article-chapo-117746 apercu surlignable"><p>Within the Court of Justice of the European Union, which is composed of the Court of<br class='autobr' /> Justice and the General Court (GC), the Registry of the GC is the sole department of<br class='autobr' /> the GC. As such, its very existence is inherent to the judicial autonomy of the GC.</p> <p>Its essential task is to assist in the efficient administration of Justice, which implies<br class='autobr' /> notably to enable Judges to carry out their duties in the best possible conditions and<br class='autobr' /> to organise the entire conduct of proceedings, in all its aspects, from the lodging of<br class='autobr' /> the application to the publication of the final decision, having regard to all the<br class='autobr' /> applicable rules and the objectives pursued by the GC.</p></div> </div> <div class="definition-section"> <h3 id="part-texte" class="definition-section-title">Commentary</h3> <div class="crayon article-texte-117746 texte surlignable"><p>The Registry is headed by the Registrar, who is elected by the Judges of the GC for a<br class='autobr' /> renewable term of six years. Before taking his duties, the Registrar takes the oath,<br class='autobr' /> provided for in Article 2 of the Protocol on the Statute of the Court of Justice of the<br class='autobr' /> European Union (Statute), before the Judges of the GC.</p> <p>The Registry contributes fully, in compliance with the provisions of the Rules of<br class='autobr' /> Procedure of the GC and the Practice Rules for the Implementation of the Rules of<br class='autobr' /> Procedure of the General Court (‘PRI’), to the activities of that Court. Its task is not<br class='autobr' /> expressly set out in the Statute, the Rules of Procedure or the PRI, but they can be<br class='autobr' /> inferred from the responsibilities entrusted to the Registrar, as they are described in<br class='autobr' /> the Rules of Procedure and the PRI.</p> <p>The legal framework for the Registry’s activities is laid down in Articles 32 to 39 of the Rules of Procedure. Those articles are supplemented by, inter alia, paragraph 1 of<br class='autobr' /> the PRI.</p> <p>The services provided by the Registry have a twofold purpose: to act as the exclusive<br class='autobr' /> interlocutor between the parties (lawyers and agents of the Member States and the<br class='autobr' /> institutions) throughout the judicial proceedings, except the hearing (external role),<br class='autobr' /> and to provide direct assistance to the 54 Judges of the GC as well as to play an<br class='autobr' /> active role in the life of the institution (internal role).</p> <ul class="spip" role="list"><li> Four main objectives</li></ul> <p>The Registry’s contribution to the efficient administration of Justice can be divided into activities centred around four main objectives:</p> <p><span class="spip-puce ltr"><b>–</b></span> <i> <strong>to ensure communication with the parties’ representatives and the Judges in judicial proceedings.</strong> </i> The Registry receives, transmits and stores all documents and make the necessary arrangements for service as required by the Rules of Procedure.</p> <p><span class="spip-puce ltr"><b>–</b></span> <i> <strong> to ensure the proper conduct of proceedings</strong>. </i> Every procedural document<br class='autobr' /> lodged in a case pending before the GC is handled by the Registry (11.729 in<br class='autobr' /> 2023, compared with 10.412 in 2022). Such processing involves various<br class='autobr' /> actions: review of compliance with formal requirements and other conditions;<br class='autobr' /> pre-analysis of the document (1.271 applications in 2023, compared with 904<br class='autobr' /> in 2022), which involves the review of jurisdiction and of certain conditions of<br class='autobr' /> admissibility; entry of the documents into the register (62.019 in 2023,<br class='autobr' /> compared with 60.691 in 2022); placement on the case file; transmission to<br class='autobr' /> the chambers of the judges concerned together with, where appropriate,<br class='autobr' /> requests for decisions (in 2023, 14.615 digital transmission sheets were<br class='autobr' /> exchanged with the Judges’ Chambers in the course of proceedings, compared with 14.631 in 2022); requests for translation and authentication.</p> <p><span class="spip-puce ltr"><b>–</b></span> <i> <strong>to provide technical and legal assistance to the Judges of the GC and their staff in different ways</strong> </i>. The Registry helps in ensuring consistency in decision-making in procedural matters, preparing procedural orders and in assisting the Judges during the administrative meetings of chambers (known as “chamber conferences”) and during the hearings.</p> <p><span class="spip-puce ltr"><b>–</b></span> <strong> <i>to contribute to the administration of the GC under the authority of the President of the GC and with the assistance of the departments of the Court of Justice of the European Union. </i> </strong> To that effect, the Registrar attends the sittings of the GC and is involved in the works of the internal committees. Furthermore, the Registrar and the representatives of the Registry participate in various bodies of the Court of Justice of the European Union.</p> <ul class="spip" role="list"><li> Parameters</li></ul> <p>The Registry has no control over the number of cases brought before the GC, the<br class='autobr' /> number of cases closed, or the number of procedural documents lodged in pending<br class='autobr' /> cases. It is required to deal with all procedural documents itself in any of the 24<br class='autobr' /> official languages of the EU and it interacts with the parties’ representatives, both in<br class='autobr' /> writing and orally, in the language of the case.</p> <p>All phases of the proceedings (from the filing of the document initiating proceedings<br class='autobr' /> to the service of the final decision, which is signed and stored electronically) have<br class='autobr' /> been progressively dematerialised between 2005 and 2022. Written communications<br class='autobr' /> between the Registry and the parties’ representatives in direct actions have been<br class='autobr' /> provided in exclusively electronic format, via the e-Curia application, since December<br class='autobr' /> 1, 2018 (1.762.453 pages filed by e-Curia in 2023, compared with 979.676 in 2022).<br class='autobr' /> Hearings may be held by videoconference under the conditions set out in the Rules<br class='autobr' /> of procedure.</p> <p>Its involvement must be measured against three benchmarks: time, quality and<br class='autobr' /> ethics.</p> <p>In 2023, the registry had 71 budgetary posts within an institution made up of 2.302<br class='autobr' /> people.</p> <ul class="spip" role="list"><li> The Registry and Competition law cases</li></ul> <p>Competition law applicable to undertakings (cartels, abuse of a dominant position or<br class='autobr' /> mergers) and State aid law are two of the more than 40 listed matters that the GC<br class='autobr' /> and its Registry have to deal with. Cases in these areas are monitored by the<br class='autobr' /> Registry teams responsible for the languages in which the cases are lodged. Where<br class='autobr' /> related actions (such as cartel cases seeking annulment of the same Commission<br class='autobr' /> decision) are brought in different procedural languages, a special system is set up<br class='autobr' /> within the Registry to ensure coordinated management.</p> <ul class="spip" role="list"><li> The managing of confidentiality issues</li></ul> <p>Proceedings in Competition cases are frequently peppered with confidentiality issues<br class='autobr' /> that require particular vigilance on the part of the Registry. These include requests to<br class='autobr' /> omit data mentioned in documents and information to which the public has access,<br class='autobr' /> requests for confidentiality between main parties (following a measure of inquiry), and<br class='autobr' /> requests for confidentiality vis-à-vis an intervener or another party in a joined case.<br class='autobr' /> The conditions for implementing the adversarial principle may be agreed upon, for<br class='autobr' /> example in the form of a confidentiality agreement.</p> <p>The Registry manages the exchange of confidential and non-confidential versions of<br class='autobr' /> the documents with the parties’ representatives and with the Judges of the competent formation (including the decision terminating the proceedings) and ensures that the case file is properly updated.</p> <ul class="spip" role="list"><li> The organisation of hearings in important cases</li></ul> <p>The Registry is responsible for summoning the parties' representatives,<br class='autobr' /> communicating the hearing report and notifying the questions the GC may have<br class='autobr' /> (without prejudice to the measures to be taken in the event of a request for<br class='autobr' /> videoconferencing). It assists the Judges during the hearing, draws up the draft<br class='autobr' /> minutes of the hearing and serves the minutes.</p> <p>Special arrangements can be made to optimize the conduct of hearings in large-scale<br class='autobr' /> cases or series of cases.</p> <p>In 2023, 419 cases were pleaded, including 26 Competition cases and 88 State aid<br class='autobr' /> cases (compared with 303, including 21 Competition cases and 38 State aid cases,<br class='autobr' /> in 2022).</p> <p>For example, the Registrar assists the Judges when the GC decides to organize a<br class='autobr' /> pre-hearing meeting with the parties’ representatives to clarify certain points and make the hearing fully interactive. The meeting covers speaking times, the order in which speakers are to take the floor, the issues to be addressed by category of plea, any outstanding procedural incidents, and issues relating to the confidentiality of data that must be preserved in the context of a public debate. Practical issues can also be addressed, such as the secure storage of files for the duration of the hearing, or the provision of premises for representatives.</p> <p>In addition, the Registry makes special arrangements for coordination with the<br class='autobr' /> institution’s departments (interpreters, court ushers, security, communications,<br class='autobr' /> multimedia) and the judge-rapporteur’s chambers to ensure that hearings in certain Competition cases run smoothly [for example, in 2021, the oral hearing in Case T- 604/18, <i>Google and Alphabet v.
