<p><strong>Here鈥檚 how bold plans for EU research and education can become a reality, explains Kurt Deketelaere</strong></p> <p>Article 179 of the Treaty on the Functioning of the European Union (TFEU) gives the union the objective of strengthening its scientific and technological bases by achieving a European Research Area in which researchers, scientific knowledge and technology circulate freely. This is the so-called fifth freedom, next to the free movement of goods, services, people and capital.</p> <p>Over the past 25 years, several European commissioners for research have tried to make progress on achieving this European Research Area. All of them encountered member states reluctant to allow EU interference in domestic research policy. </p> <p>EU legislative measures eliminating national obstacles to the free circulation of researchers, scientific knowledge and technology were a no-go. Only voluntary, bottom-up measures, jointly developed by the Commission, member states and stakeholder organisations, were feasible.</p> <p>This was true <a href="https://www.researchprofessionalnews.com/rr-news-europe-views-of-europe-2021-12-how-not-to-create-the-european-research-area/">even of the ‘New ERA’</a> launched in 2021, which introduced the ERA Forum, ERA Policy Agenda 2022-2024, ERA Policy Platform and so on. The Commission’s efforts to create a European Education Area (EEA) and European Innovation Area (EIA) suffer from the same problem.</p> <p><b>Change of heart</b> </p> <p>This failure is recognised within the Commission: <a href="https://www.researchprofessionalnews.com/rr-news-europe-politics-2024-7-marc-lema-tre-competitiveness-is-talk-of-the-town/">speaking to Research Professional News this summer</a>, its top research and innovation official, Marc Lemaître, admitted that “we can not really declare that the job [on the ERA] is done—far from it”. He also suggested abandoning “the informal, soft, coordinating approach taken so far” in favour of “legislative action”. </p> <p>Having made <a href="https://www.researchprofessionalnews.com/rr-news-europe-views-of-europe-2021-5-the-eu-must-write-its-research-ambitions-into-law/">a similar plea</a> for 15 years, it’s good to see that the Commission’s directorate general for R&I has seemingly been convinced of the added value of a top-down legislative approach to eliminating national obstacles to the free circulation of knowledge and researchers. </p> <p>The change of direction was surely prompted by April’s <a href="https://www.researchprofessionalnews.com/rr-news-europe-views-of-europe-2024-7-eu-s-embrace-of-science-must-not-serve-up-half-baked-fp10/">report on the single market by the former Italian prime minister Enrico Letta</a>, which makes an explicit plea for the fifth freedom in its opening chapter.</p> <p>Letta’s fifth freedom goes beyond the free movement of research and innovation outputs envisaged in article 179, to embedding research and innovation at the core of the single market, making knowledge diffusion a driver of economic vitality, societal advancement and cultural enlightenment.</p> <p>This clearly inspired Commission president Ursula von der Leyen to write in her <a href="https://www.researchprofessionalnews.com/rr-news-europe-politics-2024-7-guide-for-new-commission-sets-out-increased-research-spending/">political guidelines for the next Commission</a>, published in July, that research and innovation, science and technology, should be “at the centre of our economy”.</p> <p><b>Three into one</b></p> <p>As proposed by Letta, a fifth freedom encompassing research, innovation, data, knowledge and education would become a cornerstone of European integration, transforming a fragmented and uneven knowledge ecosystem into unified opportunities for growth, innovation and inclusivity.</p> <p>As he puts it, “By dismantling administrative and legal barriers, we foster a vibrant exchange of expertise and open the door to unique research opportunities.” And, as he rightly notes, to achieve such a change, the EU must “harmonise and uniformly implement laws across member states”.</p> <p>This leads me to repeat my earlier proposal, for the benefit of new members of the European Commission and Parliament: create a European Knowledge Area, based on a European Knowledge Law. </p> <p>Research, education and innovation are so interconnected that creating three separate areas makes no sense. Instead, the ERA, EEA and EIA should be merged into one European Knowledge Area. </p> <p><b>Put it in writing</b></p> <p>The EKA needs a legal basis that allows EU institutions to propose and adopt legislative measures aimed at eliminating national obstacles and introducing the harmonisation measures that will allow the area to be realised.</p> <p>This can be done by crafting a European Knowledge Law, a regulation or directive based on the TFEU’s articles covering the ERA and the single market (article 114).</p> <p>The EKA could also be incorporated into the EU’s treaties through a more detailed rewrite of article 179, and by establishing research, innovation and education as among the shared competences set out in article 4. This would have the advantage of making the realisation of the EKA a legal obligation.</p> <p>Legally and politically, moves to harmonise education policy would require the biggest shift, as, unlike research, the union has hardly any competence in the area of education. </p> <p>By writing the European Knowledge Area into the TFEU, with a European Knowledge Law to underpin national and EU measures on the many research, innovation and education issues that Letta highlights, the fifth freedom could become a reality.
