<br/>　　第一章总则<br/>　　第一条为贯彻落实党的二十届三中全会关于“深化开发区管理制度改革”精神以及党中央、国务院关于深化开发区管理制度改革和高质量发展决策部署，按照自治区党委十三届九次全会关于推进开发区改革工作要求，进一步规范开发区设立、扩区、调位和退出，实行开发区动态管理，促进开发区高质量发展，结合我区实际，制定本办法。<br/>　　第二条本办法所指开发区为全区范围内经自治区人民政府批准设立,以发展制造业和生产性服务业为主的产业园区，包括经济技术开发区、高新技术产业开发区、工业园区等各类开发区。宁夏贺兰山东麓葡萄酒产业园区根据自身特点参照本办法执行。<br/>　　第三条开发区建设坚持创新、协调、绿色、开放、共享的发展理念，遵循“区域布局合理、主导产业突出、特色错位发展、设施配套完善、用地节约集约、绿色低碳安全”的发展原则，打造工业高质量发展载体、高水平对外开放和高新技术聚集平台，努力建设成为实体经济高质量发展示范区和引领区。<br/>　　第四条县级以上人民政府对所辖开发区建设发展负有主体责任，应当加强组织领导，将开发区发展建设纳入国民经济和社会发展规划，制定促进发展的政策措施，落实目标责任制和奖惩制度，推动开发区高质量发展。<br/>　　第五条自治区工业和信息化厅牵头负责全区开发区设立、扩区、调位及退出等工作。国家级经济技术开发区、高新技术产业开发区、综合保税区按照国家有关规定归口管理。自治区有关部门按职责做好配合工作。<br/>　　第二章开发区的设立<br/>　　第六条设立条件：<br/>　　（一）符合促进区域协调发展战略布局要求，具备明显区位、交通优势，对当地经济发展能够发挥窗口、示范、辐射和带动作用；<br/>　　（二）符合国家产业政策，符合自治区、市、县（区）国土空间规划、生态环境分区管控、文物保护区划和有关行业规划；<br/>　　（三）符合国家及自治区生态环境保护、文物保护、水资源管理、节能减排、安全生产等有关规定，近3年未发生重大及以上突发环境事件、生产安全事故及重大土地违法案件；<br/>　　（四）开发区应位于城镇开发边界内，具有明确的四至范围、规划面积和土地利用方案；<br/>　　（五）开发区应具备较高产业集中度，有明确的产业发展规划，主导产业原则上不超过3个，区域内道路、通讯、水电气供应等公共基础设施较为完善；<br/>　　（六）国家和自治区规定的其他条件。<br/>　　第七条新设立的自治区级开发区名称一般为行政区划名称+开发区类型。根据实际情况，经自治区工业和信息化厅会同有关部门审核并报请自治区人民政府研究同意后，可以使用其他名称。<br/>　　第八条审批程序：<br/>　　（一）所在地级市人民政府组织发展改革、工业和信息化、科技、民政、自然资源、生态环境、住房城乡建设、水利、应急管理、文物、地震等有关部门进行研究论证，提出书面论证意见，编制开发区设立可行性研究报告；<br/>　　（二）所在地级市人民政府向自治区人民政府提出设立申请。由自治区工业和信息化厅会同有关部门提出审核意见，报自治区人民政府批准，并按规定备案。<br/>　　第九条所需材料：<br/>　　（一）设立开发区的请示，包括所在地的经济发展情况、土地及村镇人口等现状、交通区位、设立开发区对区域经济发展的重要性和必要性等；<br/>　　（二）地级市人民政府批复的开发区发展规划和风险预测评估报告；<br/>　　（三）自治区生态环境厅认可的开发区规划环评、污水集中处理、环境应急设施建设及自动在线监控装置联网等环保工作情况；<br/>　　（四）自治区自然资源厅审查通过的开发区涉及的国土空间控制线规划图、界址点坐标、土地利用现状地类及权属情况、土地集约利用评价成果报告、依法依规用地情况，以及开发区用地符合所在市、县（区）国土空间规划说明等；<br/>　　（五）自治区水利厅审查通过的开发区规划水资源论证和防洪影响评价；<br/>　　（六）自治区文物局审查通过的开发区涉及文物压覆情况；<br/>　　（七）自治区应急管理厅提供的开发区内企业近3年安全生产事故情况；<br/>　　（八）自治区统计及相关部门认定的近3年新设立开发区拟定的四至范围内，在统的当年规模以上工业企业及其投资项目等经济发展指标数据；<br/>　　（九）自治区人民政府要求提交的其他材料。<br/>　　第十条自治区工业和信息化厅向自治区人民政府报请批准设立自治区级开发区应当提交下列材料：<br/>　　（一）组织考察、评审情况报告；<br/>　　（二）有关部门审核意见；<br/>　　（三）可行性研究报告。<br/>　　第三章开发区的扩区<br/>　　第十一条支持以国家级和省级开发区为主体，整合区位相邻、相近，且符合安全环保等要求的产业园区或其中相对集中连片的区块，实行统一管理。自治区级开发区扩区需具备以下条件：<br/>　　（一）开发区可供土地面积不足自治区核准面积的20%，闲置土地处置率达到80%以上，产业链延伸和配套需要新的发展空间；<br/>　　（二）提出扩区申请前2年开发区经济发展水平综合考核结果合格，达到依法、合理、集约用地标准；<br/>　　（三）开发区扩区规划符合国家产业政策，符合自治区、市、县（区）国土空间规划、生态环境分区管控、文物保护区划、安全生产、水资源管理和有关行业规划；<br/>　　（四）拟扩区域原则上应当与原规划区域集中连片。对于连续3年（含3年）以上未按要求参与开发区土地节约集约利用评价的开发区，不支持其扩区。<br/>　　第十二条自治区级开发区扩区的审批程序参照本办法第八条办理。自治区直接管理的开发区，由管委会向自治区人民政府提出申请。<br/>　　第十三条开发区所在地级市人民政府向自治区人民政府申请自治区级开发区扩区应当提交下列材料：<br/>　　（一）开发区扩区的请示；<br/>　　（二）开发区扩区的可行性研究报告，内容包括：<br/>　　1.开发区基本情况，包括开发区原批准规划面积的开发建设、产业发展、主要经济指标、土地节约集约利用等情况，以及扩区的必要性和可行性；<br/>　　2.拟扩区域总体规划，包括拟扩区选址位置、四至范围、土地及村镇人口等现状、产业发展规划及功能区块布局等内容，重点说明与所在市、县（区）国土空间总体规划、生态环境分区管控、文物保护区划和有关行业规划以及国家产业政策的衔接情况；<br/>　　3.拟扩区域综合利用方案，包括扩区用地规模、用地范围、村庄搬迁安置、文物考古、占补平衡、村镇划归及利益分配安排等内容；<br/>　　4.拟扩区域基础设施建设方案，包括近远期建设规划方案、建设资金筹措计划；<br/>　　5.经济社会效益和社会稳定风险评估报告。<br/>　　（三）开发区所在地级市发展改革、工业和信息化、科技、自然资源、生态环境、住房城乡建设、水利、应急管理、文物等有关部门出具的论证意见；<br/>　　（四）开发区土地节约集约利用评价报告书及验收意见；<br/>　　（五）自治区人民政府要求提交的其他材料。<br/>　　第四章开发区的调位<br/>　　第十四条开发区调位分为部分调位和整体调位，原则上不扩大原批准的开发区面积。涉及调整区域与扩区同时进行的，按照扩区程序执行，但要在可行性研究报告中对调整区域和扩区的可行性、必要性同步进行说明。<br/>　　第十五条开发区原批准规划范围内若因所在地国土空间总体规划调整、地下资源、地质灾害等客观原因无法进行实际开发或者需要搬迁的，应当编制区位调整可行性研究报告，参照本办法第八条程序，报自治区人民政府批准。自治区直接管理的开发区，由管委会向自治区人民政府提出申请。<br/>　　第十六条拟调位的开发区在报批前应重新编制总体规划并进行规划环评和用地审批，未通过环评和用地审批的，不得调位。<br/>　　第十七条开发区原批准规划范围因客观原因无法进行开发，所在市、县（区）范围内又无地可调整的，开发区所在地级市人民政府应当向自治区人民政府申请撤销该开发区。<br/>　　第五章开发区的退出<br/>　　第十八条开发区实行动态管理。从2025年起，依据《宁夏回族自治区开发区高质量发展评价办法》，对综合考核不合格的自治区级开发区，限制新增土地指标，提出警告，限期整改；对整改不力，特别是长期圈占土地、开发程度低的开发区，核减面积或予以撤销退出。<br/>　　第十九条退出国家级开发区管理序列的开发区按自治区级开发区进行管理。<br/>　　第二十条退出自治区级开发区管理序列的开发区，所在市、县（区）3年之内不得重新申报自治区级开发区。<br/>　　第六章附则<br/>　　第二十一条本办法自发布之日起施行。<br/>　　' background: rgb(255, 255, 255); font-family: 仿宋_GB2312;">（四）自治区自然资源厅审查通过的开发区涉及的国土空间控制线规划图、界址点坐标、土地利用现状地类及权属情况、土地集约利用评价成果报告、依法依规用地情况，以及开发区用地符合所在市、县（区）国土空间规划说明等；</span></p><p style="text-align: justify;
