In addition, the district attorney’s office has said it will not oppose the release of witness testimony, Hardin said. As a result, Hardin said he won’t have to file a motion for those records.</p> <p>“We believe Mr. Cobbs’ counsel should be allowed to examine the testimony of the witnesses prior to their taking the stand at trial,” said Rob Drummond, an assistant district attorney.</p> <p>There has been no discussion of Cobbs reaching a plea agreement, Hardin said.</p> <p>“I’ve always made it clear it would have to be a trial or a dismissal” of the charges,” he said.</p> <p>Judge Brown set Sept. 4 as the next hearing for Cobbs, the former chief commercialization officer at the Cancer Prevention and Research Institute of Texas.</p> <p><span id="more-14076"></span></p> <p>Hardin said he and prosecutors discussed with Judge Brown a trial date possibly in early December.</p> <p>In an interview after the hearing, Hardin said the timing is based on his court schedule, not any desire to hold a trial after the Nov. 4 election.</p> <p>“It doesn’t matter from my side of the table. It’s just I’ve got stuff in October and November. That is why we are talking about December,” he said.</p> <p>Cobbs was indicted in December, 2013 in connection with an improperly awarded $11 million grant to Peloton Therapeutics, a Dallas-based technology firm. He is accused of deceiving two CPRIT officials by failing to disclose that the 2010 grant to Peloton did not undergo a required business or scientific review.</p> <p>State law prohibits a person from fraudulently causing another to sign a document affecting a financial interest. The charge is a first-degree felony that carries a prison term from five to 99 years.</p> <p><a href="https://web.archive.org/web/20140910063810/http://www.dallasnews.com/news/state/headlines/20131210-democrats-take-aim-at-abbott-over-indictment-of-cancer-fund-official.ece">Cobbs’ indictment made CPRIT a major issue in the governor’s race.</a></p> <p>Democrat Wendy Davis, a Fort Worth Democrat, has accused her Republican opponent, Attorney General Greg Abbott, of betraying Texas taxpayers by failing to show up to meetings of CPRIT’s oversight committee. At the time, the attorney general and comptroller of public accounts under state law had seats on the panel. Last year, that legislature repealed that provision as part of an agency reform package that Gov. Rick Perry signed into law.</p> <p>Abbott said he picked a high-ranking assistant to take his place and that decision “allowed me to retain the independence to take action to respond to any broader challenges posed by CPRIT.”</p> <p>Abbott’s office announced in December, 2012 that it would conduct a civil investigation of CPRIT.
