\r\nambushed and bundled \r\ninto cars, along with the \r\n16-year-old son of one of \r\nthem, apparently by Kenyans. \u003c/p\u003e\u003cp\u003eThe \r\nboy – and a man who turned out to \r\nhave British nationality – were released some hours later.\u003c/p\u003e\u003cp\u003eThe Ministry of Foreign Affairs announced \r\nthat four had been ‘repatriated’ on \r\nthe basis of ‘bilateral instruments’ \r\nbetween the two countries.\r\n\u003c/p\u003e\u003cp\u003eAnd the PS Foreign Affairs told us \r\non Citizen TV that this was a unique, \r\nisolated case because Kenya had had \r\nan actual request from the Turkish \r\nGovernment and thus had information that was so weighty that the only \r\nchoice was to send them to Turkey. \u003c/p\u003e\u003cp\u003eIt \r\nwas also an obligation because of our \r\nduty of non-interference in another \r\ncountry’s internal affairs, Korir said.\r\n\u003c/p\u003e\u003cp\u003e\u003cb\u003eNON-INTERFERENCE IN INTERNAL \r\nAFFAIRS\r\n\u003c/b\u003e\u003c/p\u003e\u003cp\u003eOne country should not interfere \r\nin another’s elections, should not \r\ninvade it, and so on – generally, this \r\ngoes without saying. \u003c/p\u003e\u003cp\u003eBeyond that \r\n‘non-interference’ is an argument \r\nmade by countries with little regard \r\nfor their citizens – often complaining about human rights treaties and \r\norganisations. \u003c/p\u003e\u003cp\u003e\r\nBut it is clear in international law \r\nthat states cannot escape responsibility by claiming that their actions \r\nthat breach human rights law are \r\nsolely within their domestic jurisdiction.\r\n\u003c/p\u003e\u003cp\u003eOur current topic was not an internal matter. These men had relied \r\non international refugee law for \r\nprotection from their government. \u003c/p\u003e\u003cp\u003e\r\nYou might even say that Turkey, by \r\nnot using normal legal channels, \r\nwas interfering in Kenya’s internal \r\naffairs by asking her to act against \r\nthe Kenyan Constitution.\r\n\u003c/p\u003e\u003cp\u003e\u003cb\u003eTHE ABDUCTION\r\n\u003c/b\u003e\u003c/p\u003e\u003cp\u003eHow about the way the Turks were \r\nseized? We have seen various videos \r\nof people being seized and bundled \r\ninto cars to be kept perhaps overnight – perhaps never to emerge. \u003c/p\u003e\u003cp\u003e It \r\nalmost seems that our security forces \r\nhave seen too many cops and robbers \r\nfilms with dramatic car chases and \r\nseizure of alleged criminals in ways \r\nthat totally violate our Constitution.\r\n\u003c/p\u003e\u003cp\u003e\u003cb\u003eSOME BACKGROUND\r\n\u003c/b\u003e\u003c/p\u003e\u003cp\u003eTurkey’s problem with these men \r\nis, apparently, that they are supporters of Fethullah Gulen. \u003c/p\u003e\u003cp\u003eHe was (he \r\ndied last month) a cleric and critic of \r\nPresident Erdogan, and he had been \r\nliving in the US. \r\nHe emphatically denied Erdogan’s \r\naccusation of being behind a coup \r\nattempt in 2016. \u003c/p\u003e\u003cp\u003e He headed a network of education establishments, \r\nincluding in Kenya. \r\nIn 2016, Kenya refused Turkey’s \r\nrequest to close down the schools \r\nin this country.\r\nTurkey used to request INTERPOL \r\nto help it get Gulen’s supporters arrested but INTERPOL decided this\u0026nbsp;was political so it denied certain \r\nassistance. \u003c/p\u003e\u003cp\u003e Turkey seems to have \r\ndecided to take matters into its own \r\nhands.\r\nThere have been a few attempts \r\nto get extradition of alleged Gulen \r\nsupporters in Kenya.\u003c/p\u003e\u003cp\u003eIn 2021, extradition proceedings were started \r\nagainst Gulen’s nephew, Selahaddin, who was in Kenya with his wife. \u003c/p\u003e\u003cp\u003e\r\nThe nephew got court permission to \r\nbring a judicial review case to quash \r\nthe DPPs decision to start that extradition process. \r\nOn May 6, the High Court temporarily stopped the extradition \r\nprocess until the judicial review \r\ncase was decided. \u003c/p\u003e\u003cp\u003eAbout that time \r\nTurkish agents apparently abducted \r\nSelahaddin Gulen – his wife had not \r\nseen him since May 3.\r\nThe US long refused to extradite \r\nFethullah Gulen. \u003c/p\u003e\u003cp\u003eApparently, Turkey \r\nhas made 800 extradition requests \r\nto various countries. More than 100 \r\nalleged Gulen supporters have been \r\nsent back, although clearly not all \r\nthrough extradition.\r\n\u003c/p\u003e\u003cp\u003eLast year, the Parliamentary Assembly of the Council of Europe \r\nsaid, “The Turkish campaign [against \r\nGulenists] has been found to rely on \r\nrenditions, abuse of extradition proceedings, Interpol Red Notices and \r\nanti-terror financing measures, and \r\nco-opting other States to deport or \r\ntransfer persons unlawfully.\u003c/p\u003e\u003cp\u003e\u003cb\u003eTHE VICTIMS\r\n\u003c/b\u003e\u003c/p\u003e\u003cp\u003eThese gentlemen were in Kenya legally. They were refugees – in the \r\nlegal sense. \u003c/p\u003e\u003cp\u003eThey had been granted \r\nthat status by the UN on the basis \r\nof their “well-founded fear of being \r\npersecuted for reasons of race, reli-\r\ngion, nationality, membership of a \r\nparticular social group or political \r\nopinion” in their own country. \u003c/p\u003e\u003cp\u003e This \r\nlanguage is used in the Kenyan Refugee Act which also says that no one \r\nshould be refused entry into Kenya, \r\nexpelled, extradited from Kenya,\u0026nbsp; \u0026nbsp;or returned to any other country \r\nif “as a result they may be subject \r\nto persecution on account of race, \r\nreligion, nationality, membership \r\nof a particular social group or political opinion”. \u003c/p\u003e\u003cp\u003eThis is the principle \r\nknown as “non-refoulement” – not \r\nsending back a refugee to the place \r\nfrom which they have fled because \r\nof persecution.\r\n\u003c/p\u003e\u003cp\u003eThe only legal basis for removing \r\nthem from this country would be \r\nextradition. \u003c/p\u003e\u003cp\u003eThis is the sending of a \r\nperson in Kenya to another country \r\nwhere they have been charged with \r\na crime (or even convicted but run \r\naway). \u003c/p\u003e\u003cp\u003eThis is regulated by (in this \r\ncase) the Extradition (Contiguous \r\nand Foreign Countries) Act.\r\n\u003c/p\u003e\u003cp\u003e\u003cb\u003eTHE RIGHT PROCEDURE\r\n\u003c/b\u003e\u003c/p\u003e\u003cp\u003eTo avoid the obvious risks in simply believing a country that wants a\u0026nbsp;person delivered to them for prosecution, a process through the courts \r\nis required by the Act. \u003c/p\u003e\u003cp\u003eFor various \r\nreasons, there seems to have been \r\nno basis for extradition in this case.\r\nExtradition only works if Ken-\r\nya has an Extradition Agreement \r\nwith the country asking for extradition (this might be a broader, \r\nmany-country treaty, for instance, \r\nabout dealing with certain types of \r\noffences, like drugs). \u003c/p\u003e\u003cp\u003eThen a Gazette \r\nnotice would apply the Act to that \r\ncountry. Kenya does not seem to have \r\nany relevant extradition agreement \r\nwith Turkey.\r\n\u003c/p\u003e\u003cp\u003eExtradition can be carried out \r\nonly if the crime involved comes \r\nwithin a list in the Act. They are all \r\nserious offences, like murder, major physical injury, drugs, robbery, \r\ntreason, money laundering. \u003c/p\u003e\u003cp\u003eTrue, \r\nwhen these men arrived in Turkey \r\nthey were charged with treason. But \r\nthere is no indication that there had \r\nbeen any actual charges while they \r\nwere in Kenya.\r\n\u003c/p\u003e\u003cp\u003eIn fact, PS Korir said on television \r\nthey had been told the men had \r\ncommitted “subversion” in Turkey. \u003c/p\u003e\u003cp\u003e\r\nSubversion is not mentioned as an \r\nextradition offence. And, what is \r\nmore, even in Kenya it does not exist \r\nas an offence any more, having been \r\ndeclared unconstitutional by a court.\r\n\u003c/p\u003e\u003cp\u003eThe formal process begins with \r\na diplomatic representative of the \r\nrequesting country applying for extradition of the person they want, \r\nusually sending the relevant arrest \r\nwarrant.\r\n\u003c/p\u003e\u003cp\u003eThe issue then goes to a Kenyan \r\nmagistrate’s court. This did not, obviously, happen.\r\n\u003c/p\u003e\u003cp\u003eThe Act says that a person must \r\nnot be extradited if the offence is \r\npolitical or the court considers that \r\nthe request has been made to punish him “for an offence of a political \r\ncharacter”.\r\n\u003c/p\u003e\u003cp\u003eExtradition will not be confirmed \r\nif there is reason to suppose the individual will not get a fair trial. And \r\n“refoulement” by extradition is also \r\nstill prohibited.\r\n\u003c/p\u003e\u003cp\u003e\u003cb\u003eA WORRYING MINDSET\r\n\u003c/b\u003e\u003c/p\u003e\u003cp\u003eWhat we see in this saga, on the \r\npart of the police and government, \r\nseems to be an impatience with legal procedures. \u003c/p\u003e\u003cp\u003eThe police would \r\nrather bully, even kill, rather than \r\ngo through court.\r\nAnd in this case, the suspicion \r\nmust be that the government assumed that the courts would not \r\napprove extradition – the necessary preconditions were not there \r\nand some factors, like the political \r\naspect, would work against extradition. \u003c/p\u003e\u003cp\u003eSo they just planned to keep \r\nthe case out of the courts.\r\n(It reminds me a bit of the careful planning for a seamless process \r\nin the final stages of the (former) \r\nDeputy President’s impeachment \r\n– leaving no gaps in which the DP \r\ncould go to court.)\r\n\u003c/p\u003e\u003cp\u003eWorse, the attitude seems to be \r\nnot caring about legal procedures.\r\n\u003c/p\u003e\u003cp\u003eAs I began to write this, I read a \r\npiece about President-elect Trump \r\nand his appointees, including, “Welcome to the second coming of Donald Trump. ... he trashes the conventions of how things should be done. \r\nYou play by his rules.
