all levels of governance, ranging from local to global, public to corporate or financial sectors. In all these areas, its mismanagement could lead to the distortion of decision-making processes, corrosion of trust and the weakening of administration. According to Professor Peters, an expert in the area, conflict of interest, a problem at the root of many scandals has “become a pervasive ethical concern in our professional, organisational, and political life”. Conflicts of interest corrode trust, and like in the public sector, trust is mandatory for the market, consumers/clients, shareholders and other stakeholders in the private sector. However, conflicts of interest in the private sector are distinct and must be treated in like manner when regulatory efforts are made to address them. The research looks at identifying conflicts of interest in the private sector and differentiating them from those in the public sector. The public interest is submitted as a criterion which allows for such differentiation. This is significant because it would for the use of tailor-made or sector-specific approaches to addressing this complex issue. This is conducted through extensive review of literature and theories on the definition of conflicts of interest. This study will employ theoretical, doctrinal and comparative methods. The nature of conflicts of interest in the private sector will be explored, through an analysis of the public sector where the notion of conflicts of interest appears more clearly identified, reasons, why they are of business ethics concern, will be advanced, and then, once again, looking at public sector solutions and other solutions, the study will identify ways of mitigating and managing conflicts in the private sector. An exploration of public sector conflicts of interest and solutions will be carried out because the typologies of conflicts of interest in both sectors appear very similar at the core and thus, lessons can be learnt with regards to the management of these issues in the private sector. Conflicts of interest corrode trust, and like in the public sector, trust is mandatory for the market, consumers/clients, shareholders and other stakeholders in the private sector. This research will then focus on some specific challenges to understanding and identifying conflicts of interest in the private sector; origin, diverging theories, the psychological barrier to the definition, similarities with public sector conflicts of interest due to the notions of corrosion of trust, ‘being in a particular kind of situation,’ etc. The notion of public interest will be submitted as a key element at the heart of the distinction between public sector and private sector conflicts of interests. It will then be proposed that the appreciation of the notion of conflicts of interest differ according to sector, country to country, based on the public interest test, using the United Kingdom (UK), the United States of America (US), France and the Philippines as illustrations.
Keywords: conflicts of interest, corporate governance, global governance, public interest
Procedia PDF Downloads 401

4433 The Management of Company Directors Conflicts of Interest in Large Corporations and the Issue of Public Interest

Authors: Opemiposi Adegbulu

Abstract:
The research investigates the existence of a public interest consideration or rationale for the management of directors’ conflicts of interest within large public corporations. This is conducted through extensive literature review and theories on the definition of conflicts of interest, the firm and purposes of the fiduciary duty of loyalty under which the management of these conflicts of interest find their foundation. Conflicts of interest is an elusive, diverse and engaging subject, a cross-cutting problem of governance which involves all levels of governance, ranging from local to global, public to corporate or financial sectors. It is a common issue that affects corporate governance and corporate culture, having a negative impact on the reputation of corporations and their trustworthiness. It is clear that addressing this issue is imperative for good governance of corporations as they are increasingly becoming and are powerful global economies with significant power and influence in the society. Similarly, the bargaining power of these powerful corporations has been recognised by international organisations such as the UN and the OECD. This is made evident by the increasing calls and push for greater responsibility of these corporations for environmental and social disasters caused by their corporate activities and their impact in various parts of the world. Equally, in the US, the Sarbanes-Oxley Act like other legislation and regulatory efforts made to manage conflicts of interest linked to corporate governance, in many countries indicates that there is a (global) public interest in the maintenance of the orderly functioning of commerce. Consequently, the governance of these corporations is tremendously pivotal to the society as it touches upon a key aspect of the good functioning of society. This is because corporations, particularly large international corporations can be said to be the plumbing of the global economy. This study will employ theoretical, doctrinal and comparative methods. The research will make use largely of theory-guided methodology and theoretical framework – theories of the firm, public interest, regulation, conflicts of interest in general, directors’ conflicts of interest and corporate governance. Although, the research is intended to be narrowed down to the topic of conflicts of interest in corporate governance, the subject of company directors’ duty of loyalty and the management of conflicts of interest, an examination of the history, origin and typology of conflicts of interest in general will be carried out in order to identify some specific challenges to understanding and identifying these conflicts of interest; origin, diverging theories, psychological barrier to definition, similarities with public sector conflicts of interest due to the notions of corrosion of trust, the effect on decision-making and judgment, “being in a particular kind of situation”, etc. The result of this research will be useful and relevant in the identification of the rationale for the management of directors’ conflicts of interest, contributing to the understanding of conflicts of interest in the private sector and the significance of public interest in corporate governance of large corporations.
Keywords: conflicts of interest, corporate governance, corporate law, directors duty of loyalty, public interest
Procedia PDF Downloads 367

4432 Prospect for Peace: Criticism to Over-Focusing on Religion in Conflicts

Authors: Leyi Wang

Abstract:
The effect of religion on conflicts is usually over-focused. Religion is not the root cause of conflicts. There are always social, political or economic factors pushing the acceleration of conflicts. Meanwhile, the charisma of religion on calling for adherents is often utilized by political leaders as a tool of providing legitimacy to the initiating of violence and mobilizing the public during conflicts. What people identify from the connections between religion and conflicts is fake. There are some strategies used by politicians to upgrade the conflicts into violence. Consequently, there are some assumptions of which try to limit the religion’s effects on accelerating conflicts. This essay aims to discuss the roles of religion in international relations and argues that the religion difference is not the real source of conflicts in the globe, by reviewing the relevant literature for understanding the research background and gap of this topic. But, in the case of Association of Southeast Asian Nations (ASEAN) for a long time, the members have witnessed conflicts, small and large. These conflicts, as a result, have given catastrophic outcomes, such as killings and destroying properties. For the resolution of such conflicts, nonetheless, efforts likewise have been made, simultaneously, in terms of establishing peace and security. In this background, the ASEAN presents a significant example as before it had faced several wars, like Vietnam War, Cambodia conflicts, and so on. This research paper, therefore, strives to examine the ASEAN as a case with the help of both primary and secondary sources. It likewise will be dealt with how changing norms and identity building facilitate the ASEAN countries to deal with their conflicts both internal and external. This paper also will discuss how internal developments within countries affect conflict resolution process as each member of ASEAN is guided by its national interest. It is then argued that conflict resolution in the ASEAN is moving from its existing power-based solution to norms and identity-based solution as member countries have become more dependent on other countries. The research, therefore, is concluded by saying that the conflicts could only be resolved through building norms and common identities, which of course are recognized crucial mechanisms among the ASEAN countries with some exceptions.
Keywords: ASEAN, conflict resolution, norms and identities, peace and security
Procedia PDF Downloads 207

4430 Growing Acts of Terrorism in Local Conflicts: A Dire Need for International Attention

Authors: Yusuf Abubakar Mamud

Abstract:
Highlighting the imperatives of local conflicts considering the dangerous dimensions of terrorism they are assuming in Africa has not attracted serious academic and political attention. The discourse about conflict in Africa was discussed within five identified conflict zones in the continent. The threats from these local conflicts are diverse and complex and the acts of terrorism in these local conflicts are driven by certain attitudes and behaviours linked to the African leadership. The paper examined and noted that the current conflict resolution model of the African Union (AU) was robust with requisite institutions to address the trends in local conflicts. However, it was observed that the AU peace and security framework lacked the requisite structural and technical capabilities to proactively address the drivers of local conflicts in Africa. It was found that the persistence of local conflicts in the African region may deny her the opportunities of achievement of the targets envisioned in the Sustainable Development Goals (SDGs). Consequently, the paper called on the international community to support Africa through provision of capacity. It urged the African leaders themselves to develop the political will to ensure that all issues concerning peace and security in the continent were guided by the provisions of the AU Constitutive Act. The need to strengthen the APRM in the light of the current trends in local conflicts was also highlighted.
Keywords: conflicts, local conflicts, terrorism, sustainable development
Procedia PDF Downloads 276

4429 Conflicts and Their Resolutions through Peace-Building: A Roadmap to Africa's Development

Authors: Samuel Omachi

Abstract:
Since the creation of man, conflicts have remained a part and parcel of the society in spite of all measures adopted to keep them away. Conflicts are globally recognized as impediments of sustainable development and therefore regarded as undesirable, yet they are inevitable. However, some political leaders are better managers of conflicts than others. Those that manage conflicts poorly are backward and far from achieving economic development while efficient managers excel. The states in Africa fall into the category of poor managers of conflicts. Consequently, African continent has gained the notoriety of being the most crisis-ridden and poverty-stricken continent in the world in spite of her enormous resource endowment status. This problematic provided the compelling need for the discourse in the present study. Using the documentary analytical method, the paper x-rays the sources of conflicts, their effects and resolutions through peace education to allow room for economic development. The study concluded that African leaders needed to imbibe the culture of good governance with a key plank of peace building as a sine-qua-non for breaking the jinx that has tied the continent down to enable her catch up with her contemporaries in other parts of the competitive world.
Keywords: conflicts, resolutions, peace-building, development
Procedia PDF Downloads 282

4428 Conflicts and Similarities among Energy Law, Environmental Law and Economic Aspects

Authors: Bahareh Arghand, Seyed Abbas Poorhashemi, Ramin Roshandel

Abstract:
Nowadays, Economic growth and the increasing use of fossil fuel have caused major damages to environment. Therefore, international law has tried to codify the rules and regulations and identify legal principles to decrease conflict of interests between energy law and environmental law. The open relationship between energy consumption and the law of nature has been ignored for years, because the focus of energy law has been on an affordable price of a reliable supply of energy; while the focus of environmental law was on protection of the nature. In fact, the legal and overall policies of energy are based on Sic Omnes and inter part for governments whereas environmental law is based on common interests and Erga Omnes. The relationship between energy law, environmental law and economic aspects is multilateral, complex and important. Moreover, they influence each other. There are similarities in the triangle of energy, environment and economic aspects and in some cases there are conflict of interest but their conflicts are in goals not in practice and their legal jurisdiction is in international law. The development of national and international rules and regulations relevant to energy-environment has been done by separate sectors, whereas sustainable development principle, especially in the economic sector, requires environmental considerations. It is an important turning point to integrate and decrease conflict of interest among energy law, environmental law and economic aspects. The present study examines existing legal principles on energy and the environment and identifies the similarities and conflicts based on the descriptive-analytic study. The purpose of investigating these legal principles is to integrate and decrease conflict of interest between energy law and environmental law.
Keywords: energy law, environmental law, erga omnes, sustainable development
Procedia PDF Downloads 382

4427 Investigating the Vehicle-Bicyclists Conflicts using LIDAR Sensor Technology at Signalized Intersections

Authors: Alireza Ansariyar, Mansoureh Jeihani

Abstract:
Light Detection and Ranging (LiDAR) sensors are capable of recording traffic data including the number of passing vehicles and bicyclists, the speed of vehicles and bicyclists, and the number of conflicts among both road users. In order to collect real-time traffic data and investigate the safety of different road users, a LiDAR sensor was installed at Cold Spring Ln – Hillen Rd intersection in Baltimore City. The frequency and severity of collected real-time conflicts were analyzed and the results highlighted that 122 conflicts were recorded over a 10-month time interval from May 2022 to February 2023. By using an innovative image-processing algorithm, a new safety Measure of Effectiveness (MOE) was proposed to recognize the critical zones for bicyclists entering each zone. Considering the trajectory of conflicts, the results of the analysis demonstrated that conflicts in the northern approach (zone N) are more frequent and severe. Additionally, sunny weather is more likely to cause severe vehicle-bike conflicts.
Keywords: LiDAR sensor, post encroachment time threshold (PET), vehicle-bike conflicts, a measure of effectiveness (MOE), weather condition
Procedia PDF Downloads 236

4426 Human Rights Violations and the Inability of International Law to Solve Them

Authors: Amin Osama Amin Mohamed Elbaramawy

Abstract:
In the last period of time, about ten years ago, wars caused violations of human rights in many places, and despite international condemnations, they did not stop, and the truth is that international law was unable to stop them. Indeed, Africa political environment is characterized by a multiplicity of threats to peace and security. Africa's leading drivers of conflict include abundant (especially mineral) resources, personal rule and attendant political authoritarianism, manipulation of identity politics across ethnicity, marginalization of communities, as well as electoral mal-practices resulting in contested legitimacy and resultant violence. However, the character of armed conflicts in Africa is changing. This paper attempts to reconstruct the trajectory of armed conflicts in Africa and explain the changing pattern of armed conflict. The paper contends that large scale political violence in Africa is on the decline rendering the endemic thesis an inappropriate paradigm in explaining political conflicts in Africa. The paper also posits that though small scale conflicts are springing up and exhibiting trans-border dimensions, these patterns of armed conflicts are not peculiar to Africa but emerging waves of global conflicts. The paper explains that the shift in the scale of warfare in Africa is a function of a multiplicity of post-cold war global contradictions. Inclusive governance, social justice and economic security are articulated as workable panaceas for mitigating warfare in Africa.
Keywords: Africa, conflicts, pattern, war
Procedia PDF Downloads 387

4424 Preventing Farmer-Herder Conflicts in Ghana: A Constellation of Local Strategies and Solutions

Authors: Abdulai Abubakari

Abstract:
The rollercoaster relationship between farmers and herders in Sub-Saharan Africa has compelled most governments to undertake different mitigating strategies. Over the past two decades, the expulsion of migrant herdsmen, the killing of cattle and human beings, and fines have been used by the state and aggrieved individuals to resolve the conflicts. Unlike this paper, most of the research conducted on this subject matter has been largely theoretical and lacks practical solutions to the conflicts. This paper is unique because it focuses on concrete strategies and practical solutions to ending the century-old phenomenon of farmer-herder conflicts in Ghana. The paper employed power or compete (fight) theory as well as compromise and negotiation theories in the analyses. The paper employed, basically, socio-anthropological methods: interviews, focus group discussions, and observations to gather data. The paper found that compromises through negotiation with the stakeholders are the best ways of resolving these conflicts. Through this, we support the compromise and negotiation approach rather than expulsion to resolve farmer-herder conflicts.
Keywords: farmer-herder, conflict, prevention, strategies, stakeholders
Procedia PDF Downloads 54

4423 Power-Sharing Politics: A Panacea to Conflict Resolution and Stability in Africa

Authors: Emmanuel Dangana Monday

Abstract:
Africa as a continent has been ravaged and bedeviled by series of political conflicts associated with politics and power-sharing maneuvering. As a result it has become the most unstable continent in the world in terms of power distribution and stable political culture. This paper examines the efficacy of conscious and deliberate power-sharing strategies to settle or resolve political conflicts in Africa in the arrangements of creation of states, revenue and resources allocation, and office distribution systems. The study is concerned with the spatial impact of conflicts generated in some renowned African countries in which power-sharing would have been a solution. Ethno-regional elite groups are identified as the major actors in the struggles for the distribution of territorial, economic and political powers in Africa. The struggle for power has become so intense that it has degenerated to conflicts and wars of inter and intra-political classes and parties respectively. Secondary data and deductive techniques were used in data collection and analysis. It is discovered that power-sharing has become an indispensable tool to curb the incessant political and power crisis in Africa. It is one of the finest tolerable modality of mediating elite’ competition, since it reflects the interests of both the dominant and the perceived marginalized groups. The study recommends that countries and regions of political, ethnic and religious differences in Africa should employed power-sharing strategy in order to avoid unnecessary political tension and resultant crisis. Interest groups should always come to the negotiation table to reach a realistic, durable and expected compromise to secure a peacefully resolute Africa.
Keywords: Africa, power-sharing, conflicts, politics and political stability
Procedia PDF Downloads 325

4422 Armed Groups and Intra State Conflict: A Study on the Egyptian Case

Authors: Ghzlan Mahmoud Abdel Aziz

Abstract:
This case study aims to identify the intrastate conflicts between the nation state and armed groups. Nowadays, most wars weaken states against armed groups. Thus, it is very important to negotiate with such groups in order to reinforce the law for the protection of victims. These armed groups are the cause of conflicts and they are related with many of humanitarian issues that result out of conflicts. In this age of rivalry; terrorists, insurgents, or transnational criminal parties have surfaced to the top as a reaction to these armed groups in an effort to set up a new world order. Moreover, the intra state conflicts became increasingly treacherous than the interstate conflicts, particularly when nation state systems deal with armed groups which try to influence the state. The unexpected upraising of the Arab Spring during 2011 in parts of the Middle East and North Africa formed various patterns of conflicts. The events of the Arab Spring resulted in current and long term change across the region. Significant modifications in the level, strength and period of armed conflict around the world have been made. Egypt was in the center of these events. It has fought back the armed groups under the name of terrorism and spread common disorder and violence among civilians. On this note, this study focuses on the problem of the transformation in the methods of organized violence within one state rather than between two state or more and analyzes the objectives, strategies, and internal composition of armed groups and the environments that foster them, with a focus on the Egyptian case.
Keywords: armed groups, conflicts, Egyptian armed forces, intrastate conflicts
Procedia PDF Downloads 459

4421 Conflicts Identification Approach among Stakeholders in Goal-Oriented Requirements Analysis

Authors: Muhammad Suhaib

Abstract:
Requirements Analysis are the most important part of software Engineering for both system application development, and project requirements. The study aimed (1) To determine the trend and nature of human-tiger conflicts (2) To understand people's perception and mitigation measures towards tiger conservation. Both primary and secondary information were used to determine human- tiger conflicts in Chitwan National Park. Systematic random sampling with 5% intensity was done to collect the perception of the villagers regarding human-tiger conflicts. The study sites were selected based on frequencies of incidences of human attacks and livestock depredation viz. Rajahar and Ayodhyapuri VDCs respectively. The trend of human casualties by tiger has increased in last five year whereas the trend of livestock has decreased. Reportedly, between 2008 and 2012, tigers killed 22 people, injured 10 and killed at least 213 livestock. Conflict was less common in the park and more intense in the sub-optimal habitats of Buffer Zone. Goat was the most vulnerable livestock followed by cattle. The livestock grazing and human intrusion into tiger habitat were the causes of conflicts. Developing local stewardship and support for tiger conservation, livestock insurance, and compensation policy simplification may help reduce human-tiger conflicts.
Keywords: livestock depredation, sub optimal habitat, human-tiger, local stewardship
Procedia PDF Downloads 463

4419 Human-Wildlife Conflicts in Urban Areas of Zimbabwe

Authors: Davie G. Such is the case with urban areas in Zimbabwe, yet little has been documented about it. This study was done to provide insights into the occurrence of human-wildlife conflicts in urban areas. The study was carried out in Harare, Bindura, Masvingo, Beitbridge, and Chiredzi to determine the cause, nature, extent, and frequency of occurrence of HWC, to determine the key wildlife species involved in conflicts and management practices done to combat wildlife conflicts in these areas. Several sampling techniques encompassing multi-stage sampling, stratified random, purposive, and simple random sampling were employed for placing residential areas into three strata according to population density, selecting residential areas, and selecting actual participants. Data were collected through a semi-structured questionnaire and key informant interviews. The results revealed that property destruction and crop damage were the most prevalent conflicts. Of the 15 animals that were cited, snakes, baboons, and monkeys were associated with the most conflicts. The occurrence of HWCs was mainly attributed to the increase in both animal and human populations. To curtail these HWCs, the local people mainly used non-lethal methods, whilst lethal methods were used by authorities for some of the reported cases. The majority of the conflicts were seasonal and less severe. There were growing concerns by respondents on the issues of wildlife conflicts, especially in those areas that had primates, such as Warren Park in Harare and Limpopo View in Beitbridge. There are HWCs hotspots in urban areas, and to ameliorate this, suggestions are that there is a need for a multi-action approach that includes general awareness campaigns on HWCs and land use planning that involves the creation of green spaces to ease wildlife management.
Keywords: human-wildlife conflicts, mitigation measures, residential areas, types of conflicts, urban areas
Procedia PDF Downloads 67

4418 Understanding the Nature of Conflicts in Africa: Analytical and Theoretical Explanations

Authors: Kingfahd Adewale Adedapo, Adekunle Ajisebiyawo

Abstract:
The focus of this paper is to explore the different theoretical perspectives that underline academic attempts at understanding and explaining the nature of conflicts in Africa. The African environment is riddled with the past history of conflicts among groups either for an economic outlet or imperial space, and most often, such past negative interactions have made it difficult even now for some of these groups to live harmoniously together within the present state system and to trust each other. The paper observed that no one theory or explanatory schema could offer a holistic explanation of conflict in Africa. At best, each of the possible theories can only offer a partial explanation of the causes and nature of conflict in a particular African society or state. This paper, therefore, attempted to synthesize the many sources of theories of conflicts and provided the intellectual background from which these different theories emanated. Therefore, if this paper has done anything at all, it is to offer the basis for assessing different theoretical strands aimed at offering cogent and reliable explanations for most of the conflicts in Africa and especially in the West African sub-region.
Keywords: conflict, functionalism, humanitarianism, structuralism, theory
Procedia PDF Downloads 104

4417 TRIZ-Based Conflicts-Solving Applications in New Product Development (NPD) Process and Knowledge Management (KM) System

Authors: Chi-Hao Yeh

Abstract:
The aim of this paper is to show how to apply TRIZ to resolve conflicts in management area, which can be readily applied in new product development (NPD) process and Knowledge Management (KM) system in desinging and manfacturing stages. However, few studies and practical usage were proposed in management area. Conflicts occurring including schedule, budget, and risk plannings at smart phone R&D process are discussed to demonstrate the ideas guided by 39 TRIZ management parameters, 40 TRIZ innovative principles, and contradiction matrix. The results show that TRIZ is able to provide direct, quick and effective alternatives to resolve the management conflicts. In this manner, huge effort and cost can be actually saved and practical experince can be stored in KM system. Both farmers and pastoralists suffered losses in the form of injuries to, and even death of household members, and loss of shelter. Farmers sustained losses of facilities and farm produce while pastoralists suffered loss and seizure of livestock, arrest of household members and forced migrations. The material losses in monetary terms amounted to 14,242,200.00 nairas for farmers, a figure higher than the 10,915,500.00 nairas incurred by pastoralists.
Keywords: cost, conflicts, farmers, pastoralists
Procedia PDF Downloads 265

4415 The Feasibility of Ratification of the United Nation Convention on Contracts for International Sale of Goods by Islamic Countries, Saudi Arabia as a Case

Authors: Ibrahim M. Sales of goods contracts are one of the most common business transaction in the world. This commercial exchange has faced many obstacles. One of the most concerned obstacles is the conflicts between laws. Thus, United Nation created a Convention on Contracts for the International Sale of Goods (CISG). Some of Islamic countries have ratified the CISG, while other Islamic countries have concerns about the feasibility of ratification of the CISG, and many businessmen have a concern of application of the convention. The concerns related to the conflict between CISG and Sharia, and the long debate about the success, ambiguity, and stability of the CISG. Therefore, this research will examine the feasibility of Muslim countries and Muslim businessmen to adopt the CISG by following steps: First, this research will introduce sharia Law (Islamic contracts law) and CISG and provide backgrounds of both laws. Second, this research will compare the provisions of CISG and Sharia and figuring out the conflicts and provide possible solutions for the conflicts. Third, this study will examine the advantages and disadvantages of adopting the CISG and examining the success of the CISG. Fourth, this study will explore the current situation in Islamic countries by taking Saudi Arabia as a case and explore how the application of Sharia law works and the possibility to enforce the CISG and explore the current practice of foreign Sales in Saudi Arabia. The research finds that there are some conflicts between CISG and Sharia Law. The most notable conflicts are interest and uncertainty in considerations. Also, this research finds that it seems that ratification of CISG is not beneficial for Muslim countries because the convention has not reached its goal which is uniformity of laws. Moreover, the CISG has been excluded and ignored by businessmen and some courts. Additionally, this research finds that it could be possible to enforce CISG in Saudi Arabia, provided that no conflict between the enforced provision and Sharia Law. This study is following the competitive and analysis methodologies to reach its findings. The researcher analyzes the provision of CISG and compares them with Sharia rules and finds the conflicts and compatibilities. In fact, CISG has 101 articles, so a comprehensive comparison of all articles in CISG with Sharia is difficult. Thus, in order to deeply analyze all aspects of this issue, this study will exclude some areas of contract which have been discussed by other researchers such as deliver of goods, conformity, and mirror image rules. The comparative section of this study will focus on the most concerned articles that conflict or doubtful of conflict with Sharia, which are interest, uncertainty, statute of limitation, specific performance, and pass of risk.
Keywords: Sharia, CISG, Contracts for International Sale of Goods, contracts, sale of goods, Saudi Arabia
Procedia PDF Downloads 151

4414 Orientation towards Social Entrepreneurship-Prioritary: Givens for Overcoming Social Inequality

Authors: Revaz Gvelesiani

Abstract:
Nowadays, social inequality increasingly strengthens the trend from business entrepreneurship to social entrepreneurship. It can be said that business entrepreneurs, according to their interests, move towards social entrepreneurship. Effectively operating markets create mechanisms, which lead to 'good' behavior. This is the most important feature of the rationally functioning society. As for the prospects of social entrepreneurship, expansion of entrepreneurship concept at the social arena may lead to such an outcome, when people who are skeptical about business, become more open towards entrepreneurship as a type of activity. This is the way which by means of increased participation in entrepreneurship promotes fair distribution of wealth. Gender conflicts have taken the leading place in the modern prose. L. Petrushevskaya represents different types of conflicts including those which are shown in the images of real contradictions in the stories "Narratrix", "Thanks to Life”, "Virgin's Case", "Father and Mother". In the prose of Petrushevskaya the gender conflicts come out in two dimensions: The first one is love relations between a man and a woman. Because of the financial indigence, neediness a woman can’t afford herself even to fall in love and arrange her family happiness. The second dimension is the family conflict because of the male adultery. Petrushevskaya fixed on the unmanifistated conflict in detail. In the real life such gender conflict can appear in different forms but for the writer is important to show it as a life basis, hidden behind the externally safe facade of “the family happiness”. In the stories of L. Petrushevskaya the conflicts reflect the common character of the social and historical situations in which her heroines find themselves, in situations where a woman feels her opposition to the customary mode of life. The types of gender conflicts of these stories differ in character of verbal images. They are presented by the verbal and event ranks creating the conflicts just in operation.
Keywords: gender behavior of heroes, gender conflict, gender picture of the world, gender structure
Procedia PDF Downloads 510

4412 Ending Wars Over Water: Evaluating the Extent to Which Artificial Intelligence Can Be Used to Predict and Prevent Transboundary Water Conflicts

Authors: Akhila Potluru

Abstract:
Worldwide, more than 250 bodies of water are transboundary, meaning they cross the political boundaries of multiple countries. This creates a system of hydrological, economic, and social interdependence between communities reliant on these water sources. Transboundary water conflicts can occur as a result of this intense interdependence. Many factors contribute to the sparking of transboundary water conflicts, ranging from natural hydrological factors to hydro-political interactions. Previous attempts to predict transboundary water conflicts by analysing changes or trends in the contributing factors have typically failed because patterns in the data are hard to identify. However, there is potential for artificial intelligence and machine learning to fill this gap and identify future ‘hotspots’ up to a year in advance by identifying patterns in data where humans can’t. This research determines the extent to which AI can be used to predict and prevent transboundary water conflicts. This is done via a critical literature review of previous case studies and datasets where AI was deployed to predict water conflict. This research not only delivered a more nuanced understanding of previously undervalued factors that contribute toward transboundary water conflicts (in particular, culture and disinformation) but also by detecting conflict early, governance bodies can engage in processes to de-escalate conflict by providing pre-emptive solutions. Looking forward, this gives rise to significant policy implications and water-sharing agreements, which may be able to prevent water conflicts from developing into wide-scale disasters. Additionally, AI can be used to gain a fuller picture of water-based conflicts in areas where security concerns mean it is not possible to have staff on the ground. Therefore, AI enhances not only the depth of our knowledge about transboundary water conflicts but also the breadth of our knowledge. With demand for water constantly growing, competition between countries over shared water will increasingly lead to water conflict. There has never been a more significant time for us to be able to accurately predict and take precautions to prevent global water conflicts.
Keywords: artificial intelligence, machine learning, transboundary water conflict, water management
Procedia PDF Downloads 105

4411 Modeling of Traffic Turning Movement

Authors: Michael Tilahun Mulugeta

Abstract:
Pedestrians are the most vulnerable road users as they are more exposed to the risk of collusion. Pedestrian safety at road intersections still remains the most vital and yet unsolved issue in Addis Ababa, Ethiopia. One of the critical points in pedestrian safety is the occurrence of conflict between turning vehicle and pedestrians at un-signalized intersection. However, a better understanding of the factors that affect the likelihood of the conflicts would help provide direction for countermeasures aimed at reducing the number of crashes. This paper has sorted to explore a model to describe the relation between traffic conflicts and influencing factors using Multiple Linear regression methodology. The war is between Fulani herdsmen and farming communities – an age-long problem which has escalated in the last decade and has assumed a very deadly dimension. In a typical scenario, Fulani herdsmen move into non-Fulani homelands with their cattle which graze on local farmlands, destroying farmers’ crops. This provokes their victims – the farmers – to acts of resistance, preventing the Fulani and their cattle from entering into farmlands. In some cases, there have been incidences of killing and/or stealing cattle, or poisoning of fields. In response, the herders wedge deadly attacks on farming communities, leading to the death of thousands of people. To be sure, this has been a major factor of instability in the rural areas of Nigeria. This paper aims at engaging the issues and cross-cutting issues of interest, as well as providing context and perspectives to the violent conflicts between Fulani herders and local communities in Nigeria. It particularly interrogates four central issues: (1) the nature and dynamics of the crisis, (2) the positions and stakes of the parties to the crisis, (3) the remedies available for containing/managing the conflicts and their desirability, and (4) perspectives on the positions of government(s) (and the African Union) on this conflict. Both primary and secondary sources were used for the purposes of this essay.
Keywords: Fulani Herdsmen, violent conflicts and insecurity, sustainable remedies, Nigeria
Procedia PDF Downloads 253

4409 Measures for Conflict Management in Nigerian Higher Institutions

Authors: Oyelade Oluwatoyin

Abstract:
The phenomenon of crises in educational sector in Nigeria has reached its peak in the 21st century. This article seeks to examine the ethno-religious conflicts in Nigeria from 2015 to 2021 and their impact on national security. The research was guided by six objectives. The theoretical framework adopted for this study is Structural Conflict Theory, which provides an adequate explanation, a predictive rationale for the frequent occurrence of ethno-religious conflicts and a tendency to provide the necessary insight for their resolution. The results of the study revealed that there is a strong relationship between ethnicity, religion, conflict and national security and that the ethno-religious conflicts experienced in Nigeria have gross implications for national security. The study recommends that the secularity of the Nigerian state be restored and preserved and that the state of origin be removed and replaced by the state of residence in all our national documents, as this will reduce ethnic identity, which is in opposition to nationalism. Religious leaders, traditional rulers, the media and other stakeholders should support the government in its fight to reduce ethno-religious conflict by sensitizing its youth, preaching unity and peaceful coexistence, and discouraging the use of violence as a means of settling disputes between groups and individuals.
Keywords: ethnicity, religion, conflict, national security
Procedia PDF Downloads 76

4407 Identity and Ethnic Conflicts in Afghanistan: Diversity as a Cultural Treasure

Authors: Morteza Azimi

Abstract:
In Afghanistan, as a multi-ethnic country, there have been ethnic conflicts, especially after 2001. These conflicts are more visible among the four main ethnicities Pashtun, Tajik, Hazara, and Uzbek. In this paper, such ethnic conflicts and their roles in the political sphere will be discussed. The distribution of personal electronic ID cards, for example, has been one of the most controversial and unsuccessful projects in Afghanistan. As a result, the lack of clear population statistics has led to several corrupted and unsuccessful presidential elections since 2001. The nation-building process in post-Taliban Afghanistan, as well as the Afghan government’s failure to build a nation, are discussed. By referring to the hybridity theory of Homi Bhabha, it is argued that the process of assimilation for nation-building has not only failed but has deepened ethnic divisions. In the end, some suggestions and solutions for making the most out of ethnic diversity rather than suffering from it will be provided. It will be argued that diversity or difference improves the freedom of choices for groups and individuals; it boosts agency in comparison with life in an assimilated, coherent, and homogeneous society.
Keywords: Afghan identity, ethnicity, nation-building, political system, self and other
Procedia PDF Downloads 235

4406 Pastoralist Transhumance and Conflict along the Nigeria-niger Borderlands: Towards New Perspective for Effective Border Management in Africa

Authors: Abubakar Samaila

Abstract:
Pastoralism has been an old practice in the Sahel region of west Africa. In recent years, pastoralists in Nigeria have increasingly been migrating on seasonal transhumance southward from the neighboring countries, especially Niger Republic, in search of better grazing conditions due to mainly, climate change. This has increased pressure on farm lands which instigate farmer-herder conflicts. These conflicts occur mainly between farmers and pastoralists but also between pastoralist groups themselves. However, there has been a shift in these conflicts recently to involve traditional institutions and, in some cases, the local authorities along the borderlands. The involvement of local institutions in the conflict has created an incentive to local actors, particularly pastoralcommunity-based groups, in responding to these violent threats. As pastoralists are mobile, these conflicts became difficult to contain and, thus, spill across borders. Consequently, the conflict has now transformed into an urbanized regional conflicts that involve some major cities along the Nigeria-Niger borderlands; Sokoto, Zamfara, and Katsina on the Nigerian side andDosso, Tahoa andMaradi in Niger republic. These areas are now experiencing unprecedented growing wave of violence that have become complex and escalates into a hydra-social conflict. The aim of this research is to investigate how the fluidities of Nigeria-Niger borderland intensified armed conflicts between the local pastoral organizations and sedentary populationspreading to some urban cities along the borderlands. The paper further suggests alternative approaches towards addressing the perennial crisis in African borderlands.
Keywords: pastoralism, climate change, conflict, nigeria, niger, borderlands
Procedia PDF Downloads 92

4405 Resolving Conflicts of Constitutional Nature: Inside the Romanian Constitutional Court's Rulings on the Role and Competencies of the Public Authorities

Authors: Marieta Safta

Abstract:
The separation and balance of state powers constitute the basis of the rule of law. Observance of this principle requires framing of public authorities within the limits of competence established by the Constitution and the law, as well as loyal cooperation between them. From this perspective, the attribution of the constitutional courts for settling legal conflicts of a constitutional nature is an important tool for correcting the tendencies of violation of these limits, as well as for identifying solutions for situations that do not find an explicit regulation in the constitutional texts. The present study analyzes the jurisprudence of the Constitutional Court of Romania in the field of legal conflicts of a constitutional nature, revealing, together with the presentation of conflict situations, the vulnerabilities of the constitutional reference texts. It is also highlighted the role of the constitutional courts in the evolution of constitutional law institutions, even in terms of defining and redefining the regime of the forms of government. The conclusion of the study, beyond the subject of legal conflicts of a constitutional nature, bears on the necessity, even more so in this matter, of the certainty of jurisdictional interpretation. This certainty cannot be achieved as long as the interpretation is not authoritative; consequently, the assurance of the effectiveness of constitutional justice constitute a key issue of the rule of law.
Keywords: <a href="https://publications.waset.org/abstracts/search?q=legal%20conflicts%20of%20constitutional%20nature" title="legal conflicts of
