Chronis<BR>Denver Post Staff Writer</font> <P></font></center><P><DD><B>May 14 -</B> From a dramatic witness to a simple metal key.<BR><DD> The timing with which prosecutors introduced a Ryder truck key found in an alley near the site of the Oklahoma bombing was a "stroke of genius," a Denver defense attorney said Tuesday.<BR><DD> The government alleges that defendant Timothy McVeigh built an ammonium nitrate-fuel oil bomb in the rear of a 1993 Ford F-700 Ryder rental truck and used it to bomb the Alfred P. Murrah Federal Building in Oklahoma City.<BR><DD> The timing of the testimony of FBI photographer Dawn Hester and the introduction of the key was critical: It came after McVeigh's former Army buddy, Michael Fortier, finished a withering cross-examination by lead defense attorney Stephen Jones, who painted Fortier as a drug-abusing, opportunistic liar.<BR><DD> "This is genius - I've never seen a prosecutor like this," David Japha, a longtime Denver attorney who often represents defendants in federal cases.<BR><DD> "The photograph after Fortier hammers home the point - no matter what the jury wants to think of Michael Fortier. It was just a stroke of genius. It was brilliant." Japha has been following the case for the Intermountain Jewish News.<BR><DD> Even before the government put on a witness who testified that the key found in the alley matched the key code for the Ryder truck that carried the bomb, "the jury (thought) this is the Ryder truck key," said Denver lawyer Andrew Cohen, who is watching the case for several news outlets, including The Denver Post.<BR><DD> "It's a nice visual thing, a nice visual image," he said. "It supposedly was found right around where McVeigh had his getaway car. It's a nice piece of the story." <BR><DD> When manufacturers such as Ford Motor Co., which made the Ryder truck, ship vehicles to dealers or bulk purchasers, they also supply a key code that makes it possible to duplicate the key for each vehicle if the original becomes lost.<BR><DD> The testimony was especially important because Jones tried so hard to discredit Fortier's testimony that he and McVeigh drove down an alley near the federal building and McVeigh pointed out a spot where he planned to park his getaway car.<BR><DD> "It's important because the very next witness after Fortier tells about a key being found in an alley. Which alley? The very same alley Fortier talks about. It hammers home that part of Fortier's testimony," Japha said.<BR><DD> While reporters have dubbed Fortier a star witness, Japha said, the government is simply using him to corroborate other evidence - and the key was another important piece of that.
