given geopolitical tensions and the growing pushback against regulation and action related to climate change, environmental protection and human rights. </p><p>After almost five decades working in human rights, Michael Posner, director of the Center for Business and Human Rights at New York University’s Stern School of Business, refuses to fall into this trap. He insists on the importance of staying “focused on the opportunities to change the status quo”. </p><p>He lays out his reasoning behind this stance in his recently published book, <em>Conscience Incorporated: Pursue Profits While Protecting Human Rights</em>. In it, he underlines the importance of regulation to initiate change, but is equally clear that business also has a vital role to play. </p><p>“However well designed or reinforced, regulations will never be sufficient,” Posner writes in his book, which opens with a preface by former US secretary of state Hillary Rodham Clinton.</p><p>“Regulation can be a catalyst for companies to be more transparent, to set and apply substantive standards, and to devote greater resources to human rights,” he continues. “At the end of the day, though, improved corporate performance in this realm will require adopting better models and new ways of doing business.” </p><p>When I speak to Posner over the phone in December, the US is awaiting the arrival of Donald Trump in the White House. Those working on environmental issues and human rights are fearful of the impacts the new American president will have domestically and internationally. </p><p>He says the US is already on a different path from the EU. “The EU has a range of regulatory proposals either on the table or being enacted that governments need to make companies do the right thing,” while the “antithesis” is happening in the US, he states. And under Trump’s leadership, “a free-for-all for businesses is coming”.</p><div class='pull-quotes'><q>In the next decade, there will be a sorting out. Some laws will get on track, others not. This is not a linear process</q><p class='author'>Michael Posner, NYU’s Stern School of Business</p></div><p>The EU is, however, far from immune from the changing climate towards environmental, social and governance-related regulation, with its Corporate Sustainability Due Diligence Directive and its Corporate Sustainability Reporting Directive under attack from certain European governments and industries, and other countries. Qatar this weekend threatened to <a href="https://www.ft.com/content/2260c21b-f5f4-4ea9-b176-ba1b38c8471c" target="_blank">stop gas shipments</a> to the EU if member states strictly enforce the CSDDD, and the law is expected to be attacked by the Trump administration. </p><p>Posner agrees in conversation and in his book that much in the political and corporate worlds is not moving in the right direction, but writes that he remains “buoyed by the many positive changes in the human rights landscape I have witnessed”. </p><p>“In the next decade, there will be a sorting out,” he tells Sustainable Views. “Some laws will get on track, others not. This is not a linear process.”</p><h2>‘A transactional president’</h2><p>And exactly how Trump will act once in power is far from clear, says Posner. </p><p>While the next US president has promised to boost the economy, “lots of what Trump says, he won’t do, and lots will not be in the interest of business, such as mass deportations and gutting whole sections of government. Trump will be a transactional president; he doesn’t have a strong ethical or moral compass. He makes assertions and then sees what sticks,” he says. </p><p>“There will be companies privately saying how do we deal with this; it is not good for brand America and who will try to mitigate damage. Business depends on the rule of law.”</p><p>Posner also points out the many inherent contradictions in the incoming US administration. It was during Trump’s first spell as president that the state department issued an <a href="https://2017-2021.state.gov/determination-of-the-secretary-of-state-on-atrocities-in-xinjiang/" target="_blank">atrocity determination</a> accusing the Chinese Communist party of committing genocide and crimes against humanity against the Uyghurs. Following this statement, in December 2021, the US adopted the Uyghur Forced Labor Prevention Act. </p><p>“[Trump] may want to further enforce this law,” he says. “In some areas, the government may take action and go beyond Biden. This is too big and complex a country and government to assume anything.”</p><h2>Standards and metrics</h2><p>Posner, nonetheless, suggests there should be changes to the way due diligence regulation is drawn up and implemented, “reframing it around standards and metrics” that are specific to different sectors. </p><p>“There need to be serious discussions about what are human rights standards for every industry, then figure out what are the indicators and then how you evaluate these standards,” he says.</p><p>He underlines in his book the need for corporate leaders to “adopt clear human rights standards for every aspect of their global operations — then apply them in practice”. </p><div class='pull-quotes'><q>There need to be serious discussions about what are human rights standards for every industry, then figure out what are the indicators and then how you evaluate these standards</q><p class='author'>Michael Posner, NYU’s Stern School of Business</p></div><p>Managing this “starts with each company articulating a business case for prioritising human rights”, writes Posner. “That case is sure to contain negative and positive dimensions. </p><p>“The negative will focus on avoiding reputational risk,” he says, while the positive case includes giving companies the ability to “recruit and retain the next generation of leaders” and “tangible commercial benefits” from treating workers well along the supply chain.</p><p>He cites the standards drawn up by the Fair Labor Association, against which companies including Nike, Adidas and L’Oréal are assessed. Criteria in the <a href="https://www.fairlabor.org/accountability/standards/manufacturing/mfg-code/" target="_blank">Fair Labor Code</a> include no forced labour, no child labour or harassment. Posner is chair of the FLA’s board of directors. </p><p>“Governments can mandate an industry approach,” he says, insisting also on the importance of enforcement and penalties to achieve change. </p><p>For policymakers trying to implement the “S” of ESG, he has this advice: “Don’t go from 0-60. Don’t try to do everything overnight. Give companies the benefit of doubt. If they are improving, don’t penalise them, but if there is a wanton disregard, hold their feet to the fire.
