These terms and conditions are a binding contract between the User and CRAMC /Canara Robeco Mutual Fund (“CRMF”). It governs the User's use of CRAMC's Website known as www.canararobeco.com("Website") and all products, services, content, tools and information available through the Website. The user will be allotted online “Personal Identification Number” (“PIN”), a unique personal identification number for availing CRMF Online facility. This PIN will be allotted subject to the PIN application form being complete in all respects. By using or accessing the CRMF Online facility (“the said Facility”) on the Website, the User declares, accepts and agrees to be bound by the following terms and conditions:</p> <div class="formsList"> <ul> <li>I have read and understood the contents of the Scheme Information Document (“SID”) / Statement of Additional Information (“SAI”) and Key Information Memorandum (“KIM”) of the respective Scheme(s) and agree to abide by the terms and conditions, rules and regulations of the Scheme and the said Facility.</li> <li>I hereby confirm that I comply with the requirements of Know Your Customer (“KYC”) and restrictions on acceptance of third party payments for subscription of units.</li> <li>I confirm that the data/information provided by me while filling up the online application form are true and correct. The ARN holder, (where selected for the transaction) has disclosed to me/ us all the commissions (in the form of trail commission or any other mode), payable to him for the different competing Schemes of various Mutual Funds from amongst which the Scheme is being recommended to me/us;</li> <li>I understand that all correspondence/communication in respect of my folio(s) will be sent by CRAMC/ Authorised Registrar at the registered address and/or email address provided by me.</li> <li>I understand that if the Unitholder is a minor, then the facility can be availed of by his/her parent or by a legal guardian appointed by a court of competent jurisdiction on behalf of the minor. I as the parent/ legal guardian shall represent the minor in all transactions of any description until the said minor attains majority. Upon attaining of majority, my right as the parent/ legal guardian to operate the account(s) shall cease. I as the parent/ legal guardian agree to indemnify CRAMC against any claim/s of the above minor in respect of any transactions made by me on behalf of the minor.</li> <li>I agree that the CRAMC/ CRMF has sole discretion at any time to restrict a particular set/ class of investors from purchasing/subscribing to/ dealing with the units of CRMF.</li> <li>I agree that at present the said Facility is a privilege service offered without any charges. This could result in delays in the processing of Instructions or failure in the processing of Instructions and other such failures and inabilities. The User understands that CRAMC disclaims all and any liability, whether direct or indirect, whether arising out of loss of profit or otherwise arising due to any failure or inability by CRAMC to honor any user Instruction for whatsoever reason. The Unit Holder(s) of such account agree(s) and confirm that the CRAMC / Authorised Registrar shall not be in a position to verify the User of the Website and thereby not be responsible or shall not be liable for any transactions arising out of misuse of the PIN by any of the Joint Unit Holder(s). Use of the PIN for any transaction executed by any of the Joint Unit Holder(s) under the said Facility shall be deemed to have been carried out jointly by all the Joint Unit Holder(s). The Joint Unit Holder(s) agree and confirm that the First Unit Holder has the full authority to act for and on behalf of all and each of the Joint Unit Holder(s) in all matters relating to the said Facility. Liability in respect of joint holding shall be joint and several and shall be binding on each Joint Unit Holder, his/her legal heirs, successors, executors and assigns. The Joint Unit Holder(s) hereby agree and undertake to confirm and ratify all the acts done by the first Unit Holder or any other Joint Unit Holder in relation to the said Facility.</li> <li>If the User is a minor, the parent / legal guardian shall be eligible to avail the said Facility till the minor attains majority. In such case, the personal details of the parent / legal guardian shall be submitted to the CRAMC / Authorised Registrar. The parent / legal guardian hereby agrees not to use the said Facility once the minor attains majority.</li> <li> If the User is not an individual, the authorized signatories (as mentioned in the application form at the time of subscription to Units or subsequent changes in the authorised signatory list). <ul> <li>The User may designate any individual as its authorized user by providing to CRAMC/ Authorised Registrar the followingThe relevant resolution or authority, as the case may be, to subscribe to Units, in original or a duly certified true copy thereof.</li> <li>Such resolution or authority shall state the name of the individual/s authorised to apply for, receive and activate the PIN access to the said Facility on behalf of the User and to further receive from, and send to, any and all communications with CRAMC/ Authorised Registrar with respect to the said Facility.</li> <li>The said resolution or authority in favour of such individual/s shall also contain the specimen signature of the individual/s so authorised.</li> <li>It shall be the User's responsibility to communicate any changes to the said authorised person/s in the same manner as aforesaid.</li> <li>The Non-Individual User agrees and confirms that CRMF/ CRAMC/ Authorised Registrar is not in a position to verify the User of the Website and thereby not responsible or shall not be held liable for any transactions arising out of misuse of the PIN by any of the representatives of such Non-Individual User. Any use of the PIN for any transaction executed by any Non-Individual User under the said Facility shall be deemed to have been carried out by the Non-Individual User. The Non-Individual User agrees and confirms that the said authorised person/s has/have the full authority to act for and on behalf of the Non-Individual User in all matters relating to the said Facility. Liability on all such Non-Individual User accounts shall be binding on each of such Non- Individual User's successors, executors and / or assigns. The Non-Individual User hereby agrees and undertakes to confirm and ratify all the acts done by the authorised person/s or any other person claiming to be authorized by the Non-Individual User in relation to the said Facility.</li> </ul> </li> </ul> </li> </ul> </div> <h2>GENERAL TERMS AND CONDITIONS</h2> <div class="formsList"> <ul> <li>The said Facility is not available to User/s whose original signature/s is/are not registered with the CRAMC/ Authorised Registrar. CRAMC reserves the right to reject any PIN Applications received from such User. The said Facility is intended only for personal non-commercial use of the User. If any User chooses to access / use the said Facility from locations outside India, he/ she/ it does so at its own initiative and risk, and shall be solely responsible for compliance with all applicable laws in force in the respective locations/ jurisdictions outside India.</li> <li>The Website is intended for use by such investors, prospective investors and distributors authorized by law and regulations to invest/deal in Mutual Fund units. The Website is not intended for distribution, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation. </li> <li>CRAMC/ Authorised Registrar may, at its absolute discretion and in the interest of the User, request document/ confirmation with regard to online transaction, signed by the User. However, CRAMC/ Authorised Registrar shall have no obligation to check or verify the authenticity or accuracy of document/ confirmation/s purporting to have been sent by the User and may act thereon as if the same had been duly given by the User.</li> <li>CRAMC/ Authorised Registrar shall not be responsible for any errors that may be committed by the User in the process of executing any transaction on the said Facility. The User shall make only one application for each transaction, either in physical or electronic form.</li> <li> The User shall give the CRAMC/ Authorised Registrar ten (10) working days' notice in writing if the User wishes to terminate this facility. CRAMC/ Authorised Registrar is entitled to terminate the PIN without prior notice on the occurrence of any of the following events: <ul> <li>Non-compliance of the terms and conditions set out herein.</li> <li>Death, insolvency, bankruptcy or liquidation of the User.</li> <li>Any other cause arising out of operation of law.</li> <li>Closing of User's account.</li> <li>Receipt of a letter from a Joint Holder for termination of the said Facility.</li> <li>If the User goes into liquidation or dissolution or presents or is presented with a petition for or passed a resolution for winding up either compulsory or voluntary or makes any arrangement with its creditors or any assignment for the benefit of creditors, or if a receiver or manager of its business or undertaking is duly appointed, or if distress or execution shall be levied or threatened upon any of its property or if it suffers any similar action in consequence of debt.</li> <li>Such other reasons as CRAMC/ Authorised Registrar may deem proper in the interest of the User. </ul> </li> <li>The User authorises CRAMC/ Authorised Registrar to provide to third parties such details relating to the User and / or the User's account as may be necessary in order to give effect to any electronic instructions of the User or in order to comply with the order of any court, governmental/statutory agency or lawful authority or in order to ensure compliance with any laws / regulations in any jurisdiction.</li> <li>The information and materials contained on the Website, and the facility interface, including text, graphics, links or other items - are provided on "as is" and "as available" basis.
