has largely failed to deliver, wasting several hundred million euros of taxpayers' money in an effort to curb irregular migration arrivals.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">On Tuesday (25 February), on the opening day of a hearing at the European Court of Justice (ECJ) in Luxembourg aimed to unpack how EU asylum laws apply to a deal predicated on Italian premier Giorgia Meloni </span><a href=\"https://euobserver.com/migration/ar6aec9598\" target=\"_self\" rel=\"noreferrer\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">political promises to offshore asylum</span></a><span style=\"white-space: pre-wrap;\">. </span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Whatever the outcome, the impact of the final judgement may be a moot point given it is based on outdated EU asylum laws that will no longer be valid as of June next year.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">While no judgement is expected in months, the hearing dived into how current EU asylum laws define an origin country as 'safe enough' in order for Italy to quickly process protection claims.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">\"It is regrettable to find that the Italian government has betrayed these values when it comes to designation of safe countries\" said Dario Belluccio, one of the lawyers at the Luxembourg-court hearing on Tuesday, citing the principles of legality, separation of powers, and equality.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">The first-instance Court of Rome last year threw a spanner into Meloni's plans after it essentially forced authorities to suspend the fast-tracking of all asylum claims throughout the entire country, including the centres in Albania. </span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Such accelerated asylum procedures in Italy typically takes four weeks instead of the normal several months and are based on the 2013 directive. In Albania, it is less than 24-hours, says Amnesty International's Elisa de Pieri.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">\"It's obvious that the rights are being undermined, left, right and centre. And we need to work as much as possible to hold on to the safeguards that there are,\" she said.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">The Court of Rome based its decision on a separate ruling by the Luxembourg court in October, which said member states cannot designate some parts of an origin country as safe.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">But given that these same EU laws will no longer apply next year, the wider discussion taking place at the Luxembourg-based court is also puzzling — and possibly irrelevant.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">\"It might not matter what the court says now, because the wording of the regulation changed,\" says Andreina De Leo, a legal scholar at Maastricht University.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">At the heart of the matter is the EU's asylum procedure directive from 2013 and how it defines the safe country of origin, as well as broader pushes by the EU to create </span><a href=\"https://euobserver.com/migration/ar8dfd5782\" target=\"_self\" rel=\"noreferrer\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">so-called \"innovative solutions\"</span></a><span style=\"white-space: pre-wrap;\"> to asylum.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Italy has been at pains of trying to send people from its centres in Albania back to their home countries of origin. And before those centres became operational, Italy had expanded its list of safe countries of origin. </span></p><h2 class=\"rte-h2\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Where — and who — are 'safe'?</span></h2><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Some had been deemed safe except for specific \"at-risk groups\" — such as LGBTIQ+ individuals, victims of female genital mutilation, and human rights defenders.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Such exceptions are not allowed in the 2013 directive, meaning that EU law requires the entire country be safe for everyone. </span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Specifically, the directive says an origin country can only be safe if it is generally and uniformly free from persecution, torture, or inhuman treatment, including harm caused by conflict.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">That basically tosses out any possibility of territorial exceptions, as carved out by Meloni's decree on safe countries, which had designated some parts of Egypt and Bangladesh as safe.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">While territorial exceptions are not possible, judges at Tuesday's hearing need to clarify if exceptions based on certain categories of people are allowed. </span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Italy claims both Egypt and Bangladesh as safe for some categories of people, posing questions on whether the Luxembourg-court's ruling last October even applies.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">But next year, new rules also come into force and the 2013 directive will no longer be on the books. </span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">It also means the wording on safe countries of origin will have changed, as defined in the new asylum procedures regulation. href=\"https://blogs.law.ox.ac.uk/border-criminologies-blog/blog-post/2025/01/europes-digital-border-wars-how-eus-facilitation\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">unchecked expansion</span></a><span style=\"white-space: pre-wrap;\"> of </span><a href=\"https://www.statewatch.org/analyses/2024/putting-the-cart-before-the-horse-the-commission-s-proposal-to-increase-europol-s-powers/\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">power and resources</span></a><span style=\"white-space: pre-wrap;\"> for Europol, the EU’s policing agency, at the expense of those they claim to protect.</span></p><p class=\"rte-p\" dir=\"ltr\" style=\"text-align: justify;\"><span style=\"white-space: pre-wrap;\">The regulation has fallen at the first hurdle — with the Council </span><a href=\"https://www.statewatch.org/news/2024/may/europol-migrant-smuggling-proposal-torn-to-shreds-by-the-council/\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">tearing the proposal to shreds</span></a><span style=\"white-space: pre-wrap;\"> and the European Parliament </span><a href=\"https://www.europarl.europa.eu/thinktank/en/document/EPRS_STU(2025)765777\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">set to follow suit</span></a><span style=\"white-space: pre-wrap;\">.</span></p><p class=\"rte-p\" dir=\"ltr\" style=\"text-align: justify;\"><span style=\"white-space: pre-wrap;\">The commission is framing these proposals as a humanitarian effort to “curb exploitation” by “ruthless smuggling gangs”, but this disguises a more insidious reality. </span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">The reform hinges on the flawed premise that ‘smugglers’ pose the greatest risk to people on the move and that increased police powers and mass data collection will ensure ‘protection’.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">In truth, this approach fuels harm and discrimination while granting the EU’s agencies like Europol and Frontex unprecedented surveillance capabilities with insufficient oversight.</span></p><p class=\"rte-p\" dir=\"ltr\" style=\"text-align: justify;\"><span style=\"white-space: pre-wrap;\">Ursula von der Leyen’s </span><a href=\"https://www.youtube.com/watch?v=1_vI0NKG3dQ\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">speech</span></a><span style=\"white-space: pre-wrap;\"> and the commission’s documents on the package reference deaths at sea, </span><a href=\"https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A52023PC0755\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">blaming “smugglers”</span></a><span style=\"white-space: pre-wrap;\"> for the death toll of over 28,000 people since 2014, citing International Organization for Migration (IOM) data. </span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">However, the IOM itself </span><a href=\"https://missingmigrants.iom.int/region/mediterranean\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">highlights</span></a><span style=\"white-space: pre-wrap;\"> “gaps in search-and-rescue capacity and restrictions on the life-saving work of NGOs” as key contributing factors — conveniently ignored in the commission’s interpretation. </span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">A </span><a href=\"https://www.unhcr.org/media/journey-no-one-cares-if-you-live-or-die-abuse-protection-and-justice-along-routes-between-1\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">recent UN report</span></a><span style=\"white-space: pre-wrap;\"> found that state authorities, including police and border guards, are often the main perpetrators of violence against people on the move, not ‘smugglers’.</span></p><p class=\"rte-p\" dir=\"ltr\" style=\"text-align: justify;\"><span style=\"white-space: pre-wrap;\">The EU’s own hostile border and migration policies force people into life-threatening situations. </span><a href=\"https://www.msf.org/eu-migration-policies-are-killing-people-sea-greece\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">Deaths at sea</span></a><span style=\"white-space: pre-wrap;\">, and </span><a href=\"https://www.routedmagazine.com/care-counteraction-border-deaths\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">on land</span></a><span style=\"white-space: pre-wrap;\">, result from a lack of safe, regular pathways into the EU. Instead of addressing these root causes, the commission is doubling down on a failed approach, empowering agencies and criminalising movement and solidarity. This will push people into even more dangerous routes, while authorities committing abuses continue to operate with impunity.</span></p><h2 class=\"rte-h2\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Expanding Europol data collection</span></h2><p class=\"rte-p\" dir=\"ltr\" style=\"text-align: justify;\"><span style=\"white-space: pre-wrap;\">The proposed reform significantly impacts digital and migrants rights by expanding Europol’s data collection on people on the move. </span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">New rules would require national law enforcement authorities to share all data related to ‘migrant smuggling’ with Europol. </span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Historically, it has been notoriously difficult to access personal data by Europol, even for </span><a href=\"https://www.fairtrials.org/articles/news/fair-trials-welcomes-a-decision-by-the-european-data-protection-supervisor-edps-ordering-europol-to-hand-over-personal-data-to-dutch-activist-frank-van-der-linde/\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">activists</span></a><span style=\"white-space: pre-wrap;\"> and </span><a href=\"https://www.opendemocracy.net/en/beyond-trafficking-and-slavery/greece-accused-me-of-espionage-i-was-helping-people-theyd-violated-migrants-turkey-border/\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">human rights defenders</span></a><span style=\"white-space: pre-wrap;\"> from the Global North. The impact on racialised migrant populations will be even more severe.</span></p><p class=\"rte-p\" dir=\"ltr\" style=\"text-align: justify;\"><span style=\"white-space: pre-wrap;\">This mass data collection contradicts established data protection standards, </span><a href=\"https://www.edps.europa.eu/system/files/2024-01/2023-1247_d0187_opinion_en.pdf\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">raising red flags</span></a><span style=\"white-space: pre-wrap;\"> from the EU’s data protection watchdog. Additionally, we can expect these vast datasets will be analysed by AI algorithms too, which are known to be racist and discriminatory, to ‘produce knowledge’ on migration. Information derived from such models could be used to justify increased policing forces to border regions, leading to more pushbacks, violence and deaths.</span></p><p class=\"rte-p\" dir=\"ltr\" style=\"text-align: justify;\"><span style=\"white-space: pre-wrap;\">In the end, who profits from all this? Not people on the move, not those in solidarity with them, but </span><a href=\"https://borderviolence.eu/reports/executive-summary-surveillance-technologies-at-european-borders/\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">private industries</span></a><span style=\"white-space: pre-wrap;\"> and </span><a href=\"https://www.statewatch.org/publications/reports-and-books/europe-s-techno-borders/\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">research institutions</span></a><span style=\"white-space: pre-wrap;\"> receiving EU funding to develop surveillance technologies.</span></p><p class=\"rte-p\" dir=\"ltr\" style=\"text-align: justify;\"><span style=\"white-space: pre-wrap;\">Compounding these concerns, the commission sidestepped key democratic safeguards in its proposal. The required impact assessment, meant to evaluate the implications of EU action - notably on fundamental rights, was conspicuously absent. This omission, which UN Special Rapporteur Mary Lawlor called </span><a href=\"https://srdefenders.org/resource/position-paper-on-the-eu-commissions-proposed-directive-to-update-the-eu-legal-framework-on-people-smuggling/\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">“shocking”</span></a><span style=\"white-space: pre-wrap;\">, undermines transparency and accountability in policymaking.</span></p><p class=\"rte-p\" dir=\"ltr\" style=\"text-align: justify;\"><span style=\"white-space: pre-wrap;\">Europol's history of overreach is </span><a href=\"https://edri.org/our-work/resist-europol-document-pool/\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">well-documented</span></a><span style=\"white-space: pre-wrap;\">. Reforms in 2016 and 2022 steadily increased its powers, allowing the agency to amass vast amounts of personal data with minimal oversight. </span></p><p class=\"rte-p\" dir=\"ltr\" style=\"text-align: justify;\"><span style=\"white-space: pre-wrap;\">The 2023 proposal goes even further, expanding cooperation between Europol and Frontex, the EU border agency infamous for </span><a href=\"https://www.euronews.com/2023/03/28/a-collapse-of-the-rule-of-law-how-does-frontex-get-away-with-plain-murder\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">human rights violations</span></a><span style=\"white-space: pre-wrap;\">. It would allow Europol agents to be seconded into Frontex teams. </span></p><p class=\"rte-p\" dir=\"ltr\" style=\"text-align: justify;\"><span style=\"white-space: pre-wrap;\">Currently, Frontex cannot share migrants’ data with Europol en-masse. </span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">However, both agencies attempted to circumvent this restriction with the 2015 PeDRA project (‘Processing of Personal Data for Risk Analysis). This effort to conduct mass surveillance of migrants stalled following an </span><a href=\"https://balkaninsight.com/2022/07/07/eus-frontex-tripped-in-plan-for-intrusive-surveillance-of-migrants/\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">investigation</span></a><span style=\"white-space: pre-wrap;\"> and </span><a href=\"https://www.edps.europa.eu/press-publications/press-news/press-releases/2025/edps-reprimands-frontex-non-compliance-regulation-eu-20191896_en\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">scrutiny</span></a><span style=\"white-space: pre-wrap;\"> from the EU’s Data Protection Supervisor. The new Europol Regulation risks creating a legal framework for enhanced data-sharing between Europol and Frontex, sidestepping previous challenges.</span></p><h2 class=\"rte-h2\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Security, Europe!</span></h2><p class=\"rte-p\" dir=\"ltr\" style=\"text-align: justify;\"><span style=\"white-space: pre-wrap;\">Under the current Polish EU Council presidency, \"Security, Europe!\" has been touted as a guiding motto, with new EU migration commissioner Magnus Brunner declaring it a </span><a href=\"https://euobserver.com/migration/ar52e4450e\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">“fundamental right”</span></a><span style=\"white-space: pre-wrap;\">. external border, the less pressure we have on the internal border. Without any question,\" said commission president Ursula von der Leyen, last month </span><a href=\"https://euobserver.com/*/ar9947fa31\" target=\"_self\" rel=\"noreferrer\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\">alongside Poland's prime minister Donald Tusk</span></a><span style=\"white-space: pre-wrap;\">.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">The commission has since 2015 been unable to convince member states to lift the internal border checks, once deemed an existential threat to the European Union.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Whatever the motives, the pushbacks are now said to be an unofficial part of EU migration policy, amid token legislative gestures that seek to preserve asylum rights as authorities use the threat of hostile states like Belarus to in fact deny people access to those rights.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Many have died. Only last December,</span><a href=\"https://euobserver.com/migration/ar66403851\" target=\"_self\" rel=\"noreferrer\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\"> three teenage boys from Egypt</span></a><span style=\"white-space: pre-wrap;\"> were found dead in the forests in Bulgaria after crossing in from Turkey. Activists says their rescue attempts had been thwarted by the Bulgarian border police— which the police deny.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">The same authorities report that 52,500 people volunteered to return to Turkey with help by the Bulgarian border police. But given the often-alleged violence from police, the vast majority of volunteer returns are also likely pushbacks, notes the report.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">\"In 2024, there were reports of people in critical health conditions sending distress alerts, only to be violently pushed back instead of receiving medical aid,\" says the report.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">EUobserver</span><a href=\"https://euobserver.com/migration/are967d08b\" target=\"_self\" rel=\"noreferrer\" class=\"rte-link\"><span style=\"white-space: pre-wrap;\"> last year revealed that Bulgarian authorities</span></a><span style=\"white-space: pre-wrap;\"> were pressuring the EU's border police Frontex not to report on abuse in exchange to preferential access to people attempting to enter the country irregularly.</span></p><p class=\"rte-p\" dir=\"ltr\"><span style=\"white-space: pre-wrap;\">Similar trends of reported abuse and illegal pushbacks elsewhere in the EU have often gone unchallenged, with the exception of Hungary.
