The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.</li> <li> With data aggregators.</li> <p>All the above categories exclude text messaging originator opt-in data and consent; this information is not, and will not be, disclosed to any third parties.</p> </ul> <p><center></p> <p><strong><u>Your Rights and Choices</u></strong></p> <p></center><br /> The CCPA and CPRA provide consumers (California residents) with specific rights regarding their Personal Information. This section describes your these rights and explains how to exercise those rights.</p> <p><i><strong>Access to Specific Information and Data Portability Rights</strong></i></p> <p>You have the right to request that we disclose the categories and specific pieces of information we have collected and certain information to you about our collection and use of your Personal Information . We will provide all the Personal Information that we have collected and maintain about you since January 1, 2022, including beyond the 12-month period preceding our receipt of the request, unless doing so proves impossible or would involve disproportionate effort. Once we receive and verify your consumer request (see Exercising Access, Correction, Data Portability, and Deletion Rights), we will disclose to you, as applicable:</p> <ul> <li> The categories of Personal Information we collected about you.</li> <li> The categories of sources for the Personal Information we collected about you.</li> <li> Our business or commercial purpose for collecting, that Personal Information.</li> <li> The categories of third parties with whom we disclose that Personal Information.</li> <li> The specific pieces of Personal Information we collected about you (also called a data portability request).</li> <li> If we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing:</li> <li> the Personal Information categories that we sold and for each category identified, the categories of third parties to whom we sold that particular category of Personal Information; and</li> <li> the Personal Information categories that we disclosed for a business purpose and for each category identified, the categories of third parties to whom we disclosed that particular category of Personal Information.</li> </ul> <p><i><strong>Correct Specific Information</strong></i></p> <p>You have the right to request that we correct inaccurate Personal Information about you. Once we receive and verify your request (see Exercising Access, Correction, Data Portability, and Deletion Rights), we will use commercially reasonable efforts to correct the information to comply with your request.</p> <p><i><strong>Deletion Request Rights</strong></i></p> <p>You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and verify your consumer request (see Exercising Access, Correction, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies. In responding to your request, we will inform you whether or not we have complied with the request, and, if we have not complied, provide you with an explanation as to why.<br /> Note that a service provider is not required to comply with a deletion request submitted by the consumer directly to the service provider.<br /> We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:<br /> 1. Complete the transaction for which we collected the Personal Information, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service that you requested, take actions reasonably anticipated by you within the context of our ongoing business relationship with you, or otherwise perform our contract with you.<br /> 2. Help to ensure security and integrity to the extent the use of your Personal Information is reasonably necessary and proportionate for those purposes.<br /> 3. Debug products to identify and repair errors that impair existing intended functionality.<br /> 4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.<br /> 5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).<br /> 6. Engage in public or peer-reviewed scientific, historical, or statistical research that conforms or adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the ability to complete such research, if you previously provided informed consent.<br /> 7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us and compatible with the context in which you provided the information.<br /> 8. Comply with a legal obligation.</p> <p><strong>Personal Data Sharing Opt-Out and Opt-In Rights. </strong><br /> Pursuant to CCPA and CPRA, you have the right to direct us to not share your Personal Information at any time (the “right to opt-out”). As used herein, “share” refers to sharing for purposes of cross-context behavioral advertising, as contemplated under the CCPA and CPRA.<br /> We do not have actual knowledge that we share the Personal Information of consumers under 16 years of age. We do not, and will not, sell or share the Personal Information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. We will use this information to verify this is a permitted request, such as by matching your name and address with information in our records. Depending on the type of request, we may require a certain number of data points to allow for verification.<br /> Only you, or a person legally authorized by you to act on your behalf, may make a consumer request related to your Personal Information. You may also make a consumer request on behalf of your minor child.<br /> An authorized agent may make a request on your behalf using the request methods designated above. Additionally, if you use an authorized agent to submit a consumer request, we may require the authorized agent to provide proof that you gave the agent signed permission to submit the request. We may also require you to verify your own identity directly with us or directly confirm with us that you provided the authorized agent permission to submit the request.<br /> You may only make a consumer request for access or data portability twice within a 12-month period. The consumer request must:</p> <ul> <li> Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized agent of such person.</li> <li> Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.</li> </ul> <p>We may deny a request to correct if we denied the same request within the past six months. If you provide new or additional documentation, we will treat this as a new request.<br /> We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.<br /> Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to Personal Information associated with that specific account.<br /> We will only use Personal Information provided in a consumer request to verify the requestor’s identity or authority to make the request.</p> <p><strong><i>Response Timing and Format</i></strong></p> <p>We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 45 additional days), we will inform you of the reason and extension period in writing.<br /> If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.<br /> The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.<br /> We do not charge a fee to process or respond to your consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.</p> <p><i><strong>No Personal Information Sales</strong></i></p> <p>We do not sell any Personal Information, including any Personal Information of consumers under 16 years of age, that we collect or use.</p> <p><center></p> <p><strong>Non-Discrimination</strong></p> <p></center><br /> We will not discriminate against you for exercising any of your CCPA and CPRA rights. Unless permitted by the CCPA and/or CPRA, we will not:</p> <ul> <li> Deny you goods or services.</li> <li> Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.</li> <li> Provide you a different level or quality of goods or services.</li> <li> Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.</li> </ul> <p>However, we may offer you certain financial incentives permitted by the CCPA, as amended by the CPRA, that can result in different prices, rates, or quality levels.
