If you are using Exponent on behalf of a university or other legal entity, "you" also refers to such university or legal entity, and you agree to be bound by these Terms even if we have a separate agreement with you. If you do not agree with any of the Terms, you are prohibited from using or accessing Exponent.</p> <p>We reserve the right to revise these Terms at any time. If we do, we will post the modified Terms on this page and indicate the date of the most recent change above. Your continued use of Exponent constitutes acceptance of these Terms and any modifications thereto.</p> <h2>Use of Services</h2> <p>To use Exponent's services, you may need to register for an account. You agree that the information you provide is accurate to the best of your knowledge. You must be at least 18 years of age or emancipated according to your local jurisdiction. You are solely responsible for all activity that occurs under your account.</p> <p>You may create an account via a third-party service (e.g., Google, Facebook). In doing so, you agree to be bound by those third-party terms and conditions, as well as Exponent's Privacy Policy.</p> <p>You agree to use Exponent only for lawful purposes in a manner consistent with these Terms and all applicable laws.</p> <h2>User Content</h2> <p>Content from other users and third parities may be made available to you through Exponent. "Content" means any work or authorship or information, including salaries, company reviews, interview reviews, company photos, logos, employer profile information, comments, opinions, postings, resumes, text, files, images, photos, works of authorship, e-mail, data, or other materials you find on Exponent. Because we do not control such Content, you understand and agree that (1) we are not responsible for, and do not endorse, any such Content; (2) we make no guarantees about the accuracy, currency, suitability, reliability or quality of the information in such Content; and (3) we assume no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful Content made available by users, advertisers, and third parties.</p> <p>You are solely responsible for any content or materials ("User Content") that you submit or authorize for use through Exponent, including audio or video content submitted via the platform. You retain ownership of all User Content you submit to Exponent, including audio or video content, from the moment of creation. This includes any communications, recordings, or other materials you provide. Exponent does not claim ownership over your User Content.</p> <p>By submitting or authorizing any User Content, you grant Exponent a non-exclusive, perpetual, worldwide, fully-paid license (including the right to sublicense) to use, reproduce, store, display, distribute, paywall, or sell derivative works of, adapt and distribute such Content in any and all media (now known or later developed) throughout the world. To the greatest extent permitted by applicable law, you hereby expressly waive any and all of your moral rights applicable to Exponent's exercise of the foregoing license. You agree that this license includes the right for us to provide, promote, and improve Exponent and to make Content submitted to or through Exponent available to other companies, organizations or individuals for the syndication, broadcast, distribution, promotion or publication of such Content on other media and services, subject to our terms and conditions for such Content use. No compensation will be paid with respect to the Content that you post through Exponent. You should only submit Content to Exponent that you are comfortable sharing with others under the terms and conditions of these Terms.</p> <p>You also agree that Exponent may share your User Content, including audio or video content, with third parties for the purposes of delivering feedback or providing services, subject to our privacy and data protection policies. No compensation will be provided for the User Content you submit.</p> <h2>Prohibited Conduct</h2> <p>You agree that you will not:</p> <ul> <li>Impersonate another person, or their email address, or misrepresent your current or former affiliation with an employer.</li> <li>Create user accounts under false or fraudulent pretenses; create or use an account for anyone other than yourself.</li> <li>Post Content that you do not own or have the right to post in accordance with the license set forth in these Terms;</li> <li>Post Content that is defamatory, libelous, or fraudulent; that you know to be false or misleading; or that does not reflect your honest opinion and experience;</li> <li>Act in a manner that is harassing, threatening, abusive, racist or bigoted, is otherwise objectionable (as determined by Exponent);</li> <li>Promote, endorse or further illegal activities;</li> <li>Disclose information in violation of any legally enforceable confidentiality, non-disclosure or other contractual restrictions or rights of any third party, including any current or former employers or potential employers;</li> <li>Violate the privacy, publicity, copyright, patent, trademark, trade secret, or other intellectual property or proprietary rights of any third-party;</li> <li>Post anything pornographic or sexually explicit in nature, or engage in the exploitation of persons in a sexual or violent manner;</li> <li>Imply a Exponent endorsement or partnership of any kind without our express written permission;</li> <li>Send messages in violation of the USA CAN-SPAM Act or any other applicable anti-spam law;</li> <li>Introduce software or automated agents to Exponent, or access Exponent so as to produce multiple accounts, generate automated messages, or to scrape, strip or mine data from Exponent without our express written permission;</li> <li>"Frame" or "mirror" or otherwise incorporate part of Exponent into any website, or "deep-link" to any portion of Exponent without our express written permission.</li> <li>Copy, modify or create derivative works of Exponent or any Content (excluding Your Content) without our express written permission;</li> <li>Copy or use the information, Content (excluding Your Content), or data on Exponent in connection with a competitive service, as determined by Exponent;</li> <li>Sell, resell, rent, lease, loan, trade or otherwise monetize access to Exponent or any Content (excluding Your Content) without our express written permission;</li> <li>Interfere with, disrupt, modify, reverse engineer, or decompile any data or functionality of Exponent;</li> <li>Introduce any viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or similar software to Exponent; or attempt to circumvent any security feature of Exponent;</li> </ul> <p>Exponent may remove content or terminate accounts that violate these Terms or applicable law.</p> <h2>Third-Party Links and Services</h2> <p>Exponent may contain links to third-party websites placed by us as a service to those interested in this information or posted by other users. Your use of all such links to third-party websites is at your own risk. We do not monitor or have any control over and make no claim or representation regarding third-party websites. To the extent such links are provided by us, they are provided only as a convenience, and a link to a third-party website does not imply our endorsement, adoption or sponsorship of, or affiliation with, such third-party website. When you leave Exponent, our terms and policies do not govern your use of third-party websites.</p> <h2>Enforcement by Exponent</h2> <p>Exponent reserves the right to review, edit, or delete any content that violates these Terms or other policies. We may also take appropriate action, including suspending or terminating your account or reporting you to law enforcement if necessary.</p> <h2>Dispute Resolution</h2> <p>All disputes arising out of or relating to these Terms or Exponent shall be resolved through binding arbitration. You agree to waive your right to participate in class actions or jury trials.</p>
