belang om te weten wat is overeengekomen in het arbeidscontract. Een arbeidsovereenkomst voor onbepaalde tijd geeft meer rechtsbescherming dan een arbeidscontract voor bepaalde tijd. Ook van belang is welke clausules en bedingen zijn opgenomen of weggelaten die de positie bepalen van de werkgever en werknemer. </span></p><p><span style="color: #003366;"><b>Arbeidsconflict<br /> </b>Het komt voor dat een conflict ontstaat tussen de werknemer en werkgever. Het is van belang om te weten wat de rechten en de plichten zijn van alle betrokkenen bij een arbeidsconflict. Een arbeidsconflict kan een gevolg zijn van verschil van inzicht tussen werknemer en werkgever over de wijze waarop een functie moet ingevuld, onverenigbaarheid van karakters kan ook leiden tot een arbeidsconflict. Arbeidsconflicten kunnen uitmonden in een officiële waarschuwing, overplaatsing, sancties, ziektemelding en zelfs tot ontslag. Bij voortslepende conflicten is de kans groter dat de betrokken werknemer een beroepsziekte oploopt en in de ziektewet beland. De werkgever heeft de verantwoordelijkheid om arbeidsconflicten zoveel mogelijk te voorkomen en als een conflict zich voordoet snel in te grijpen en te zorgen voor waarborgen voor de werknemer om zonder vrees voor sancties zijn kant van het verhaal te doen. Al dan niet opgenomen in een protocol kan mediation voor beide partijen een oplossing bieden bij arbeidsconflicten. Indien het conflict gaat over ongewenst gedrag, discriminatie, pesten of seksuele intimidatie, dan moet de werknemer terecht kunnen bij een interne of externe vertrouwenspersoon. </span></p><p><span style="color: #003366;"><b>Mediation<br /> </b>Mediation is een alternatieve wijze van geschiloplossing, ook bekend als ‘begeleid onderhandelen’. Bij mediation gaat het niet om wie gelijk heeft maar dat eerst de werkelijke belangen van partijen op tafel komen, zodat partijen daarna op zoek kunnen gaan naar de beste oplossing. Als de bereidheid er is om tot een een duurzame oplossing te komen, dan is mediation de oplossing. Bij ontslag wegens ruzie met de baas, arbeidsconflict of verstoorde arbeidsrelatie, moet uw werkgever normaliter uw ontslag voorleggen bij de kantonrechter. Een arbeidsgeschil is meestal een gevolg van een verschil van inzicht tussen werknemer en werkgever over de wijze waarop een functie moet worden ingevuld. Maar het kan ook gaan om een arbeidsconflict vanwege onverenigbaarheid van karakters. Bij alle arbeidsgeschillen en (dreigend) ontslag, kunt u langslepende procedures voorkomen door mediation.
