In response to the judgment, three ISPs have already announced that they will take the case to the Supreme Court. In addition, The Pirate Bay itself now says it will sue the anti-piracy outfit IFPI if the ISPs fail to overturn the ruling.</p> </div> <p><img src="http://web.archive.org/web/20090208071042im_/http://torrentfreak.com//images/tpb.jpg" align="right" alt="pirate bay"/>The decision to block The Pirate Bay has once again ignited a debate on Internet filtering, the responsibilities of Internet providers and the legal status of BitTorrent sites. The IFPI - the RIAA&#8217;s global partner - has chalked up a small victory this week, but the fight is far from over.</p> <p>Peter Sunde, co-founder of <a href="http://web.archive.org/web/20090208071042/http://thepiratebay.org/">The Pirate Bay</a> told TorrentFreak that they are seriously considering suing the IFPI for unfair competition. &#8220;They have had a monopoly on distribution and we&#8217;re breaking that monopoly, and in turn they sue people that allow access to our distribution method,&#8221; he said.</p> <p>Meanwhile, all other BitTorrent sites are still accessible in Denmark, and thus far the IFPI hasn&#8217;t announced it will go after any of them. This, together with the fact that there are several tricks to get around the block, make their legal strategy look like a personal vendetta against The Pirate Bay instead of an effective measure against piracy. </p> <p>Before The Pirate Bay takes action against the IFPI, they will first await the outcome of the Supreme Court appeal that the three ISPs - DC, Telia and Telenor - <a href="http://web.archive.org/web/20090208071042/http://torrentfreak.com/danish-isps-to-fight-the-pirate-bay-block-090205/">announced</a> earlier this week. If the appeal is unsuccessful, and when they find the perfect lawyer to represent them, The Pirate Bay will sue IFPI.</p> <p>The IFPI seems to be looking forward to yet another confrontation. &#8220;Peter Sunde is welcome to sue us,&#8221; Jesper Bay, the head of the Danish IFPI told <a href="http://web.archive.org/web/20090208071042/http://www.comon.dk/news/pirate.bay.vil.sagsoge.ifpi_39620.html">Comon.dk</a> in a response to the news. Ironically, one of the websites explaining how to get around the Danish blockade carries <a href="http://web.archive.org/web/20090208071042/http://thejesperbay.dk/">Jesper Bay&#8217;s</a> name.</p> <p>For now, the Pirate Bay team has another court case to focus on. <a href="http://web.archive.org/web/20090208071042/http://torrentfreak.com/the-pirate-bay-gets-ready-for-court-case-090126/">In two weeks</a> their trial in Sweden kicks off, where the IFPI will also be one of their opponents. I seriously doubt it. The cases of courts being corrupt in Western countries are very rare. It is entirely possible for the court to make a finding against TPB and not be corrupt. They are arguing and deciding on how the law should be applied - if you disagree with the decision that is made is doesn&#8217;t mean they are corrupt&#8230; seriously, wierd that you attached the word &#8220;logic&#8221; to that sentence.</p> <p>I may be proved wrong but I fail to see how TPB can sue for &#8220;unfair competition&#8221; in this case - how does that work? The IFPI does not like this because it means that their money sources are not in control of distribution and are being bypassed. If you send the pirate bay a letter asking them to take-down content (actually, unlink to it), they&#8217;ll send you back a letter telling you to go f*** yourself and threaten to countersue for harassment. TPB breaks this vacuum and allows the worker a little release from this tedium, it allows poor and worn people with internet to enjoy a movie now and then, a &#8220;2007 Super Mix Collection&#8221; now and then, and to escape the vacuum a little, even under threat of police, lawyers, and courts to come and ruin their lives.</p> <p>The major movie houses can make their monies from those who decide to support to them. There is room for the two markets: the cam-videos and copies from TPB, and the people who have money to buy the high quality original DVD&#8217;s or to go to the movie houses. As far as &#8220;original artists&#8221; like Ellison, these have to find people who support them, who will pay them. Because TPB is fictionally eliminated does not equal money in the pocket for people like &#8220;Ellison.&#8221;</p> <p>The most significant effect of TPB is that whole worlds are opened up for purpose of sociological study, old media, and the landslide of new high-dollar often low-value contrivances from the major studios. Hopefully in the long term there will be some kind of society evolution as media content is opened up and accessible across the countries of the world.
