It was caused debate among law observers and parties who litigated at the time. Based on this background, this thesis raises the formulation of the problem, What is the legal standing and the legal certainty of the Constitutional Court Regulation Number 2 of 2019 in the system of statutory regulations and Administrative Law? The results of this study indicate that the Constitutional Court Regulation Number 2 of 2019 in the Indonesian legal system is valid because it is recognized. Meanwhile, the legal uncertainty occurs in the Regulation based on Administrative Law Perspective, because the regulation which is pseudowetgeving was not revoked and was not done the judicial review The reason is that Orient Riwu Kore was only known to have dual citizenship after issuing the KPU Decree. The Constitutional Court later annulled the KPU decree. In contrast, Article 24C of the Constitution mandates that the MK&#39;s authority decide disputes regarding the general election results. In its practice, it has been proven that the authority of the judicial review to the Constitutional Court, and the Supreme Court encourages various issues. The substantive difference between the tests conducted by the Constitutional Court, and those conducted by the Supreme Court, is the process of examining the trial of the legislation under the law, and against the law by the Supreme Court was conducted in private. The cases handled by the Supreme Court were numerous, not just the legislation testing cases, but also the cases of cassation, and other legal matter. The relationship between the two judicial institutions, namely the Supreme Court, and the Constitutional Court, has become out of sync in the Indonesian constitutional system. The enforcement of the constitution integrally in all laws and regulations has become challenging to materialise. It becomes the loss of the power of the Supreme Court decision for a test case. When the norms that are used as the basis by the Supreme Court are declared unconstitutional by the Constitutional Court, there will be conflicting decisions. There is no mechanism for challenging any decision or action made by public authorities that violate fundamental rights enshrined in the Indonesian Constitution. This article argues that constitutional complaint and constitutional question might be adopted as new jurisdictions of the Indonesian Constitutional Court in order to strengthen the protection of fundamental rights of its citizen. It also identifies main problems that will be faced by the Constitutional Court in exercising constitutional complaint and constitutional question. Rakia</a></div><p class="ds-related-work--metadata ds2-5-body-xs">IOSR Journal, 2023</p><p class="ds-related-work--abstract ds2-5-body-sm">In the Indonesian constitutional system, the President is given the authority to issue regulations in extraordinary circumstances called Government Regulations in Lieu of Laws (Perpu). However, the limits of this authority are quite abstract so that the phrase "a matter of compelling urgency" in the Indonesian constitution has become moot. This paper aims to analyze the basic meaning of the phrase "a matter of compelling urgency" in the Indonesian Constitution, and whether the Perpu is a regulation issued by the President as Head of State or Head of Government. The method used is normative-juridical research which is analyzed qualitatively. The results of this study indicate that the phrase "matters of compelling urgency" in the Constitutional Court Decision does not specifically explain the meaning of coercive circumstances.
