In the midst of this country’s needs to accelerate construction of public infrastructure providing connectivity among regions and supporting economic growth as well as better living quality, project delays have to be seriously addressed. This paper identifies potential causes factors of interface problems experienced by construction projects in Indonesia. Data are collected through a survey involving the main actors of six important public infrastructure construction projects including railway, LRT, sports stadiums, apartment, and education building construction projects. Five of these projects adopt the design-build project delivery method and one applies the design-bid-build scheme. Interface problems’ potential causes are categorized into contract, management, technical experience, coordination, financial, and environmental factors. Research results reveal that, especially in railway and LRT projects, potential causes of interface problems are mainly technical and managerial in nature. These relate to complex construction execution in highly congested areas. Meanwhile, coordination cause factors are mainly found in the education building construction project with loan from a foreign donor. All of the six projects have to resolve interface problems caused by incomplete or low-quality contract documents. This research also shows that the design-bid-build delivery method involving more parties in construction projects tends to induce more interface problem cause factors than the design-build scheme. <p class="card-text"><strong>Keywords:</strong> <a href="https://publications.waset.org/abstracts/search?q=cause%20factors" title="cause factors">cause factors</a>, <a href="https://publications.waset.org/abstracts/search?q=construction%20delays" title=" construction delays"> construction delays</a>, <a href="https://publications.waset.org/abstracts/search?q=project%20delivery%20method" title=" project delivery method"> project delivery method</a>, <a href="https://publications.waset.org/abstracts/search?q=contract%20documents" title=" contract documents"> contract documents</a> </p> <a href="https://publications.waset.org/abstracts/86489/interface-problems-in-construction-projects" class="btn btn-primary btn-sm">Procedia</a> <a href="https://publications.waset.org/abstracts/86489.pdf" target="_blank" class="btn btn-primary btn-sm">PDF</a> <span class="bg-info text-light px-1 py-1 float-right rounded"> Downloads <span class="badge badge-light">255</span> </span> </div> </div> <div class="card paper-listing mb-3 mt-3"> <h5 class="card-header" style="font-size:.9rem"><span class="badge badge-info">11</span> Antioxidant Extraction from Indonesian Crude Palm Oil and Its Antioxidation Activity</h5> <div class="card-body"> <p class="card-text"><strong>Authors:</strong> <a href="https://publications.waset.org/abstracts/search?q=Supriyono">Supriyono</a>, <a href="https://publications.waset.org/abstracts/search?q=Sumardiyono"> Sumardiyono</a>, <a href="https://publications.waset.org/abstracts/search?q=Puti%20Pertiwi"> Puti Pertiwi</a> </p> <p class="card-text"><strong>Abstract:</strong></p> Crude palm oil (CPO) is a vegetable oil that came from a palm tree bunch. Palm oil tree was known as highest vegetable oil yield. It was grown across Equatorial County, especially in Malaysia and Indonesia. The greenish red color on CPO was came from carotenoid antioxidant, which could be extracted and use separately as functional food and other purposes as antioxidant source. Another antioxidant that also found in CPO is tocopherol. The aim of the research work is to find antioxidant activity on CPO comparing to the synthetic antioxidant that available in a market. On this research work, antioxidant was extracted by using a mixture of acetone and n. hexane, while activity of the antioxidant extract was determine by DPPH method. The extracted matter was shown that their antioxidant activity was about 45% compare to pure tocopherol and beta carotene. <p class="card-text"><strong>Keywords:</strong> <a href="https://publications.waset.org/abstracts/search?q=antioxidant" title="antioxidant">antioxidant</a>, <a href="https://publications.waset.org/abstracts/search?q=" title=" "> </a>, <a href="https://publications.waset.org/abstracts/search?q=beta%20carotene" title=" beta carotene"> beta carotene</a>, <a href="https://publications.waset.org/abstracts/search?q=" title=" "> </a>, <a href="https://publications.waset.org/abstracts/search?q=crude%20palm%20oil" title=" crude palm oil"> crude palm oil</a>, <a href="https://publications.waset.org/abstracts/search?q=" title=""></a>, <a href="https://publications.waset.org/abstracts/search?q=DPPH" title=" DPPH"> DPPH</a>, <a href="https://publications.waset.org/abstracts/search?q=" title=" "> </a>, <a href="https://publications.waset.org/abstracts/search?q=tocopherol" title=" tocopherol "> tocopherol </a> </p> <a href="https://publications.waset.org/abstracts/74220/antioxidant-extraction-from-indonesian-crude-palm-oil-and-its-antioxidation-activity" class="btn btn-primary btn-sm">Procedia</a> <a href="https://publications.waset.org/abstracts/74220.pdf" target="_blank" class="btn btn-primary btn-sm">PDF</a> <span class="bg-info text-light px-1 py-1 float-right rounded"> Downloads <span class="badge badge-light">291</span> </span> </div> </div> <div class="card paper-listing mb-3 mt-3"> <h5 class="card-header" style="font-size:.9rem"><span class="badge badge-info">10</span> Determinants of Conference Service Quality as Perceived by International Attendees</h5> <div class="card-body"> <p class="card-text"><strong>Authors:</strong> <a href="https://publications.waset.org/abstracts/search?q=Shiva%20Hashemi">Shiva Hashemi</a>, <a href="https://publications.waset.org/abstracts/search?q=Azizan%20Marzuki"> Azizan Marzuki</a>, <a href="https://publications.waset.org/abstracts/search?q=S.%20Kiumarsi"> S. Transit Oriented Development (TOD) becomes one of the strategies to improve community livability based on the design of transit place and the system of its context. TOD principle is trying to win over pedestrian motorization habit, makes people would rather transit and travel more than using private vehicle. Train station takes the main role as the catalyst to emerge TOD, in Jakarta this role will be taken by Commuter line and the future MRT. For advancing its development, architectural design perspective is needed to perform evaluation while seeking for the strategies between accessibility transportation modes with convenience and safety for increasing human behavioral intention. This paper discovers design strategy for transit place that appropriates with Jakarta condition use the basic theories of liminal space and transit-oriented development goal. This paper use evidence-based approach with typology method to analyze the present condition of Commuter Line station in Jakarta and precedent of Asian Cities, Tokyo and Seoul, as the secondary sources, and also with numbers of valid questionnaires. Furthermore, the result of this paper aims to the emerging of a transit-oriented community by giving design requirements and suggestion transportation policies preparing for the operational of MRT in the future Jakarta and other similar cities. <p class="card-text"><strong>Keywords:</strong> <a href="https://publications.waset.org/abstracts/search?q=station%20design" title="station design">station design</a>, <a href="https://publications.waset.org/abstracts/search?q=transit%20place" title=" transit place"> transit place</a>, <a href="https://publications.waset.org/abstracts/search?q=transit-oriented%20development" title=" transit-oriented development"> transit-oriented development</a>, <a href="https://publications.waset.org/abstracts/search?q=urban" title=" urban "> urban </a> </p> <a href="https://publications.waset.org/abstracts/75970/architectural-design-strategies-enhance-train-station-performance-as-the-catalyst-of-transit-oriented-development-in-jakarta-case-study-of-beos-commuter-line-station" class="btn btn-primary btn-sm">Procedia</a> <a href="https://publications.waset.org/abstracts/75970.pdf" target="_blank" class="btn btn-primary btn-sm">PDF</a> <span class="bg-info text-light px-1 py-1 float-right rounded"> Downloads <span class="badge badge-light">219</span> </span> </div> </div> <div class="card paper-listing mb-3 mt-3"> <h5 class="card-header" style="font-size:.9rem"><span class="badge badge-info">7</span> Preliminary Geotechnical Properties of Uncemented Sandstone Kati Formation</h5> <div class="card-body"> <p class="card-text"><strong>Authors:</strong> <a href="https://publications.waset.org/abstracts/search?q=Nursyafiqah%20Abdul%20Kahar">Nursyafiqah Abdul Kahar</a>, <a href="https://publications.waset.org/abstracts/search?q=Niraku%20Rosmawati%20Ahmad"> Niraku Rosmawati Ahmad</a>, <a href="https://publications.waset.org/abstracts/search?q=Hisham%20Mohamad"> Hisham Mohamad</a>, <a href="https://publications.waset.org/abstracts/search?q=Siti%20Nuruljannah%20Mohd%20Marzuki"> Siti Nuruljannah Mohd Marzuki</a> </p> <p class="card-text"><strong>Abstract:</strong></p> Assessment of geotechnical properties of the subsoil is necessary for generating relevant input for the design and construction of a foundation. It is significant for the future development in the area. The focus of this research is to investigate the preliminary geotechnical properties of the uncemented sandstone from Kati formation at Puncak Iskandar, Seri Iskandar. A series of basic soil tests, oedometer and direct shear box tests were carried out to obtain the soil parameters. The uncemented sandstone of Kati Formation was found to have well-graded and poorly graded sand distribution, depending on the location where the samples were obtained. The sand grains distribution was in a range of 82%-100% while, the specific gravity of the uncemented sandstone is in the range 2.65-2.86. The preconsolidation pressure for USB3 was 990 kPa indicating that the sandstone at USB3 sample had undergone 990 kPa of overburden pressure. The angle of friction for uncemented sandstone was ranging between 23.34°-32.92°. <p class="card-text"><strong>Keywords:</strong> <a href="https://publications.waset.org/abstracts/search?q=geotechnical%20properties" title="geotechnical properties">geotechnical properties</a>, <a href="https://publications.waset.org/abstracts/search?q=Kati%20formation" title=" Kati formation"> Kati formation</a>, <a href="https://publications.waset.org/abstracts/search?q=uncemented%20sandstone" title=" uncemented sandstone"> uncemented sandstone</a>, <a href="https://publications.waset.org/abstracts/search?q=oedometer%20test%3B%20shear%20box%20test" title=" oedometer test; shear box test"> oedometer test; shear box test</a> </p> <a href="https://publications.waset.org/abstracts/131980/preliminary-geotechnical-properties-of-uncemented-sandstone-kati-formation" class="btn btn-primary btn-sm">Procedia</a> <a href="https://publications.waset.org/abstracts/131980.pdf" target="_blank" class="btn btn-primary btn-sm">PDF</a> <span class="bg-info text-light px-1 py-1 float-right rounded"> Downloads <span class="badge badge-light">155</span> </span> </div> </div> <div class="card paper-listing mb-3 mt-3"> <h5 class="card-header" style="font-size:.9rem"><span class="badge badge-info">6</span> Changes in Religious Belief after Flood Disasters</h5> <div class="card-body"> <p class="card-text"><strong>Authors:</strong> <a href="https://publications.waset.org/abstracts/search?q=Sapora%20Sipon">Sapora Sipon</a>, <a href="https://publications.waset.org/abstracts/search?q=Mohd%20Fo%E2%80%99ad%20Sakdan"> Mohd Fo’ad Sakdan</a>, <a href="https://publications.waset.org/abstracts/search?q=Che%20Su%20Mustaffa"> Che Su Mustaffa</a>, <a href="https://publications.waset.org/abstracts/search?q=Najib%20Ahmad%20Marzuki"> Najib Ahmad Marzuki</a>, <a href="https://publications.waset.org/abstracts/search?q=Mohamad%20Sukeri%20Khalid"> Mohamad Sukeri Khalid</a>, <a href="https://publications.waset.org/abstracts/search?q=Mohd%20Taib%20Ariffin"> Mohd Taib Ariffin</a>, <a href="https://publications.waset.org/abstracts/search?q=Husni%20Mohd%20Radzi"> Husni Mohd Radzi</a>, <a href="https://publications.waset.org/abstracts/search?q=Salhah%20Abdullah"> Salhah Abdullah </a> </p> <p class="card-text"><strong>Abstract:</strong></p> Flood disasters occur throughout the world including Malaysia. Basically, a green building is a building that is designed, constructed and operated to boost environmental, economic, health and productivity performance over conventional buildings. The buildings have been proven to be successful in contributing towards sustainability and project success. The purpose of this study was to determine the benefits of sustainability application in building projects, looking towards project success from the perspective of Malaysian key project stakeholders. The study also aimed to explore the establishment of sustainability goals in the green building projects in Malaysia. The Triple Bottom Line (TBL) Concept of Sustainability was used as the foundation theoretical framework. Surveys, interviews and multiple case study methods were employed. A sample of 188 Malaysian building project stakeholders was selected for questionnaire surveys, and 15 stakeholders from three award-winning green building projects in Malaysia were involved in the interviews. The study found that the majority of the respondents were less aware that the sustainability integration in the building project can significantly affect cost reduction, schedule effectiveness and stakeholders’ satisfaction with the performance of buildings as at the same level as the quality performance. Of the four sustainability goals, the environmental aspect was given more priority than others in the development of the green building projects. <p class="card-text"><strong>Keywords:</strong> <a href="https://publications.waset.org/abstracts/search?q=green%20building" title="green building">green building</a>, <a href="https://publications.waset.org/abstracts/search?q=sustainability" title=" sustainability"> sustainability</a>, <a href="https://publications.waset.org/abstracts/search?q=project%20stakeholders" title=" project stakeholders"> project stakeholders</a>, <a href="https://publications.waset.org/abstracts/search?q=Malaysia" title=" Malaysia"> Malaysia</a> </p> <a href="https://publications.waset.org/abstracts/30421/study-on-the-key-stakeholders-perception-and-establishment-of-sustainability-goals-in-the-green-building-projects-the-case-of-malaysia" class="btn btn-primary btn-sm">Procedia</a> <a href="https://publications.waset.org/abstracts/30421.pdf" target="_blank" class="btn btn-primary btn-sm">PDF</a> <span class="bg-info text-light px-1 py-1 float-right rounded"> Downloads <span class="badge badge-light">562</span> </span> </div> </div> <div class="card paper-listing mb-3 mt-3"> <h5 class="card-header" style="font-size:.9rem"><span class="badge badge-info">4</span> Hearing Conservation Program for Vector Control Workers: Short-Term Outcomes from a Cluster-Randomized Controlled Trial</h5> <div class="card-body"> <p class="card-text"><strong>Authors:</strong> <a href="https://publications.waset.org/abstracts/search?q=Rama%20Krishna%20Supramanian">Rama Krishna Supramanian</a>, <a href="https://publications.waset.org/abstracts/search?q=Marzuki%20Isahak"> Marzuki Isahak</a>, <a href="https://publications.waset.org/abstracts/search?q=Noran%20Naqiah%20Hairi"> Noran Naqiah Hairi</a> </p> <p class="card-text"><strong>Abstract:</strong></p> Noise-induced hearing loss (NIHL) is one of the highest recorded occupational diseases, despite being preventable. Hearing Conservation Program (HCP) is designed to protect workers hearing and prevent them from developing hearing impairment due to occupational noise exposures. However, there is still a lack of evidence regarding the effectiveness of this program. The purpose of this study was to determine the effectiveness of a Hearing Conservation Program (HCP) in preventing or reducing audiometric threshold changes among vector control workers. This study adopts a cluster randomized controlled trial study design, with district health offices as the unit of randomization. Nine district health offices were randomly selected and 183 vector control workers were randomized to intervention or control group. The intervention included a safety and health policy, noise exposure assessment, noise control, distribution of appropriate hearing protection devices, training and education program and audiometric testing. The control group only underwent audiometric testing. Audiometric threshold changes observed in the intervention group showed improvement in the hearing threshold level for all frequencies except 500 Hz and 8000 Hz for the left ear. The hearing threshold changes range from 1.4 dB to 5.2 dB with largest improvement at higher frequencies mainly 4000 Hz and 6000 Hz. Meanwhile for the right ear, the mean hearing threshold level remained similar at 4000 Hz and 6000 Hz after 3 months of intervention. The Hearing Conservation Program (HCP) is effective in preserving the hearing of vector control workers involved in fogging activity as well as increasing their knowledge, attitude and practice towards noise-induced hearing loss (NIHL). <p class="card-text"><strong>Keywords:</strong> <a href="https://publications.waset.org/abstracts/search?q=adult" title="adult">adult</a>, <a href="https://publications.waset.org/abstracts/search?q=hearing%20conservation%20program" title=" hearing conservation program"> hearing conservation program</a>, <a href="https://publications.waset.org/abstracts/search?q=noise-induced%20hearing%20loss" title=" noise-induced hearing loss"> noise-induced hearing loss</a>, <a href="https://publications.waset.org/abstracts/search?q=vector%20control%20worker" title=" vector control worker"> vector control worker</a> </p> <a href="https://publications.waset.org/abstracts/113493/hearing-conservation-program-for-vector-control-workers-short-term-outcomes-from-a-cluster-randomized-controlled-trial" class="btn btn-primary btn-sm">Procedia</a> <a href="https://publications.waset.org/abstracts/113493.pdf" target="_blank" class="btn btn-primary btn-sm">PDF</a> <span class="bg-info text-light px-1 py-1 float-right rounded"> Downloads <span class="badge badge-light">167</span> </span> </div> </div> <div class="card paper-listing mb-3 mt-3"> <h5 class="card-header" style="font-size:.9rem"><span class="badge badge-info">3</span> Failure to React Positively to Flood Early Warning Systems: Lessons Learned by Flood Victims from Flash Flood Disasters: the Malaysia Experience</h5> <div class="card-body"> <p class="card-text"><strong>Authors:</strong> <a href="https://publications.waset.org/abstracts/search?q=Mohamad%20Sukeri%20Khalid">Mohamad Sukeri Khalid</a>, <a href="https://publications.waset.org/abstracts/search?q=Che%20Su%20Mustaffa"> Che Su Mustaffa</a>, <a href="https://publications.waset.org/abstracts/search?q=Mohd%20Najib%20Marzuki"> Mohd Najib Marzuki</a>, <a href="https://publications.waset.org/abstracts/search?q=Mohd%20Fo%E2%80%99ad%20Sakdan"> Mohd Fo’ad Sakdan</a>, <a href="https://publications.waset.org/abstracts/search?q=Sapora%20Sipon"> Sapora Sipon</a>, <a href="https://publications.waset.org/abstracts/search?q=Mohd%20Taib%20Ariffin"> Mohd Taib Ariffin</a>, <a href="https://publications.waset.org/abstracts/search?q=Shazwani%20Shafiai"> Shazwani Shafiai</a> </p> <p class="card-text"><strong>Abstract:</strong></p> This paper describes the issues relating to the role of the flash flood early warning system provided by the Malaysian Government to the communities in Malaysia, specifically during the flash flood disaster in the Cameron Highlands, Malaysia. Normally, flash flood disasters can occur as a result of heavy rainfall in an area, and that water may possibly cause flooding via streams or narrow channels. For this study, the flash flood disaster in the Cameron Highlands occurred on 23 October 2013, and as a result the Sungai Bertam overflowed after the release of water from the Sultan Abu Bakar Dam. This release of water from the dam caused flash flooding which led to damage to properties and also the death of residents and livestock in the area. Therefore, the effort of this study is to identify the perceptions of the flash flood victims on the role of the flash flood early warning system. For the purposes of this study, data collection was gathered from those flood victims who were willing to participate in this study through face-to-face interviews. This approach helped the researcher to glean in-depth information about their feeling and perceptions on the role of the flash flood early warning system offered by the government. The data were analysed descriptively and the findings show that the respondents of 22 flood victims believe strongly that the flash flood early warning system was confusing and dysfunctional, and communities had failed to response positively to it. Therefore, most of the communities were not well prepared for the releasing of water from the dam that caused property damage and 3 people were killed in Cameron Highland flash flood disaster. <p class="card-text"><strong>Keywords:</strong> <a href="https://publications.waset.org/abstracts/search?q=communities%20affected" title="communities affected">communities affected</a>, <a href="https://publications.waset.org/abstracts/search?q=disaster%20management" title=" disaster management"> disaster management</a>, <a href="https://publications.waset.org/abstracts/search?q=early%20warning%20system" title=" early warning system"> early warning system</a>, <a href="https://publications.waset.org/abstracts/search?q=flash%20flood%20disaster" title=" flash flood disaster "> flash flood disaster </a> </p> <a href="https://publications.waset.org/abstracts/20720/failure-to-react-positively-to-flood-early-warning-systems-lessons-learned-by-flood-victims-from-flash-flood-disasters-the-malaysia-experience" class="btn btn-primary btn-sm">Procedia</a> <a href="https://publications.waset.org/abstracts/20720.pdf" target="_blank" class="btn btn-primary btn-sm">PDF</a> <span class="bg-info text-light px-1 py-1 float-right rounded"> Downloads <span class="badge badge-light">704</span> </span> </div> </div> <div class="card paper-listing mb-3 mt-3"> <h5 class="card-header" style="font-size:.9rem"><span class="badge badge-info">2</span> The Effect of Second Victim-Related Distress on Work-Related Outcomes in Tertiary Care, Kelantan, Malaysia</h5> <div class="card-body"> <p class="card-text"><strong>Authors:</strong> <a href="https://publications.waset.org/abstracts/search?q=Ahmad%20Zulfahmi%20Mohd%20Kamaruzaman">Ahmad Zulfahmi Mohd Kamaruzaman</a>, <a href="https://publications.waset.org/abstracts/search?q=Mohd%20Ismail%20Ibrahim"> Mohd Ismail Ibrahim</a>, <a href="https://publications.waset.org/abstracts/search?q=Ariffin%20Marzuki%20Mokhtar"> Ariffin Marzuki Mokhtar</a>, <a href="https://publications.waset.org/abstracts/search?q=Maizun%20Mohd%20Zain"> Maizun Mohd Zain</a>, <a href="https://publications.waset.org/abstracts/search?q=Saiful%20Nazri%20Satiman"> Saiful Nazri Satiman</a>, <a href="https://publications.waset.org/abstracts/search?q=Mohd%20Najib%20Majdi%20Yaacob"> Mohd Najib Majdi Yaacob</a> </p> <p class="card-text"><strong>Abstract:</strong></p> Background: Aftermath any patient safety incidents, the involved healthcare providers possibly sustained second victim-related distress (second victim distress and reduced their professional efficacy), with subsequent negative work-related outcomes or vice versa cultivating resilience. This study aimed to investigate the factors affecting negative work-related outcomes and resilience, with the triad of support; colleague, supervisor, and institutional support as the hypothetical mediators. Methods: This was a cross sectional study recruiting a total of 733 healthcare providers from three tertiary care in Kelantan, Malaysia. Three steps of hierarchical linear regression were developed for each outcome; negative work-related outcomes and resilience. Then, four multiple mediator models of support triad were analyzed. Results: Second victim distress, professional efficacy, and the support triad contributed significantly for each regression model. In the pathway of professional efficacy on each negative work-related outcomes and resilience, colleague support partially mediated the relationship. As for second victim distress on negative work related outcomes, colleague and supervisor support were the partial mediator, and on resilience; all support triad also produced a similar effect. Conclusion: Second victim distress, professional efficacy, and the support triad influenced the relationship with the negative work-related outcomes and resilience. Support triad as the mediators ameliorated the effect in between and explained the urgency of having good support for recovery post encountering patient safety incidents. <p class="card-text"><strong>Keywords:</strong> <a href="https://publications.waset.org/abstracts/search?q=second%20victims" title="second victims">second victims</a>, <a href="https://publications.waset.org/abstracts/search?q=patient%20safety%20incidents" title=" patient safety incidents"> patient safety incidents</a>, <a href="https://publications.waset.org/abstracts/search?q=hierarchical%20linear%20regression" title=" hierarchical linear regression"> hierarchical linear regression</a>, <a href="https://publications.waset.org/abstracts/search?q=mediation" title=" mediation"> mediation</a>, <a href="https://publications.waset.org/abstracts/search?q=support" title=" support"> support</a> </p> <a href="https://publications.waset.org/abstracts/150191/the-effect-of-second-victim-related-distress-on-work-related-outcomes-in-tertiary-care-kelantan-malaysia" class="btn btn-primary btn-sm">Procedia</a> <a href="https://publications.waset.org/abstracts/150191.pdf" target="_blank" class="btn btn-primary btn-sm">PDF</a> <span class="bg-info text-light px-1 py-1 float-right rounded"> Downloads <span class="badge badge-light">108</span> </span> </div> </div> <div class="card paper-listing mb-3 mt-3"> <h5 class="card-header" style="font-size:.9rem"><span class="badge badge-info">1</span> Constitutional Courts as Positive Legislators: The Role of Indonesian Constitutional Court in Interpreting and Applying the Constitution</h5> <div class="card-body"> <p class="card-text"><strong>Authors:</strong> <a href="https://publications.waset.org/abstracts/search?q=Masnur%20Marzuki">Masnur Marzuki</a> </p> <p class="card-text"><strong>Abstract:</strong></p> As in other democratic countries, the constitutional court of Indonesia has the role of interpreting and applying the Constitution in order to preserve its supremacy testing the constitutionality of statutes. With its strong power to enforce and guard the Constitution, the court is now challenged to provide people an opportunity to understand their constitutional rights close up. At the same time, the court has built up an enviable reputation among constitutional courts in new democracies for the technical quality of its legitimacy in the legal sense. Since its establishment in 2003, the Constitutional Court of Indonesia has decided more than 190 statutes in judicial review case. It has been remarkably successful to make a credible start on its work of guarding the Constitution. Unsurprisingly, many argue that the Court has elevated Indonesia’s democracy to a whole new level. In accomplishing its roles judicial review, the basic principle that can be identified is that the Constitutional Court must always be subordinated to the Constitution. It is not being allowed to invade the field of the legislator. In doing so, the court does not have any discretionary political basis in order to create legal norms or provisions that could not be deducted from the Constitution itself. When interpreting a statute “in accordance with the constitution”, the court recognizes and reasserts that it is strictly forbidden to extend the scope of a legal provision in such a way that would create a general norm not established by the law-maker. This paper aims to identify and assess the latest role of Indonesian Constitutional Court in interpreting and applying the Constitution. In particular, it questions 1) the role of the Constitutional Court in judicial review; and 2) the role of the court to assist the legislators in the accomplishment of their functions in order to preserve its supremacy testing the constitutionality of statutes. Concerning positive legislator, jurisprudential and judicial review theories will be approached. The empirical part will include qualitative and comparative research. Main questions to be addressed: Can the Constitutional Court be functionalized as positive legislator? What are the criteria for conducting role of Constitutional Courts as Positive Legislators and how can it be accepted? Concerning the subordination of Constitutional Courts to the Constitution and judicial review, both qualitative and quantitative methods will be used, and differences between Indonesia and German Constitutional Court will be observed. Other questions to be addressed: Can Constitutional Courts have any discretionary political basis in order to create legal norms or provisions that could not be deducted from the Constitution itself. Should the Constitutional Court always act as a negative legislator? However, the Constitutional Court in Indonesia has played role as positive legislators which create dynamic of Indonesian legal development. In performing the task of reviewing the constitutionality of statutes, the Constitutional Court has created legal norms or provisions that could be deducted from the Constitution itself. <p class="card-text"><strong>Keywords:</strong> <a href="https://publications.waset.org/abstracts/search?q=constitution" title="constitution">constitution</a>, <a href="https://publications.waset.org/abstracts/search?q=court" title=" court"> court</a>, <a href="https://publications.waset.org/abstracts/search?q=law" title=" law"> law</a>, <a href="https://publications.waset.org/abstracts/search?q=rights" title=" rights"> rights</a> </p> <a href="https://publications.waset.org/abstracts/30793/constitutional-courts-as-positive-legislators-the-role-of-indonesian-constitutional-court-in-interpreting-and-applying-the-constitution" class="btn btn-primary btn-sm">Procedia</a> <a href="https://publications.waset.org/abstracts/30793.pdf" target="_blank" class="btn btn-primary btn-sm">PDF</a> <span class="bg-info text-light px-1 py-1 float-right rounded"> Downloads <span class="badge badge-light">425</span> </span> </div> </div> </div> </main> <footer> <div id="infolinks" class="pt-3 pb-2"> <div class="container"> <div style="background-color:#f5f5f5;" class="p-3"> <div class="row"> <div class="col-md-2"> <ul class="list-unstyled"> About <li><a href="https://waset.org/page/support">About Us</a></li> <li><a href="https://waset.org/page/support#legal-information">Legal</a></li> <li><a target="_blank" rel="nofollow" href="https://publications.waset.org/static/files/WASET-16th-foundational-anniversary.pdf">WASET celebrates its 16th foundational anniversary</a></li> </ul> </div> <div class="col-md-2"> <ul class="list-unstyled"> Account <li><a href="https://waset.org/profile">My Account</a></li> </ul> </div> <div class="col-md-2"> <ul class="list-unstyled"> Explore <li><a href="https://waset.org/disciplines">Disciplines</a></li> <li><a href="https://waset.org/conferences">Conferences</a></li> <li><a href="https://waset.org/conference-programs">Conference Program</a></li> <li><a href="https://waset.org/committees">Committees</a></li> <li><a href="https://publications.waset.org">Publications</a></li> </ul> </div> <div class="col-md-2"> <ul class="list-unstyled"> Research <li><a href="https://publications.waset.org/abstracts">Abstracts</a></li> <li><a href="https://publications.waset.org">Periodicals</a></li> <li><a href="https://publications.waset.org/archive">Archive</a></li> </ul> </div> <div class="col-md-2"> <ul class="list-unstyled"> Open Science <li><a target="_blank" rel="nofollow" href="https://publications.waset.org/static/files/Open-Science-Philosophy.pdf">Open Science Philosophy</a></li> <li><a target="_blank" rel="nofollow" href="https://publications.waset.org/static/files/Open-Science-Award.pdf">Open Science Award</a></li> <li><a target="_blank" rel="nofollow" href="https://publications.waset.org/static/files/Open-Society-Open-Science-and-Open-Innovation.pdf">Open Innovation</a></li> <li><a target="_blank" rel="nofollow" href="https://publications.waset.org/static/files/Postdoctoral-Fellowship-Award.pdf">Postdoctoral Fellowship Award</a></li> <li><a target="_blank" rel="nofollow" href="https://publications.waset.org/static/files/Scholarly-Research-Review.pdf">Scholarly Research Review</a></li> </ul> </div> <div class="col-md-2"> <ul class="list-unstyled"> Support <li><a href="https://waset.org/page/support">Support</a></li> <li><a href="https://waset.org/profile/messages/create">Contact Us</a></li> <li><a href="https://waset.org/profile/messages/create">Report Abuse</a></li> </ul> </div> </div> </div> </div> </div> <div class="container text-center"> <hr style="margin-top:0;margin-bottom:.3rem;"> <a href="https://creativecommons.org/licenses/by/4.0/" target="_blank" class="text-muted small">Creative Commons Attribution 4.0 International License</a> <div id="copy" class="mt-2">© 2024 World Academy of Science, Engineering and Technology</div> </div> </footer> <a href="javascript:" id="return-to-top"><i class="fas fa-arrow-up"></i></a> <div class="modal" id="modal-template"> <div class="modal-dialog"> <div class="modal-content"> <div class="row m-0 mt-1"> <div class="col-md-12"> <button type="button" class="close" data-dismiss="modal" aria-label="Close"><span aria-hidden="true">×</span></button> </div> </div> <div class="modal-body"></div> </div> </div> </div> <script src="https://cdn.waset.org/static/plugins/jquery-3.3.1.min.js"></script> <script src="https://cdn.waset.org/static/plugins/bootstrap-4.2.1/js/bootstrap.bundle.min.js"></script> <script src="https://cdn.waset.org/static/js/site.js?v=150220211556"></script> <script> jQuery(document).ready(function() { /*jQuery.get("https://publications.waset.org/xhr/user-menu", function (response) { jQuery('#mainNavMenu').append(response);
