Imark 24.3146, Mo. Roth Franziska 24.3159 und Mo. Müller Damian 24.3374) zur Unterstützung der Schweizer Stahlindustrie befasst und beantragt ihrem Rat, sie anzunehmen. Aus Sicht der Kommissionsmehrheit ergänzen diese Motionen die in der UREK-N gegenwärtig diskutierten Sofortmassnahmen. Der Bundesrat wird damit beauftragt, rasch zusätzliche Massnahmen zu verfolgen, um die Stahlproduktion in der Schweiz zu erhalten. – Nach der Durchführung einer Anhörung und ausführlicher Diskussion lehnt die Kommission entgegen dem deutlichen Beschluss des Nationalrates das Eintreten auf die Vorlage zur Einführung einer Investitionskontrolle (23.086) ab. Der Ständerat entscheidet voraussichtlich in der Frühjahrssession 2025. </p> </div> <div class="page-content-wrapper"> <div id="ctl00_PlaceHolderMain_ctl13_Content_de_label" style='display:none'>Content</div><div id="ctl00_PlaceHolderMain_ctl13_Content_de__ControlWrapper_RichHtmlField" class="ms-rtestate-field" style="display:inline" aria-labelledby="ctl00_PlaceHolderMain_ctl13_Content_de_label"><p>Anlässlich der von der Kommission beschlossenen Anhörung zum Investitionsprüfgesetz (vgl. <a href="/press-releases/Pages/mm-wak-s-2024-10-22.aspx?lang=1031">Medienmitteilung der WAK-S vom 22. Oktober 2024</a>) kamen Vertreter der Konferenz der kantonalen Volkswirtschaftsdirektorinnen und -direktoren sowie diverser Verbände (Asset Management Association Switzerland, economiesuisse, Schweizerischer Gewerbeverband, Swiss Holdings, Verband Immobilien Schweiz) zu Wort, um ihre Haltung zur Vorlage des Bundesrates und zu den vom Nationalrat beschlossenen Ausweitungen darzulegen. Mit 8 zu 4 Stimmen hat die Kommission anschliessend beschlossen, nicht auf die Vorlage einzutreten. In der Abwägung zwischen sicherheits- und wirtschaftspolitischen Interessen überwiegen aus Sicht der Kommissionmehrheit die Nachteile, welche die Einführung einer Investitionsprüfung zur Folge hätte. So würde die Schweiz als kleine, offene Volkswirtschaft übermässig unter der Schwächung der Standortattraktivität und der Rechtssicherheit leiden. Strategisch unbedenkliche, aber durchaus benötigte Direktinvestitionen mit ausländischem Kapital wären erheblich behindert. Ebenfalls ist davon auszugehen, dass die Schweiz den Retorsionsmassnahmen anderer Länder ausgesetzt wäre. Nebst diesen Argumenten sieht die Mehrheit insbesondere durch die Ausweitungen des Nationalrats auch einen übermässigen Eingriff in kantonale Kompetenzen. Weil kritische Infrastrukturen weitgehend in der öffentlichen Hand sind, erachtet die Mehrheit schliesslich, dass das Risiko strategisch unerwünschter Übernahmen begrenzt ist. Eine Minderheit beantragt dem Ständerat, auf die Vorlage einzutreten. Sie ist der Ansicht, dass die politische Diskussion rund um die Einführung einer Investitionskontrolle im heutigen geopolitischen Kontext zumindest geführt werden muss. Im Gegensatz zur Mehrheit stellt sie fest, dass aktuell keine genügend wirksamen Instrumente existieren, um die Schweiz vor strategisch problematischen Direktinvestitionen schützen zu können. Der Ständerat berät den Antrag seiner Kommission voraussichtlich in der Frühjahrssession 2025.<br></p><p>Vor ihrem Entscheid über die Motionen zugunsten der Stahlindustrie liess sich die Kommission von den Departementsvorstehern des WBF und des UVEK eingehend über die vom Bundesrat bereits in die Wege geleiteten Massnahmen, insbesondere zugunsten von Stahl Gerlafingen, informieren. Sie nahm ausserdem zur Kenntnis, dass die UREK-N bald über konkrete Sofortmassnahmen entscheiden dürfte (vgl. <a href="/press-releases/Pages/mm-urek-n-2024-10-22.aspx?lang=1031">Medienmittelung der UREK-N vom 22. Oktober 2024</a>). Dies war für einen Teil der Kommission ein Grund, die Sistierung der Motionen zu verlangen, was die WAK-S jedoch mit 7 zu 6 Stimmen ablehnte. Mit 7 zu 5 bzw. 7 zu 6 Stimmen bei 1 Enthaltung beantragt sie die Annahme der Motionen 24.3146 und 24.3159, die vom Bundesrat Sofortmassnahmen zur Rettung des Stahlwerks Gerlafingen verlangen, und mit 8 zu 2 Stimmen bei 3 Enthaltungen die Annahme der Motion 24.3374, die den Bundesrat beauftragen will, in geeigneter Form eine Übergangsfinanzierung für die Stahlindustrie zur Verfügung zu stellen, um den Produktionsstandort Schweiz zu sichern und die Kreislaufwirtschaft zu erhalten. Aus Sicht der Mehrheit soll der Bundesrat mit diesen Motionen unterstützt werden, die geplanten Massnahmen weiterzuverfolgen und umzusetzen. Sie weist darauf hin, dass die Motionen bewusst offen formuliert seien und nicht zwingend ein Handeln mittels Notrecht verlangten. Auch wenn man eine Industriepolitik grundsätzlich nicht befürworte, sei angesichts der existentiellen Bedrohung der beiden Stahlwerke Gerlafingen und Emmenbrücke Handlungsbedarf gegeben. Im Interesse der Versorgungssicherheit des Landes und der Nachhaltigkeit müssten Rahmenbedingungen für die Schweizer Stahlindustrie geschaffen werden, die ihr eine Weiterexistenz erlauben. Die Kommissionsminderheit schliesst sich der Argumentationslinie des Bundesrats an. Sie unterstützt dessen laufende Bestrebungen und möchte ihm keine weiteren Aufträge erteilen, zumal die UREK-N bereits Schritte eingeleitet hat. Ausserdem möchte sie kein Präjudiz schaffen. Mit dem Verweis auf Versorgungssicherheit und Nachhaltigkeit könnten auch weitere Industriezweige – wie z.B. die Zementindustrie oder Sägereien – Unterstützungsmassnahmen des Bundes verlangen. Der Ständerat wird sich in der Wintersession mit den Motionen befassen.</p><h2 class="pd-rteElement-h2">Vorstösse im Bereich des Kartellrechtes</h2><p>Trotz den bereits initiierten Arbeiten des Bundesrates im Hinblick auf eine Reform der Wettbewerbsbehörden stützt die Kommission das Anliegen der Motion 23.3224 und beantragt deshalb mit 8 zu 3 Stimmen bei 2 Enthaltungen deren Annahme. Sie drückt so insbesondere ihren Willen aus, dass zum einen die Problematik der institutionellen Trennung zwischen untersuchender und entscheidender Behörde und zum anderen die Frage der Verfahrensdauer angepackt werden. Um eine Beschleunigung der Verfahren zu erwirken fordert die Kommission mit 7 zu 1 Stimme bei 2 Enthaltungen ebenfalls die Annahme der Motion 22.4404. Durch die Rechtsunsicherheit, die mit langen Verfahren einhergehen, ist das gegenwärtige System insbesondere für KMU höchst problematisch und schadet dem Vertrauen der Wirtschaft ins Kartellgesetz.</p><p>Schliesslich lehnt die Kommission mit 6 zu 4 Stimmen bei zwei Enthaltungen die Motion 22.3838 ab, welche Hersteller und Importeure von Kraftfahrzeugen (KFZ) bei der Gestaltung ihres Vertriebssystems beschränken will, um den Wettbewerb im KFZ-Markt aufrechtzuerhalten. Die Kommissionsmehrheit teilt die Auffassung des Bundesrates, wonach eine solche Regelung de facto einem Vertragszwang entsprechen und damit die verfassungsrechtlich garantierte Wirtschaftsfreiheit erheblich beschneiden würde. Sie vertritt auch die Ansicht, dass sich die Marktteilnehmenden in allen Arten von Vertriebssystemen auf die geltenden kartellrechtlichen Rahmenbedingungen berufen können. Eine Kommissionsminderheit unterstützt das Anliegen der Motion. Angesichts der stetigen Ausdünnung des Handelsnetzes – insbesondere in Randregionen – sieht sie Handlungsbedarf, um die Abhängigkeit der kleineren Akteure von den grossen Herstellern und Importeuren auszugleichen und zugunsten der Konsumentinnen und Konsumenten den Wettbewerb zu fördern.</p><p>Die Beratung der beiden gleichlautenden Motionen 22.3976 und 22.3977 («Interchange Fees für Zahlungen mit Debitkarten verbieten») hat die Kommission aus Zeitgründen auf eine spätere Sitzung verschoben.</p><p>Die Kommission hat am 14.
