It is the listener of the people of the US and it decides on all matters regarding the people. It "interprets the nation's law" (World Book 141). Being able to interpret the law gives the Judicial branch a special kind of power. One of which the Executive Branch and the Legislative Branch do not possess. The Judicial branch decides when a law has been broken, to what extent, and how to punish the criminal act. And that is what makes it the strongest branch. This branch, however, does not have all the power. There is a system put into place by the founding fathers called checks and balances. This system was though up with one goal in mind, to allow near equal flow of power<a data-href=/writing/document/F36NQPYTC class="document__middle white-space--normal source-serif text-l" rel="nofollow" style="cursor:pointer;white-space: normal;"> <i>&hellip;show more content&hellip;</i> </a></p></span><span class="document__preview text-l source-serif "><p class='text-ellipsis-after'>It has to approve any judge that the President tries to put into the Supreme Court and can impeach them if necessary. The Legislative Branch is the second strongest branch of government. The Executive Branch is run by the President who is commander and chief of the Military. It "carries out federal laws." (World Book 140). It will create regulations that back up the laws that Congress passes. The branch acts as the enforcer of the Government. The executive branch is separated into fourteen departments, each handling a specific Executive business. The head of each department is appointed by the President and approved by the senate. The collection of these departments makes up the Presidential Cabinet. The purpose of the cabinet and its members is as stated, As individuals, cabinet members are responsible for the executive departments they head. As, a group, the cabinet is intended to serve as an advisory body to the President. (Remy 230) This branch has ways to supersede the power of the other branches. President can Veto any law that Congress is trying to pass. This will deny Congress the right to pass that law. The President can put in place a Presidential order. This order holds the weight of a law but does not require Congress to vote on it prior to it being put in place. The President can appoint Judges to the Supreme Court. These Judges will carry out the mindset of the President even after his term has ended</p></span></div><div class="paper__gradient paper__gradient--bottom"></div><div class="center paper__cta"><a class="button text-m button--orange" id="ShowMoreButton" rel="nofollow" data-href="/writing/document/F36NQPYTC">Get Access</a></div></div></div></div><div class="columns large-4 hide-for-medium-only hide-for-small-only"><div class="rhino-slot center" id="essay_ad_sidebar"></div><div class="rhino-slot center" id="essay_ad_sidebar_1"></div></div></div><div class="row essay-preview-block essay-related-block "><div class="columns large-12 padding-1 no-padding-large"><div class="columns large-12 paper--related-separator-new"><span class="paper--related-separator-word">Related</span></div><div class="rhino-slot center" id="essay_ad_related"></div><section class=""><ul id="RelatedDocumentCenter" class="unstyled"><li id="related-essay1"><div class="columns small-12 medium-12 large-12 card box-shadow card-grade-essay paper no-padding"><div class="columns small-12 medium-12 hide-for-large position-relative card-grade-essay-grade-col grade-decent-essays"><div><span>Decent Essays</span></div></div><div class="columns small-12 medium-12 position-relative hide-for-large card-grade-essay-words-col padding-left-1-imp"><a href="/essay/Constitution-Guard-Against-Tyranny-Analysis-7576FD4E242DA93E" class="hide-for-large"><h2 class="heading-s weight-700 brand-secondary">Constitution Guard Against Tyranny Analysis</h2></a><ul><li>486 Words</li><li>2 Pages</li></ul></div><div class="columns small-12 medium-12 large-8 position-relative"><div class="card-grade-essay-preview-col show-for-large"><a href="/essay/Constitution-Guard-Against-Tyranny-Analysis-7576FD4E242DA93E" class="show-for-large"><h2 class="heading-s weight-700 brand-secondary">Constitution Guard Against Tyranny Analysis</h2></a></div><p class="text-m break-word word-break text-ellipsis-after text-ellipsis-after">The United States guards against tyranny by creating a system of checks and balances. The Judiciary branch is the third branch which is made up of courts such as the supreme, circuit, the magistrate and municipal. Alexander Hamilton wrote essays to explain and defend the newly drafted constitution, in 1788, prior to its approval. In Federalist No. 78, Hamilton argues that the judiciary would be the least threatening branch of government because it does not control the military or budget of the nation. In other words, it has no power to act on its own or to enforce what it does. The courts make the ruling only within proper lawsuits such as cases and controversies in the United States Constitution. Essentially, it gives the judges the right to interpret the constitution and when laws are passed by federal and state legislatures that they feel violate the Constitution, they can strike them down using judicial review (Rosen). Although this has “long been criticized as an anti-democratic institution” because “it exercises control, not in behalf of the prevailing majority, but against it” (Rosen), it really is preserving democracy. It preserves the foundation of the Constitution, which represents the will of the people, “while the federal and state laws merely represented the will of the people&#x27;s temporary and fallible representatives” (Rosen). For these reasons, it is important that the judges can therefore interpret the constitution without fear of retribution. The process of being unelected, having life tenure, the inability to be removed from bench and constant salaries allows “them to make unpopular decisions without fear of retribution either from those who appointed them or from the public at large”(Hudson, 71). These unpopular decisions that need to be made in order to protect our lives, property, and rights, not only sincerely looking out for the people, but also making us a</p></div><div class="columns large-1-5 position-relative show-for-large card-grade-essay-words-col"><ul><li>1374 Words</li><li>6 Pages</li></ul></div><div class="columns large-2 show-for-large position-relative card-grade-essay-grade-col grade-decent-essays"><div><span>Decent Essays</span></div></div><div class="small-12 medium-12 large-1-5 position-relative card-grade-essay-button-col"><a class="button text-m " href="/essay/Judicial-Branch-Research-Paper-BAAE9286061DDFCE">Read More</a></div></div></li><li id="related-essay12"><div class="columns small-12 medium-12 large-12 card box-shadow card-grade-essay paper no-padding"><div class="columns small-12 medium-12 hide-for-large position-relative card-grade-essay-grade-col grade-good-essays"><div><span>Good Essays</span></div></div><div class="columns small-12 medium-12 position-relative hide-for-large card-grade-essay-words-col padding-left-1-imp"><a href="/essay/The-Judicial-Branch-F3CCWVGYTJ" class="hide-for-large"><h2 class="heading-s weight-700 brand-secondary">Essay about The Judicial Branch</h2></a><ul><li>1512 Words</li><li>7 Pages</li></ul></div><div class="columns small-12 medium-12 large-8 position-relative"><div class="card-grade-essay-preview-col show-for-large"><a href="/essay/The-Judicial-Branch-F3CCWVGYTJ" class="show-for-large"><h2 class="heading-s weight-700 brand-secondary">Essay about The Judicial Branch</h2></a></div><p class="text-m break-word word-break text-ellipsis-after text-ellipsis-after">The United States government consists of three main branches: the legislative, the executive, and the judicial. The Supreme Court of the United States encompasses the federal judiciary, explicitly the judicial branch.
