София 1000, пл. “Славейков”, № 6, ет. 1. Агенцията притежава БУЛСТАТ 0006963272031 и се представлява от Г-Н Владимир Данаилов – Главен изпълнителен директор. <br/> Настоящото споразумение се прилага към информационните услуги и системи, достъпни през Сайта, чрез негови съкратени мобилни версии, както и всяко друго приложение и услуга. <br/> С факта на зареждане на Сайта от крайно устройство Потребителят изразява съгласието си да се запознае с настоящите Общи условия и всички неразделни части на споразумението и да ги спазва. <br/> Споразумението между Потребителя и Агенцията се сключва на български език и поражда действие от момента на постигане на съгласие, обективирано по начина, посочен по-горе. <br/> С приемането на настоящите Общи условия Потребителят се съгласява комуникацията с него да бъде осъществявана и чрез електронна поща, като Потребителят се съгласява да бъде адресат и да получава електронни изявления от Сайта и неговия администратор. <br/> Страните се съгласяват, че изпращаните помежду им съобщения чрез електрона поща съставляват електронни изявления и че придружаващата ги информация съставлява идентифициране на Сайта, респективно Потребителя, като автор и титуляр на тези електронни изявления и е електронен подпис, на който страните признават стойността на саморъчен подпис в техните отношения. <br/> Настоящото споразумение има действие до преустановяване от Потребителя на ползването на Услугите, достъпни през Сайта. <br/> Сайтът, неговите услуги и съдържание не са насочени директно към непълнолетни лица.  <br/><hr style="background-color:white"> <ol> <li><strong>I. ПОНЯТИЯ</strong></li> </ol><hr style="background-color:white"> <strong> </strong> При прилагане и тълкуване на настоящите Общи условия за ползване, използваните термини ще имат следното значение: <ol> <li>“Администратор на лични данни“ означава лице, което само или съвместно с други определя целите и средствата за обработването на лични данни.</li> <li>„IP Адрес” (“IP address”) е уникален идентификационен номер, асоцииращ устройство, Интернет страница или ресурс на Потребителя, по начин, който позволява локализирането им в глобалната Интернет мрежа.</li> <li>“Бисквитки (cookies)” са малки текстови файлове, които се запазват от Интернет страница чрез Интернет сървър върху твърдия диск на Крайния потребител и дават възможност за възстановяване на информация за него, като идентифицират използваното крайно устройство и/или браузър.</li> <li>„Електронна препратка” е връзка, обозначена в определена Интернет страница, която позволява автоматизирано препращане към друга Интернет страница, информационен ресурс или обект чрез стандартизирани протоколи.</li> <li>„Злоумишлени действия” са действия или бездействия, нарушаващи Интернет етиката или нанасящи вреди на лица, свързани към Интернет или асоциирани мрежи, изпращане на нежелана поща (SPAM, JUNK MAIL), препълване на каналите (FLOOD), получаване на достъп до ресурси с чужди права и пароли, използване на недостатъци в системите с цел собствена облага или добиване на информация (HACK), извършване на действия, които могат да бъдат квалифицирани като промишлен шпионаж или саботаж, повреждане или разрушаване на системи или информационни масиви (CRACK), изпращане на „троянски коне“ или предизвикване инсталация на вируси или системи за отдалечен контрол, смущаване нормалната работа на останалите потребители на Интернет и асоциираните мрежи, извършване на каквито и да е било действия, които могат да се квалифицират като престъпление или административно нарушение по българското законодателство или по друго приложимо право.</li> <li>„Интернет страница” е част от уебсайт, която може да е съставна или обособена.</li> <li>„Информационна система” или “Система” е устройство или система от свързани устройства, което или някое, от които е предназначено да съхранява, изпраща или получава електронни документи.</li> <li>„Лични данни“ означава всяка информация, свързана с идентифицирано физическо лице или физическо лице, което може да бъде идентифицирано („субект на данни“).</li> <li>„Непоискани търговски съобщения“ са търговски съобщения, изпратени без предварително искане от страна на получателя.</li> <li>„Обработване“ означава всяка операция или съвкупност от операции, извършвана с лични данни или набор от лични данни чрез автоматични или други средства като събиране, записване, организиране, структуриране, съхранение, адаптиране или промяна, извличане, консултиране, употреба, разкриване чрез предаване, разпространяване или друг начин, по който данните стават достъпни, подреждане или комбиниране, ограничаване, изтриване или унищожаване.</li> <li>“Потребител” или “Краен потребител” е всяко физическо лице, което ползва предоставяните през Сайта информационни услуги и ресурси и което действа извън рамките на своята търговска дейност, занаят или професия.</li> <li>„Случайно събитие” е непредвидено към момента на сключването на договора обстоятелство от извънреден характер, което прави предоставянето на услугите обективно невъзможно.</li> <li>„Съгласие на субекта на данните“ означава всяко свободно изразено, конкретно, информирано и недвусмислено указание за волята на субекта на данните, посредством изявление или ясно потвърждаващо действие, което изразява съгласието му свързаните с него лични данни да бъдат обработени.</li> <li>„Сървър” е устройство или система от свързани устройства, на което или на някое от които е инсталиран системен софтуер за изпълняване на задачи във връзка със съхраняване, обработка, приемане или предаване на предоставят различни информационни услуги и ресурси, предмет на настоящите Общи условия за ползване.</li> <li>„Услуги” са услугите, предоставяни посредством Сайта.</li> <li>“Физическо лице, което може да бъде идентифицирано” е лице, което може да бъде идентифицирано, пряко или непряко, по-специално чрез идентификатор като име, идентификационен номер, данни за местонахождение, онлайн идентификатор или по един или повече признаци, специфични за физическата, физиологичната, генетичната, психическата, умствената, икономическата, културната или социална идентичност на това физическо лице.</li> ФУНКЦИОНАЛНА ХАРАКТЕРИСТИКА НА САЙТА</strong><hr style="background-color:white"> <ol> <li>1.Териториален и персонален обхват на дейността</li> </ol> Сайтът и Услугите, предлагани чрез него не са ограничени в конкретни териториални граници и са насочени към потребители от Европейския съюз и от трети страни без наличие на какъвто и да било дискриминационен признак.  <hr style="background-color:white"> <ol start="2"> <li>2.Цел на Сайта</li> </ol> Целта на Сайта се изразява в две главни направления:<br/> Първо - информиране на посетителите на сайта за дейността на Агенцията.<br/> Второ - информиране на посетителите на сайта за детайлите за контакт със СОАПИ, в случай че се нуждаят от допълнителна информация, имат запитвания, коментари или препоръки, както и да получат информация за своите права и начина на упражняването им.  <br/><hr style="background-color:white"> <ol start="3"> <li>3. Права и задължения на потребителя</li> </ol> Потребителят има право на достъп в реално време (online) до Услугите, предоставяни чрез Сайта при спазване на изискванията за достъп, определени от Агенцията. <br/> Потребителят има право на достъп до публикувано на сайта съдържание единствено за лично ползване. <br/> Правото на достъп, предоставено на Потребителя, не включва правото да копира или възпроизвежда информация, или да използва защитени обекти на интелектуална или индустриална собственост, освен на незначително количество информация, предназначено само за лично ползване, при условие че такова ползване не уврежда законните интереси на авторите или други носители на права на интелектуална или индустриална собственост, и копирането или възпроизвеждането е извършено с нетърговска цел. <br/> Потребителят се задължава при използване на предоставяните Услуги: <ul> <li>да не извършва злоумишлени действия по смисъла на тези Условия за ползване;</li> <li>да не извлича с технически средства или по технически начин никакви информационни ресурси или части от тях, включени в базите данни, достъпни чрез Сайта и по този начин да създава своя собствена база данни в електронна или каквато и да било друга форма.</li> <li>да не се представя за друго лице или за представител на лице, което не е упълномощен да представлява или по друг начин да заблуждава Сайта или трети лица за самоличността си или принадлежността си към определена група хора;</li> <li>да уведомява незабавно Агенцията за всеки случай на извършено или открито нарушение при използване на предоставяните Услуги;</li> <li>да не извършва дейност, която включва ползването на вируси, ботове, червеи или друг вид компютърен код, файлове или програми, които прекъсват, унищожават или ограничават функционалността на компютърен софтуер или хардуер или телекомуникационно устройство, или по друг начин позволяват неразрешено ползване на или достъп до компютърно устройство или компютърна мрежа.</li> </ul>  <br/><hr style="background-color:white"> <ol start="4"> <li>4. Връзки към социални мрежи и други уебсайтове</li> </ol> Чрез Сайта Агенцията предоставя възможност на своите посетители и потребители да посетят страницата на СОАПИ във Facebook. Последното се явява Трета страна и е вероятно при посещаването на сайта www.facebook.com да бъдат инсталирани “бисквитки” (или други подобни технологии) върху потребителското устройство ако потребителят ползва услугите на тази трета страна. Агенцията няма контрол над тази дейност, тъй като взаимоотношенията между потребителите на сайта с тези трети страни се урежда съгласно правилата за ползване на последните и техните политики за лични данни. <br/> За повече информация за ползваните от нас “бисквитки” вижте раздел “Политика за използване на бисквитки”.  <br/><hr style="background-color:white"> <ol start="5"> <li>5. Ограничаване на отговорността на Агенцията</li> </ol> СОАПИ предоставя Услугите чрез Сайта за ползване от Потребителя “както са” и “както са достъпни”. <br/> СОАПИ не гарантира или обещава конкретни резултати от ползването или от продължителна възможност за ползване на Услугите. <br/> СОАПИ не предоставя гаранции за това, че: <ol> <li>ползването на Услугите от потребителя ще бъде непрекъснато, навременно, подсигурено и сигурно или безгрешно;</li> <li>евентуални дефекти в Услугите ще бъдат поправени;</li> <li>предоставяните Услуги или услугите, върху които последните са изградени, ще бъдат свободни от вируси или други вредни компоненти;</li> </ol> При никакви обстоятелства СОАПИ няма да бъде отговорна за каквато и да било загуба или повреда произлизащи от: <ol> <li>ползването на Услугите;</li> <li>проблеми или техническо нефункциониране във връзка с ползването на Услугите;</li> <li>материали, свалени чрез или във връзка с Услугите;</li> <li>потребителско съдържание;</li> <li>поведение на Потребители във връзка с Услугите, независимо дали в реално време (on line) или не (off line).</li> </ol> СОАПИ не носи отговорност, ако потребителят не може да осъществи достъп до сайта, поради проблеми извън контрола на Сайта - софтуерен, хардуерен, проблем с връзката с Интернет или форс мажор.<br/> Потребителят приема да носи отговорността за всички разходи по поддръжката, изправността или връзката на своята компютърна система или друго имущество, необходими за ползването на Услугите от Потребителя.<br/> СОАПИ си запазва правото за системна намеса в цялата функционалност на Сайта, включително, но не изчерпателно, за преустановяване на достъпа до него, при наличието на основателна причина за това.  <br/> <ol start="6"><hr style="background-color:white"> <li>6. Неустойки</li> </ol> До пълния обем, допустим от приложимото право, Агенцията няма да бъде отговорна за вреди, претърпени от Потребител, които са непреки, последващи, инцидентни, наказателни, включително за вреди за пропуснати ползи, произлизащи от ползването или от невъзможност за ползването на Услугите. СПОРОВЕ, КОМПЕТЕНТЕН СЪД И ПРИЛОЖИМО ПРАВО</strong><br/><hr style="background-color:white"> Като основен принцип по изпълнението на това споразумение, страните възприемат взаимното разбиране и търпимите отстъпки. В този смисъл, страните се споразумяват да решават спорните въпроси, възникнали помежду им, в дух на добра воля и по пътя на преговорите. Всеки спор, разногласие или иск, произтичащ от или свързан с изпълнението, съответно – неизпълнението на това споразумение, следва да се решава от страните чрез договаряне и с добрата воля на всяка една от тях. При невъзможност за решаване на спорове, възникнали във връзка и по повод този договор, неговото изпълнение, съответно неизпълнение, страните се договарят да решават същите пред компетентния за това български съд, определен съобразно правилата на родовата подсъдност, съгласно действащото право на Република България, което е приложимо към настоящото споразумение.
