The action was the result of the school being terminated from the National School Lunch Program in the spring.</p><p>The initial appeal, which was due Wednesday, will go to agency staff for examination and then a decision by Education Commissioner Michael Williams. That’s expected to take about a month.</p><p>In the appeal letter, Prime Prep’s attorney, Darren G. Gibson, wrote that recent changes in leadership put the school in a “strong position to continue its mission, and revocation of the charter and shutting down the school would only harm the students and prevent them from receiving the quality education they deserve.”</p><p>“In the United States of America, murderers, robbers, thieves, you name it, they all get a second chance,” Superintendent Ron Price said. “All I'm asking is for TEA to give the children of Prime Prep a second chance.”</p><p>The appeal letter said the board is “dedicated to providing 100 percent of the student population with nutritious meals, regardless of whether the school is participating in federally funded school lunch programs.”</p><p>Gibson also wrote that financial supporters had committed to covering the cost of school meals for the upcoming year. The letter provided no details about those commitments.</p><p>The letter also boasted about some of Prime Prep’s successes, including a 95 percent high school attendance rate, 100 percent graduation rate and a program allowing students to take community college classes in the summer. The school also noted that students from last year’s and this year’s graduating classes had received 15 scholarships. There was no breakdown of how many were academic and how many were athletic scholarships.</p><p>The appeal request also emphasized that the school’s problems were the result of actions by administrators no longer employed there. Many of the school’s problems have been attributed to the management of D.L. Wallace, who co-founded the school with ex-NFL star Deion Sanders.</p><p>Neither is currently employed at Prime Prep.</p><p>But as a last resort, Gibson urged the TEA to consider the option of reconstituting the governing board or transferring the operations to another charter school operator.</p><p>If Prime Prep loses its appeal, it could make its case to the State Office of Administrative Hearings. That process could take several months and potentially extend into the spring semester.</p><p>Also on Wednesday, the school received good news from a federal judge in a pending lawsuit against Prime Prep.</p><p>U.S. District Judge Barbara Lynn set aside a previous default ruling against the school. The default came after Prime Prep failed to respond to the lawsuit’s claims. The school’s attorney argued that Prime Prep wasn’t correctly served with the lawsuit and wasn’t obligated to respond. Lynn agreed.</p><p>“The court ruling validates what we’ve been saying from the start,” Price said. “The new administration is following all the rules and regulations. … Hopefully, this will signal a good message to the Texas Education Agency.”</p><p>That default was cited as one reason Prime Prep was terminated from the lunch program. The Texas Department of Agriculture also found dozens of problems with the program this year. The agency report said that many of the problems were the same as those found in a 2012 review.</p><p>The judge’s decision won’t get Prime Prep immediately back into the meal program.
