<p>個人的・家庭内その他これに準ずる範囲内で使用する場合は、使用者が複製できます。ただし、公衆送信(送信可能化を含む)はこの使用に含まれませんので、個人のブログや閲覧者が限られるものであってもインターネットサイトやブログ、SNS等に許可なく記事や写真を転載することはできません</p> <h5>引用　(著作権法第32条)</h5> <p>他人の著作物の一部を自己の著作物に引用することができますが、著作権法では「公正な慣行に合致するものであり、かつ、報道、批評、研究その他の引用の目的上正当な範囲内でおこなわれるものでなければならない。」とされています。これは、利用されるものは公表された著作物であること▽自己の著作物が「主」で引用した著作物が「従」の関係にあること▽ 引用した著作物が明瞭に区分されていること▽その利用に必要性があること▽出典を明示すること――これらの要件を満たす場合に、著作権者の権利が制限されることをいいます。たとえば、ブログやSNS等で、記事全文または一部を転載し、【引用元:この記事の著作権は、毎日新聞社に帰属します。】のように出典を表記しても、その他の引用の要件を満たさない場合は、著作権法違反となります。</p> <h5>学校等の教育機関での利用　(著作権法第35条)</h5> <p>学校等の教育機関では、教員と生徒等が授業の過程において、記事等を複製したり、公衆送信（放送、有線放送、インターネット送信）したり、公に伝達することができます。なお、一部利用方法を除き、公衆送信する場合は、補償金の支払いが必要です。詳しくは一般社団法人授業目的公衆送信補償金等管理協会SARTRAS（サートラス）の<a href="https://sartras.or.jp/seido/" target="_blank">「授業目的公衆送信補償金制度とは」</a>（外部サイト）をご覧ください。<br /> 以下のような授業以外での利用には許諾申請が必要です。料金についてはお問い合わせください。</p> <ul> <li>・記事を使用した教材を学内のサーバーに保存する<br /> ・教職員会議、保護者会、ＰＴＡ主催の親子向け講座での記事コピー配布<br /> ・学校説明会やオープンキャンパスでの模擬授業での記事コピー配布 </li> </ul> <p>学校での新聞の二次利用については、日本新聞協会の<a href="https://nie.jp/teacher/copyright/" target="_blank">「教育に新聞をNIE」</a>（外部サイト）も参考にしてください。</p> <h5>試験問題としての複製等（著作権法第36条）</h5> <p>入学試験や採用試験等の問題として記事等を複製や公衆送信を行うことができます。営利目的の模擬試験等で利用する場合は、事前に許諾を得る必要はありませんが、事後に利用料の支払が必要です。なお、漢字をひらがなに変えることや、穴埋め問題で一部を空欄にする等必要最小限の改変や翻訳は許諾なくできます。ただし、要約や書き変え等必要以上の改変は認められていません。</p> target="_blank">文化庁「視覚障害者等のための複製・公衆送信が認められる者について」</a>（外部サイト）をご参照下さい。</p> <h5>時事問題に関する論説(社説)の転載　(著作権法第39条)</h5> <p>社説は、他の新聞・雑誌への転載や放送等、報道的な様態において利用することができます。以下のような場合等は、前述の利用にあたらず、利用する場合は許諾が必要です。</p> <ul> <li>・利用禁止の明示がある場合<br /> ・有償、無償に関わらず、収集してアプリや電子書籍等を作成し、配布、公衆送信(送信可能化を含む)等をする場合 </li> </ul> <h5>電子計算機器による情報処理及びその結果の提供に付随する軽微利用等（著作権法第47条の５）</h5>
