Foto: christian russau" /></div><div class="entry-content"><p><em>Mehr als drei Jahre nach dem Bruch des Rückhaltebeckens der Mine Córrego do Feijão bei Brumadinho will die Bundesstaatsanwaltschaft Entschädigungszahlungen an an vom Dammbruch betroffene Indigene Pataxó und Pataxó Hã Hã Hãe erreichen. Die Pataxó- und Pataxó-Hã-Hãe-Indigenen lebten in dem Dorf Naô Hohã am Ufer des Paraopeba-Flusses bei São Joaquim de Bicas im brasilianischen Bundesstaat MInas Gerais und waren gezwungen, ihr Land zu verlassen, als der Wasserlauf nach dem Dammbruch der Vale-Mine Brumadinho mit Schwermetallen verseucht war. Dorfstrukturen, Lebenswelt und Bestreitung ihres Lebensunterhalts wurden durch den Dammbruch nachhaltig geschädigt. Betroffene warten noch immer auf Entschädigung.<br /> </em></p> <p>Von <a href="https://www.outro-mundo.org" target="_blank" rel="noopener">Christian Russau</a></p> <p>Die <a href="http://www.mpf.mp.br/mg/sala-de-imprensa/noticias-mg/mpf-e-dpu-ajuizam-acao-para-reparacoes-individuais-a-indigenas-atingidos-pelo-desastre-da-mina-do-corrego-do-feijao" target="_blank" rel="noopener">Bundesstaatsanwaltschaft MPF und die Pflichtverteidigung der Bundesunion DPU haben gestern eine Zivilklage gegen Vale S/A eingereicht</a>, um das Bergbauunternehmen Vale dazu zu verpflichten, ein individuelles Wiedergutmachungsprogramms und Entschädigungszahlungen an die indigenen Familien der Pataxó und Pataxó Hã Hã Hãe des Dorfes Naô Xohã zu erreichen. Diese waren vom Bruch des Bergbaudamms (tailings) der Mine Córrego do Feijão bei Brumadinho betroffen. In der Klage fordern MPF und DPU die Zahlung von zusammengerechnet mehr als 1.000 Mindestlöhnen – insgesamt umgerechnet etwa 1,2 Millionen Reais an Entschädigungszahlungen „für materielle und immaterielle Schäden, die indigene Erwachsene, schwangere Frauen, ältere Menschen, Kinder, Jugendliche und Anführer erlitten haben, die von den Auswirkungen der Tragödie in einem Staudamm der Firma Vale in Brumadinho betroffen waren“, <a href="http://www.mpf.mp.br/mg/sala-de-imprensa/noticias-mg/mpf-e-dpu-ajuizam-acao-para-reparacoes-individuais-a-indigenas-atingidos-pelo-desastre-da-mina-do-corrego-do-feijao" target="_blank" rel="noopener">so MPF und DPU auf ihrer Internetseite</a>.</p> <p>Konkret fordern MPF und die DPU als Entschädigung für individuell erlittene materielle und immaterielle Schäden die Zahlung von 737 Mindestlöhnen pro erwachsene Person, zusätzlich 61 Mindestlöhne pro schwangere Frau, 40 Mindestlöhne pro ältere Person, 111 Mindestlöhne pro indigenem Anführer und 60 Mindestlöhne pro Kind oder Jugendlichem in der jeweiligen Familiengruppe. der Betrofenen. Die Geschädigten sind die Mitglieder der indigenen Völker der Pataxó- und Pataxó-Hã-Hãe, die das Dorf Naô Hohã bilden, sowie auf weitere Familiengruppen, die dem MPF und der DPU gegenüber bereits ihr Einverständnis daran bekundet hätten, dass ihre jeweiligen Rechte auf individuelle Wiedergutmachung in dieser Aktion behandelt werden. Die MPF und die DPU fordern außerdem, dass die gleichen individuellen Entschädigungen den indigenen Völkern gewährt werden, die das Dorf Katurãma und einen davon entfernter wohnenden, unabhängigen Familienkern bilden, die aber ebenfalls vom Bruch des Brumadinho-Staudamms betroffen seien und die derzeit von privaten Anwält:innen unterstützt würden und direkt mit Vale verhandelten. Voraussetzung dafür, so MPF und DPU, sei, dass diese Betroffenen entsprechend den Regularien zur freien, vorherigen und informierten Befragung (FPIC) im Voraus konsultiert werden und ihre Absicht bekunden, dass ihre jeweiligen Rechte auf individuelle Entschädigungen auch in dieser Klage behandelt werden.</p> <p>Ziel des MPF und der DPU sei es, so die beiden Institutionen, einerseits, die indigene Autonomie zu respektieren und die freie Wahl der Privatanwält:innen durch die indigene Bevölkerung zu wahren. In diesem Sinne greife die jetzt von MPF und DPU eingereichte Klage den parallel laufenden direkten Verhandlungen der indigenen Bevölkerung mit der verantwortlichen Firma Vale nicht vor, wenn sie weiterhin von privaten Anwält:innen unterstützt werden möchten. Andererseits sollen nach dem Willen der Justizorgane MPF und DPU die Gruppen in der jetzt eingereichten Zivilklage nicht ausgeschlossen und berücksichtigt werden. Durch die Aufnahme der Option für indigene Völker, die bereits direkt mit dem Bergbauunternehmen verhandeln, wollen die Institutionen das Risiko einer zukünftigen Verjährung des Rechts auf individuelle Wiedergutmachung vermeiden, so MPF und DPU.</p> <p>Laut dem Fachgutachten, mit dem MPF und DPU die Klage begründen, wurden die genannten indigenen Völker der Pataxó und Pataxó Hã Hã Hãe durch den <a href="https://www.kooperation-brasilien.org/de/themen/politik-wirtschaft/brumadinho-und-kein-ende-in-sicht" target="_blank" rel="noopener">Brumadinho-Dammbruch</a> mehrfach geschädigt: verseuchtes Flusswasser, das zuvor als Trinkwasser, für Fischerei, Baden und Freizeit genutzt wurde, bis hin zu kulturellen und spirituellen Schäden, da der Paraopeba-Fluss, in dem sie ihre Rituale abhielten, nicht mehr nutzbar war. Dadurch wurden die gewachsenen Dorfstrukturen und deren Lebenswelten nachhaltig gestört. Auch erlitten die Indigenen indirekte Schädigungen durch den Dammbruch, so wurde die Tätigkeit des Kunsthandwerk nach dem Dammbruch kaum mehr ausgeübt, eine Tätigkeit, von der die Mitglieder der indigenen Gemeinschaft zur Bestreitung ihres Lebensunterhaltes abhingen, die aber nach dem Dammbruch unrentabel wurde, einerseits wegen der Knappheit und des Mangels an Rohstoffen, die durch den Dammbruch in Mitleidenschaft wurden, oder wegen des Verlusts an Ruhe, den diese Tätigkeit erfordert. Dies liege auch daran, dass das Leben der indigenen Bevölkerung nach dem Dammbruch von vielen Versammlungen auf der Suche nach Wiedergutmachung sowie von notwendigen Protesten und Demonstrationen bestimmt wurde. Für MPF und DPU ist klar: „Die Lebensumstände [der indigenen Pataxó und Pataxó Hã Hã Hãe] erfuhren eine tragische Wendung, die sich weitgehend um den Prozess der Wiedergutmachung drehte, und zwar in einer so akuten Weise, dass sie sogar ihre Lebenspläne und -projekte unterbrochen wurden“. MPF und DPU erinnern daran, dass „das Bergbauunternehmen Vale seine Pflicht zur Wiedergutmachung zugunsten der indigenen Gemeinschaft bereits durch die vorläufige Anpassungsklausel anerkannt hat, die am 5. April 2019 vom MPF zusammen mit den Völkern Pataxó und Pataxó Hã Hã Hãe des Dorfes Naô Xohã mit dem genannten Bergbauunternehmen unterzeichnet wurde und die das Recht der betroffenen indigenen Bevölkerung auf eine angemessene Wiedergutmachung der erlittenen Schäden auch aus individueller Sicht belegt.“ Doch bislang sind die Entschädigungszahlungen noch nicht geflossen, so MPF und DPU. Seit 2008 setzt GegenStrömung sich dafür ein, Betroffene insbesondere im Globalen Süden zu unterstützen und politische Rahmenbedingungen so zu verändern, dass diese Auswirkungen adressiert und schädliche Projekte nicht umgesetzt werden.</p> <p>Unser Ansatz führt dabei über deutsche Akteure in globalen wirtschaftlichen und politischen Strukturen. Ob deutsche Unternehmen, die Staudämme im Ausland bauen oder finanzieren, Außenwirtschaftsförderung oder Entwicklungspolitik der Bundesregierung oder politische Rahmensetzungen in der europäischen und internationalen Energiepolitik – Entscheidungen, die in Deutschland getroffen werden, haben weltweite Auswirkungen.
