</strong></p> <p>根据国家市场监督管理总局发布的《汽车驾驶自动化分级》国家推荐标准，自动驾驶技术分为六个等级，从L0到L5。L0为人工驾驶，L1、L2级别人类驾驶员主导，系统辅助。从L3级别开始，车辆控制权逐渐从人类驾驶员转移到自动驾驶系统，这一转变在泊车辅助、自适应巡航和车道居中辅助等功能中尤为明显。</p> <p><img class="nbdLazyload" style="display: block; margin-left: auto; margin-right: auto;" src="https://image.nbd.com.cn/uploads/articles/images/1672300/__-__.jpg" alt="" width="630" data-not-nbd-origin="0" data-imgscale="0.41745414118954977" data-imgwidth="751" data-imgheight="1799" />在深圳、武汉和北京三个《条例》中，智能网联车辆或自动驾驶车辆，都是指可以由自动驾驶系统替代人的操作在道路上安全行驶的汽车，包括有条件自动驾驶（L3）、高度自动驾驶（L4）和完全自动驾驶（L5）三种类型。而对于L3车辆申请上路流程、发生事故后责任如何界定等问题，三地《条例》有些许差异。</p> <p><strong>L3级自动驾驶车上路，有哪些步骤？</strong></p> <p>深圳、武汉和北京《条例》均要求，搭载L3级自动驾驶技术的车辆在上路前须进行道路测试和示范应用，须向相关部门提出申请，经审核批准后方可进行，但在申请流程、道路测试和示范应用的具体要求上，以及对车辆和车企的额外要求方面略有不同，如下表所示：</p> <p><img class="nbdLazyload" style="display: block; margin-left: auto; margin-right: auto;" src="https://image.nbd.com.cn/uploads/articles/images/1672301/1736068809___-__.jpg" alt="" data-not-nbd-origin="0" data-imgscale="0.5788923719958202" data-imgwidth="554" data-imgheight="957" /></p> <p><strong>在L3自动驾驶状态下，交通事故责任如何判定？</strong></p> <p>由于交通事故的责任认定属于国家立法事权，地方立法无权单独作出具体规定，因此，北京、武汉、深圳的《条例》在这方面与国家相关法律法规进行了衔接和协调，同时根据地方实际情况对一些具体操作流程和要求进行了细化和补充，其中在责任判定和数据是否作为责任认定依据方面，三地的《条例》略有不同，如下图所示：</p> <p><img class="nbdLazyload" style="display: block; margin-left: auto; margin-right: auto;" src="https://image.nbd.com.cn/uploads/articles/images/1672304/1736068842_____-__.jpg" alt="" data-not-nbd-origin="0" data-imgscale="0.7234600262123198" data-imgwidth="552" data-imgheight="763" /></p> <p>业内观点认为，北京和武汉相继出台关于L3级自动驾驶的条例，标志着政策层面对于L3级及以上自动驾驶技术的快速落地进行了有力支持和推动。</p> <p>针对北京《条例》，盘古智库高级研究员江瀚认为，将个人乘用车出行纳入条例，将推动技术普及和民用市场发展，为消费者提供便捷安全的出行选项，还将促使企业在明确市场需求下更有动力研发L3及以上级别自动驾驶技术，促进产业链合作。</p> <p>北方工业大学汽车产业创新研究中心主任、教授纪雪洪在接受每经记者采访时表示：“目前的情况表明，无论是政府还是车企，尤其是车企，都普遍认为自动驾驶技术发展迅速，希望能在法律层面进行推动，以便这些车辆在销售给消费者后能够在道路上使用。”</p> <p>纪雪洪认为，无论是北京市还是武汉市的《条例》，对自动驾驶发展都明确了三个阶段：</p> <p>第一阶段是道路测试，这已经较早开展了；</p> <p>第二阶段是示范应用，如果示范应用经过专家评估达到要求，就会进入关键的第三阶段——道路应用试点。</p> <p>进入道路应用试点意味着范围将进一步扩大，且可以拿到牌照，从而进行L3的应用。整体上看，武汉和北京的法规，为L3车辆的应用做了较充分的准备。</p> <p>对于自动驾驶事故的责任认定，纪雪洪认为，武汉《条例》明确了相关责任人在事故发生后应承担的法律责任。例如，驾驶员、安全员以及车辆的所有者和管理人在出现事故时，应该如何处理和认定责任，这一点比较明确。这为下一步L3的推行在责任划分方面做了准备。</p> <p>“多地发布自动驾驶条例，还可能会给保险公司带来新的挑战和机遇，同时也促使他们重新评估风险模型和服务内容。对就业结构也将产生深远影响，催生新的职业，如自动驾驶监控员等。”江瀚对每经记者表示。</p> <p style="text-align: center;"><strong>2</strong></p> <p style="text-align: center;"><strong>激战自动驾驶</strong></p> <p style="text-align: center;"><strong>多家车企已全面备战</strong></p> <p>公开数据显示，2024年我国乘用车L2级及以上自动驾驶的渗透率是55.7%，中国电动汽车百人会副理事长兼秘书长张永伟预计这一数字到2025年可能会接近65%。另据J.D.Power（公司名称）发布的《2023中国新车购买意向研究》（NVIS）显示，智能化体验在购车决策中的影响权重上升到14%，成为继汽车质量和性能之后的第三大决策因素，与汽车设计的权重持平，超越了品牌和价格。</p> <p>对于自动驾驶来说，硬件是基础，包括激光雷达传感器、控制器等关键部件，特别是高性能计算芯片；软件则是“灵魂”，涵盖感知、决策、控制等多个层面的算法和系统。目前，自动驾驶已成各大车企争夺的焦点。</p> <p>作为华为与江淮汽车合作品牌尊界首款车，S800将按照L3自动驾驶架构设计，并于2025年上市；</p> <p>理想汽车智能驾驶副总裁郎咸朋公开表示，理想汽车有望在2025年实现L3级别自动驾驶。</p> <p>同时，近日也有传闻称某知名车企为了备战自动驾驶技术，连元旦春节都不休假，记者试图进一步核实，但截至发稿未获回复。</p> <p>小米汽车在2024年9月完成了智能驾驶团队的组织架构调整，将“感知”和“规控”两个部门合并为“端到端算法与功能部”，这一举措旨在推进量产方案的开发。</p> <p>紧接着在10月，比亚迪也成立了前瞻部门，专注于端到端技术的落地实施。比亚迪副总裁、汽车新技术研究院院长杨冬生明确指出，比亚迪的策略是尽快在大众车型上补充高阶自动驾驶功能，并计划在一两年内让10万元以下的车型都能配备高阶自动驾驶功能。</p> <p>除去软件层面，车企在硬件层面也做了诸多准备，比如自研芯片。小鹏汽车在2024年11月的“小鹏AI科技日”上展示了自研的“图灵AI芯片”，这款芯片具备40核处理器，AI算力相当于三颗英伟达Orin X芯片。理想汽车也在推进自研芯片项目，以提升其自动驾驶能力。同时，传统车企如比亚迪和东风汽车集团也在积极自研或投资芯片产业，东风汽车预计到2026年将广泛采用7nm制程芯片。</p> <p>另一方面，在车市竞争激烈的背景下，车企为了将智能驾驶技术进一步下探，不少车企推出纯视觉方案。例如，小鹏汽车推出了MONA 03，该车型采用了全新一代小鹏AI鹰眼视觉方案。然而，纯视觉方案在快速应用的同时，也面临着一些挑战，尤其是在夜间和恶劣天气中，视觉感知的灵敏度会显著下降。对此，有观点指出，要实现L2以上更高级别的自动驾驶，当前技术还无法完全解决这些难题，需要激光雷达等传感器的辅助。</p> <p>业内顶级的一家激光雷达厂家在2024年三季度投资者交流会上透露，虽然某车企的主要车型目前采用纯视觉方案，但已计划在2025年3～4季度重新引入激光雷达。这一决策部分是因为激光雷达成本降低，同时也因为该车企希望超越L2级别自动驾驶，以应对华为等竞争对手。</p> <p>有专家认为，对于L3级别自动驾驶，安全性是关键，因为责任主体很可能从驾驶员逐步转移到车企。所以，特斯拉虽然在纯视觉技术上领先，但也不敢轻易推进到L3级别。而在国内，激光雷达对于提高自动驾驶的安全性至关重要，尤其是在强阳光等视觉受限场景下。</p> <p style="text-align: center;"><strong>3</strong></p> <p style="text-align: center;"><strong>同济大学朱西产：</strong></p> <p style="text-align: center;"><strong>预计工信部2025年发布</strong></p> <p style="text-align: center;"><strong>L3自动驾驶车辆的认证</strong></p> <p>随着北京、武汉《条例》近期公布，政策层面为L3级及以上自动驾驶汽车的市场主体提供了明确、透明的制度规范。这意味着，个人乘用车驾驶人在遵守道路通行规定和车辆使用说明的前提下，可以规范使用自动驾驶功能。</p> <p>同济大学汽车学院教授、汽车安全技术研究所所长朱西产在接受《每日经济新闻》记者（以下简称NBD）独家专访时，分享了他对L3级自动驾驶的看法。朱西产教授预测，2025年将成为自动驾驶技术的关键决胜年。</p> <p><img class="nbdLazyload" style="display: block; margin-left: auto; margin-right: auto;" src="https://image.nbd.com.cn/uploads/articles/images/1672306/__1.jpg" alt="" width="630" data-not-nbd-origin="0" data-imgscale="1.4972222222222222" data-imgwidth="1617" data-imgheight="1080" /></p> <p style="text-align: center;">朱西产图片来源：受访者供图</p> <p><strong>NBD：2024年6月工信部批准9家车企测试L3级别自动驾驶，另外也有车企宣布2025年实现L3自动驾驶，距离L3大规模上路是不是很近了？</strong></p> <p><strong>朱西产：</strong>预计工信部2025年会发布L3级自动驾驶车辆的相关认证。参考欧盟已经完成了L3级别的认证，初期车企会将L3级自动驾驶认证的ODD（Operational Design Domain，操作设计域）缩得很小，意味着自动驾驶功能将在非常有限的条件下启用，例如特定的道路和环境。</p> <p><strong>NBD：L3自动驾驶与L2有何不同？</strong></p> <p><strong>朱西产：</strong>L3级别的自动驾驶技术与L2+在产品形态和技术形态上是一样的，主要的区别在于使用层面。在L2+级别下，驾驶员脱手驾驶时间不能超过15秒，而L3级别允许驾驶员在符合操作范围的特定条件下暂时脱离驾驶，但也不允许深度脱离驾驶，比如不能离开驾驶位置或睡着。欧盟的ECE R157标准已经发布，国内的标准也在跟进。</p> <p>从用户体验方面来看，欧洲标准规定了L3级别的自动驾驶只能在特定条件下启用，如在高速公路上单车道巡航，车速在0到60公里/小时之间。这种限制使得L3级别的自动驾驶只能在非常有限的条件下使用，例如在晴天的高速公路上，一旦遇到恶劣天气或需要变道等情况，系统就会退出L3模式，降级为L2级别。为了保证L3级别的高安全性，其适用范围被极度缩小，并且由于企业需要增加冗余以满足安全要求，将进一步推高成本。</p> <p><img class="nbdLazyload" style="display: block; margin-left: auto; margin-right: auto;" src="https://image.nbd.com.cn/uploads/articles/images/1672307/1736068932______20250105120212.jpg" alt="" width="630" data-not-nbd-origin="0" data-imgscale="0.6527415143603134" data-imgwidth="750" data-imgheight="1149" /></p> <p><strong>NBD：一旦发生事故，L3级自动驾驶责任如何认定？</strong></p> <p><strong>朱西产：</strong>L3和L4统称为高等级自动驾驶，在L2+级别，用户需要自行承担责任，而L3级别则涉及企业的产品责任。目前，全球只有华为和特斯拉承诺了NOA（Navigate on Autopilot，即自动辅助导航驾驶技术）&zwnj;保险服务，即在智能驾驶状态下发生主责交通事故时，由企业承担保险责任。然而，L3和L4级别还可能面临产品召回等责任问题，一旦发生这种情况，企业怎么办？</p> <p>因为L3级别自动驾驶涉及企业承担更多产品和事故责任，这使得成本大幅上升。由于L3级别可能带来的产品召回等责任问题，因此，现在L3级别的自动驾驶功能，大概率不会在100万元以下的车辆搭载，因为不划算。</p> <p>这就是L3级自动驾驶目前的现状，从技术发展和政策支持来看，初期车企的操作设计域会缩得非常小，假如放开操作设计域，那你就要有相应的技术去保障，所以华为也是把L3放在了他百万元级别的尊界上，而不是其他“三界”。目前，华为尊界已在申报工信部的认证，通过认证后，他会给尊界车辆用户释放L3的功能。</p> <p>而对于运营车辆而言，人力成本是网约车服务中最高昂的部分。由于L3级别的自动驾驶仍然需要司机在车内，它并没有为出行服务带来成本上的优势。而如果要发展Robotaxi等无人驾驶出租车服务，则需要达到L4或L5级别的自动驾驶技术。</p> <p><strong>NBD：当前L3级别自动驾驶在实际应用中面临的最大挑战是什么？L3落地难点主要是什么？</strong></p> <p><strong>朱西产：</strong>从技术发展角度来看，此前L2+和L4自动驾驶的研发是由不同团队负责的，原先专注于无人驾驶的算法团队在这一领域逐渐占据优势。比如福特的BlueCruise自动驾驶辅助系统就部分采用了Argo AI的技术，蔚小理跟特斯拉一样，全部都是朝着无人驾驶方向在发展，即强人工智能。上汽的智己、东风的岚图、广汽的昊铂全都是Momenta的技术，Momenta也是无人驾驶出身。博世与奇瑞合作的新纪元系统也是一个例子，博世负责硬件部分，而文远知行则负责软件和无人驾驶算法的开发。</p> <p>目前，L2+、L3、L4在技术上的界限变得越来越模糊，现在的NOA技术，基本上是从L4级别向下延伸发展。算法上是原来做无人驾驶的算法团队胜出。自动驾驶的安全性，尤其是人工智能在边缘场景下的表现和安全性的长尾问题，成为难题，导致无法实现完全自动驾驶，许多技术因此停留在L2+级别，L2+的NOA技术可能会在相当长的一段时间内在乘用车领域内被广泛使用。</p> <p>除了技术层面外，还包括上面提到的“产品责任”问题，基于此，企业成本就会提高，为了安全性，就只能把操作设计域减小。</p> <p><strong>NBD：目前在智驾领域，特斯拉FSD是一个比较特殊的存在，很多车企在技术层面也喜欢与其进行比较，如端到端、纯视觉等方面，您怎么看？目前国内车企在智驾技术上的进展和成熟度如何？</strong></p> <p><strong>朱西产：</strong>当前自动驾驶领域普遍采用的算法源自于无人驾驶技术，这些算法依赖于强大的人工智能，强调摄像头的作用而相对减轻对其他传感器的依赖。在是否使用激光雷达的问题上，从安全冗余的角度来看，激光雷达目前还是不可或缺的。对于成本在5000元以下的智能驾驶系统，由于成本限制，不太可能配备激光雷达；而成本超过1万元的系统则通常会包含激光雷达，以确保传感器的冗余性和安全性。</p> <p>特斯拉在全球以其技术创新而闻名，但在安全问题上，该公司一直面临着外界的不同看法和挑战。在自动驾驶的实践中，特斯拉对于激光雷达的使用持有独特的观点。特斯拉CEO马斯克倾向于采用第一性原则，认为在技术发展过程中应避免不必要的中间步骤，因此特斯拉更多地依赖于摄像头和人工智能算法。</p> <p>所以我觉得中国企业还是不错的，尤其是华为并没有一门心思地跟着特斯拉走。比如，华为采取了两段式的端到端自动驾驶策略，其中感知部分完全依赖于人工智能，而运动规划部分则主要依赖于准则模型，这些模型的可靠性较高。因此，我们期待的还是一个波澜不惊的、不需要带来太多惊喜的自动驾驶技术，能够在各种情况下稳定地提供安全、可靠的驾驶体验。</p> <p><strong>NBD：传闻特斯拉FSD即将入华，随着L3自动驾驶政策开始落地，您觉得特斯拉会怎么做？</strong></p> <p><strong>朱西产：</strong>我们说驾驶L3级别的车辆，意味着车辆具备较高的自动驾驶性能，即车辆在大多数情况下能够独立驾驶而不需要人工干预，也就是MPI（Mean Time Between Intervention，干预间隔平均时间）非常长。</p> <p>全球范围内，特斯拉及其CEO马斯克是个例外，特斯拉不会来做L3认证，马斯克创造了另外一套说辞。现在的特斯拉FSD V12版本，被称为“监督驾驶”（Supervised），它既不承认是完全自动驾驶，也不完全认同是辅助驾驶。在美国，FSD 12.5版本的MPI已经达到了3000公里，意味着车主在一个月的驾驶中可能只需要接管一两次，几乎不需要人工干预。特斯拉甚至承诺，如果在使用FSD功能时发生主责交通事故，将由特斯拉的保险来理赔。这种承诺在全球范围内只有很少公司敢于跟进，华为是其中之一。</p> <p><strong>NBD：您之前提到2025年将是自动驾驶技术的关键决胜年，在这一背景下，您如何看待2025年自动驾驶技术的发展态势和行业趋势？</strong></p> <p><strong>朱西产：</strong>2025年就是自动驾驶的决胜年，现在自动驾驶价格成本不像我们想像的那么高。Robotaxi的BOM成本（成本总和）已经从最初的300万元、100万元、50万元、25万元降至7万元，甚至更低。而NOA的成本也在不断降低，从7万元降至3.5万元、从2万元到3000元，预计到2025年，将有成本在3000元以下的NOA产品投入市场，NOA的渗透率有望超过40%。</p> <p>随着智驾快速上车，车企方面也在开发低成本的自动驾驶系统。例如，华为也在准备一套纯视觉、低算力的系统，以适应不同成本和市场需求，这样的系统将只依赖于48TOPS的算力，以实现更广泛的市场应用。</p> <p>2024年～2025年的重点还在于，将L2+级别的自动驾驶技术尽快应用到量产车辆中，并建立起数据闭环，以便进行快速迭代。目标是每月进行1.2～1.5次的迭代，即大约每两个月进行三次OTA（Over-The-Air，空中下载软件更新），以快速提升技术水平。</p> <p style="text-align: center;">记者|刘曦</p> <p style="text-align: center;">编辑|易启江</p> <p style="text-align: center;">视觉|蔡沛君</p> <p style="text-align: center;">排版|易启江</p> <p><img class="nbdLazyload" style="display: block;
