Néhány nappal ezelőtt azonban az Alkotmánybíróság úgy foglalt állást, hogy a szuverenitásvédelmi törvénnyel, a hivatal felállításával, működésével nincsen semmilyen alapjogi probléma. Elsőként a korrupció ellen küzdő Transparency International (TI) magyarországi szervezeténél, majd az Átlátszó tényfeltáró portált működtető közhasznú nonprofit kft.-nél indítottak „egyedi – átfogó jellegű – vizsgálatot”. A hivatal azt állította, hogy ezek külföldről finanszírozott szervezetek, amik befolyásolni akarják a választást.</p> <p>A TI ezután nyújtott be alkotmányjogi panaszt, amihez további 31 civil szervezet csatlakozott. A TI szerint a szuverenitásvédelmi törvény rendelkezései sértik a véleménynyilvánítás szabadságához, a tisztességes hatósági, illetve bírósági eljáráshoz és a jogorvoslathoz való jogokat, valamint nemzetközi szerződésbe is ütköznek. A TI közleményében azt írta, hogy az Alkotmánybíróság kedvezőtlen döntése után a strasbourgi Emberi Jogok Európai Bíróságához fordul az ügyben.</p> <p>Nádori Szabót először az Alkotmánybíróság szerepéről, funkciójáról kérdezte a műsorban.</p> <p>„Az alkotmánybíráskodás az részben annak a kifejezése, hogy attól, hogy valamit törvényekbe írnak, az nem biztos, hogy jogszerű. Lehet, hogy megsérti valakiknek a jogait” – mondta Szabó, majd példaként a halálbüntetés eltörlését hozta fel, amiről az Alkotmánybíróság döntött úgy, hogy hiába szerepel a büntető törvénykönyvben, a halálbüntetés eleve ellentétes a jogrendszer alapjaival, ezért azt meg kell semmisíteni.</p> <p>Az Alkotmánybíróság bírósági ítéletek alkotmányellenességét is megállapíthatja és megsemmisítheti.</p> <p>„Ez azt jelenti, hogy a bírósági ítéletek még ha meg is felelnek a jogrendszer valamelyik szakágában lévő szabályoknak, az ottani dogmatikai feltételeknek, lehet, hogy távolabbról nézve a jogrendszer egészének nem felelnek meg és alapjogokat sértenek” – fejtette ki Szabó, hozzátéve, hogy az Alkotmánybíróság érdemben csak az Alaptörvény hatálybalépése óta foglalkozik ilyennel, korábban szinte csak jogszabályok megsemmisítésével foglalkozott.</p> <p>Szabó szerint a magyar Alkotmánybíróság nem gyakorolja megfelelően ezt a hatáskörét sem, nemcsak törvényeket nem semmisít meg szinte egyáltalán az elmúlt években, hanem rossz, alapvető jogokat sértő bírósági ítéleteket sem nagyon. Az alkotmányjogi panasznak azonban szerinte még egy rosszul működő Alkotmánybíróság esetén is van pozitív hatása. Meggyőző ereje a jogi érvelésben még így is hat a bíróságokra, még akkor is, ha valójában nem bízhatunk abban, hogy az Alkotmánybíróság meg fog semmisíteni egy alapvető jogokat sértő ítéletet.</p> <p>„Alapjogi szempontból a rendes bíróságok most sokkal jobb ítélkezést folytatnak, mint folytattak 2012 előtt, amikor még nem volt ilyen alkotmányjogi panasz Magyarországon” – mondta.</p> <p>Panaszt csak érintett nyújthat be, akinek a jogait megsértette egy bírói ítélet vagy egy törvény. A Transparency így is tett. A véleménynyilvánítás szabadságával, a tisztességes eljárással és a jogorvoslathoz való joggal kapcsolatban tettek panaszt, ám az érveiket lesöpörte az Alkotmánybíróság. Nádori kérdésére Szabó megosztotta, hogy biztos volt benne, hogy nem fognak helyt adni a panasznak. Ugyanakkor mindig meglepődik, hogy az utóbbi időben, mennyire nem akar az Alkotmánybíróság még magához képest sem következetes maradni. Egy-egy elutasító döntés mögé akár olyan indoklást tesznek, ami egy három nappal korábban hozott határozattal ellentétes.</p> <p>Szerinte az Alkotmánybíróság „mazsolázgat”, olyan mondatokat keres korábbi határozatokban, amik alátámasztják azt a döntést, amit meg akar hozni. A Transparency esetében az Alkotmánybíróság például csúsztat az indoklásában, amikor azt hozza fel érvként, hogy mivel a szuverenitásvédelmi törvény nem büntetőjogszabály, ezért nem okozhat öncenzúrát. Szabó szerint ez nem egy érvényes logikai összefüggés.</p> <p>„Valamilyen módon ezek az intézmények ilyen patyomkin intézményekként, azért mímelni akarják, hogy ők valójában azok, aminek állítják magukat” – fogalmazott.</p> <p>Ha valami nehezen lenne megmagyarázható, akkor az Alkotmánybíróság nem foglalkozik az indítványnak azon részével egyáltalán. Ezt könnyen megteheti, mivel az Alkotmánybíróság döntéseivel szemben semmiféle jogorvoslati lehetőség nincs. Ezzel szemben egy „rendes” bíróságon az ügyfélnek van lehetősége arra, hogy sérelmezze azt, hogy nem foglalkoztak az ő kérelmének valamelyik részével.</p> <p>Ettől függetlenül vannak olyan esetek, ahol Szabó véleménye szerint még mindig érdemes az Alkotmánybírósághoz fordulni. Nem csak azért, mert a mai gyakorlat szerint csak hazai jogorvoslati lehetőségek kimerítése után lehet nemzetközi bíróság elé vinni az ügyeket. Hanem mert így jogi érveket lehet becsatornázni egy közéleti vitába.
