(’Apple’), which facilitates the generation of content codes.</p><p>You can link physical or digital Apple gift cards or codes with your Apple Account (‘Account’) or add funds through the App Store, iTunes Store, Apple TV App, Apple Books or Apple Music to the balance associated with your Account to establish an ‘Associated Balance’. The amount available in your Associated Balance includes all gift cards and codes linked to your Account and the total balance of all funds added to your Associated Balance. Physical and digital Apple gift cards and codes (including the Apple Gift Card) and Associated Balances are, collectively, ‘Gift Cards’.</p><p>You can use your Gift Cards to purchase content, apps and services (collectively, ‘Content’) from Apple Media Services and items (‘Products’) from Apple Retail stores, the Apple online store and the Apple Store app. </p><p>If you are the holder of an App Store and iTunes gift card or code balance or have a balance in your Associated Balance, you can now use the gift card and code balance and the Associated Balance to purchase Products as well as Content.</p><p><b>3. Restrictions on Use of Gift Cards</b><p>You can use all forms of Gift Cards on the Apple online store or the Apple Store app or by calling 0800 048 0408 to purchase Content. However, <b>only physical and digital Apple gift cards and codes can be used towards purchases in Apple Retail stores</b> (i.e. you will not be able to use your Associated Balance in Apple Retail Stores). Some items may not be available for purchase.</p><p>Once you link a physical or digital Apple gift card or code to your Account, the balance becomes associated with your Associated Balance, and you will no longer be able to use the physical or digital Apple gift card or code.</p><p>Gift Cards purchased in the United Kingdom and content codes can only be linked to an Account in the United Kingdom and can only be used for purchases in the United Kingdom. However, <b>Products purchased on the Apple online store may have restrictions on where they deliver. Please review Apple online store delivery terms for any restrictions.</b></p><p>Some Gift Cards may indicate that they can only be used to purchase Products, e.g. the Apple Store Gift Card. If you purchased or use a Gift Card that indicates it is only for Products, you cannot use that Gift Card to purchase Content.</p><p><b>4. Additional Restrictions </b></p><p>Gift Cards are not redeemable for cash and cannot be returned for a cash refund (except as required by law), exchanged, resold or used to purchase Gift Cards. Unused Associated Balances are not transferable. Issuer maintains information about the status of gift cards or codes. To check the available balance on a gift card or code, call 0800 048 0408 or visit www.apple.com/go/gcb/uk.</p><p>You agree to not use Gift Cards or content codes in any manner that is unlawful, misleading, deceptive, unfair or otherwise harmful to Issuer, Apple or its customers. We and Apple reserve the right, to void or deactivate Gift Cards or content codes, suspend or terminate Accounts, request alternative forms of payment, suspend or terminate the ability to purchase Products or to purchase or use Content, cancel or limit orders and bill alternative forms of payment if the Gift Cards or content codes were obtained, used or associated with an Account unlawfully, fraudulently or otherwise in material breach of these Terms.</p><p>We reserve the right not to issue any refund when taking any of the action described above unless we are required to do so by law. </p><p>You must spend any Associated Balance in order to close your Account. </p><p><b>5. Purchases </b></p><p><b>Content.</b> When you purchase Content, the funds will be deducted first from the amount available in your Associated Balance. Any unused amount will remain in your Associated Balance. If your purchase exceeds the amount available in your Associated Balance, another authorised payment method on file may be charged. If that is not available, you will be asked to pay using another payment method, or the transaction will be cancelled.</p><p>Use of Gift Cards or content codes to purchase Content in the United Kingdom requires an Account and acceptance of the Apple Media Services Terms and Conditions at https://www.apple.com/legal/internet-services/itunes/uk/terms.html. An Account is necessary to access and use Content. Apple may update the terms related to Accounts, Content, Products and content codes. Promotional Programmes</b></p><p>From time to time, we may, in our sole discretion, run promotional programmes associated with Gift Cards (‘Promotion(s)’). Promotions may also be run by Apple or by a participating retailer or developer (‘Qualifying Retailer’). If you purchase a Gift Card during a Promotion, you may be eligible to receive a monetary or content bonus (‘Bonus’) upon association of the Gift Card with your Account during the promotional period.<b> We, Apple and Qualifying Retailers may modify or end a Promotion or change its terms and conditions, at any time, for any reason and without prior notice.</b></p><p><b>Promotion Period.</b> Bonuses are only available during the promotional period, as defined by the Promotion terms and conditions, and while supplies last. The Bonus must be associated with an Account by the end of the period listed in the terms of the Promotion. You must be an individual end user located in the United Kingdom to obtain the Bonus and we, Apple and the Qualifying Retailers reserve the right to deny the Bonus to end users located outside the United Kingdom.</p><p><b>Restrictions.</b> From time to time, Apple Media Services may run Promotions. Faulty Gift Cards/Content Code </b></p><p>If a Gift Card or content code is non-functional, you are entitled to a replacement gift card or content code, credited with the unused balance that was held on the non-functional card or code.</p><p><b>9. Limitation of Liability </b></p><p>If we fail to comply with these Terms, we are responsible for our failing to use professional diligence, but we are not responsible for any loss or damage:</p><ul><li>not caused by our breach of these Terms or otherwise by our acts; </li><li>not reasonably foreseeable by both you and us at the time of entering into these Terms; or</li><li>caused by events beyond our reasonable control.</li></ul><p>Nothing in these Terms excludes or limits your consumer statutory rights nor our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation. </p><p><b>10. Governing Law </b></p><p>If you are a resident of any European Union country or the UK, Switzerland, Norway or Iceland, these Terms and your relationship with us is governed by the laws of your usual place of residence.
