</span></span><span style="color: #003366;">Een overtreding is zoals een misdrijf een strafbare feit. Overtredingen zijn in het wetboek van strafrecht ingedeeld in categorieën. Een poging tot en de voorbereiding van overtredingen is niet strafbaar. Vaak beslist de kantonrechter of de politierechter over een overtreding. </span></p> <p><strong><span style="color: #003366;">Woonoverlast<br /> </span></strong><span style="color: #003366;">Onderhuur, kamerverhuur, overbewoning, verloedering van lege woningen, drugspanden, hennepteelt, overlast en kraaksituaties zijn vormen van woonoverlast. Woonfraudeurs overtreden de regels van de huurovereenkomst en belemmeren een rechtvaardige woonruimteverdeling. Met als gevolg klachten van burgers, omdat er vaak lange wachttijden voor huurwoningen zijn. </span><span style="color: #003366;">Er is sprake van woonfraude b</span><span style="color: #003366;">ij illegale onderhuur (wonen zonder toestemming van de verhuurder of eigenaar); b</span><span style="color: #003366;">ij illegale kamerverhuur; w</span><span style="color: #003366;">anneer er te veel mensen in de woning wonen, d</span><span style="color: #003366;">e woning wordt alleen gebuikt als bedrijf of winkelruimte; d</span><span style="color: #003366;">e woning wordt door niemand bewoond en is leeg; h</span><span style="color: #003366;">ennepteelt: in de woning is een kwekerij, stekkerij of drogerij gevestigd; p</span><span style="color: #003366;">rostitutie: de bewoner of huurder verricht seksuele bedrijvigheid in de woning; d</span><span style="color: #003366;">rugs: er wordt drugs verhandeld of in grote mate gebruikt door personen; k</span><span style="color: #003366;">raak: de woning is gekraakt, u bent bang voor kraak of er wordt gekraakt; o</span><span style="color: #003366;">verlast: de woonfraude geeft overlast. </span></p> <p><span style="color: #003366;"><strong>Sanctie bij overtredingen<br /> </strong>Bij overtredingen die geconstateerd zijn door inspecties kunt u bezwaar maken en beroep instellen. Een advocaat die in het strafrecht die gespecialiseerd is in overtredingen kan u bijstaan, helpen en adviseren. De advocaat kan fouten in het proces-verbaal opsporen en andere vormfouten ontdekken die u misschien zelf niet zou ontdekken. Indien u voor de rechter moet verschijnen, kan de advocaat u bijstaan in de procedure. </span></p> <p><span style="color: #003366;"><strong>Onrechtmatige hinder<br /> </strong>De wet bepaalt dat de eigenaar van een erf niet op een wijze die onrechtmatig is aan eigenaars van andere erven hinder mag toebrengen “door het verspreiden van rumoer, trillingen, stand, rook of gassen, door het onthouden van licht of lucht of het ontnemen van steun”. Vaak is het overduidelijk dat een hinder of overlast niet door de beugel kan, maar het komt voor dat een geschil ontstaat over een gedraging en de onrechtmatigheid van de hinder alleen via een rechterlijk verbod kan worden beëindigd. Soms kan overlast structureel zijn en gepaard gaan met burenruzie en ziekteverschijnselen. Of er sprake is van onrechtmatige hinder, hangt af van de mate van de hinder, de belangen gediend bij de hinder toebrengende activiteit, de mogelijkheden hinder en schade te voorkomen, de omstandigheid of de klagende partij zich voor of na de aanvang van de hinder veroorzakende activiteiten zich heeft gevestigd en de hoedanigheid van partijen; wordt hinder veroorzaakt door een particulier of bedrijf. Ook als er structureel onterecht geklaagd wordt over hinder, valt dat onder onrechtmatige hinder. </span></p> <p><span style="color: #003366;"><strong>Advocaat of mediator<br /> </strong>De wettelijke regeling in het Burenrecht is niet dwingend: buren kunnen met elkaar van de wet afwijkende afspraken maken, bijvoorbeeld door het vestigen van een erfdienstbaarheid. Indien u er zelf niet uitkomt met de buren en u de onrechtmatige hinder wil laten stoppen, en een lange, ingewikkelde en slepende rechtsproces wil voorkomen, met het risico dat de uitkomsten onbevredigend zijn, dan is mediation een goede oplossing voor beide partijen. Een burenrecht mediator kan u hierin bijstaan. Soms kan een kwestie vanwege de situatie en aard van het conflict en door de houding van partijen niet door een mediator worden opgelost, en is procederen en de rechter vragen om de hinder te laten stoppen onvermijdelijk.
