background-color:#FFFFFF;"><img src="images/spacer.gif" alt=""></div> </div> </div> <div id="content"> <div id="rectangle_scroll">  <h1><span style="font-size:14px;"><span style="font-family: tahoma, geneva, sans-serif;">Comitetul European pentru Protecția Datelor</span></span></h1> <p> </p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma, geneva, sans-serif;">Comitetul european pentru protecția datelor (CEPD) este un organism european independent care contribuie la aplicarea consecventă a normelor privind protecția datelor în întreaga Uniune Europeană și care promovează cooperarea dintre autoritățile UE pentru protecția datelor. </span></span></p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma, geneva, sans-serif;">CEPD este alcătuit din reprezentanți ai autorităților naționale pentru protecția datelor și ai Autorității Europene pentru Protecția Datelor (AEPD). EDPB a fost înființat în temeiul art. 68 din Regulamentul (UE) 2016/679 (Regulamentul General privind Protecția Datelor). Comisia Europeană are dreptul de a participa la activitățile și reuniunile CEPD, fără a avea însă drept de vot.  </span></span></p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma, geneva, sans-serif;">CEPD are un Secretariat, care este asigurat de AEPD. Condițiile de cooperare între CEPD și AEPD sunt definite de un memorandum de colaborare.</span></span></p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma, geneva, sans-serif;">CEPD își propune să asigure o aplicare consecventă la nivelul Uniunii Europene a Regulamentului General privind Protecția Datelor și a Directivei (UE) 2016/680 (Directiva europene privind protecția datelor în materie de aplicare a legii)<a href="http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:32016L0680">.</a></span></span></p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma, geneva, sans-serif;">CEPD poate adopta orientări generale pentru a clarifica termenii specifici legislației europene privind protecția datelor, oferind părților interesate o interpretare consecventă a drepturilor și obligațiilor acestora.</span></span></p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma, geneva, sans-serif;">De asemenea, Regulamentul General privind Protecția Datelor abilitează CEPD să adopte decizii cu caracter obligatoriu adresate autorităților naționale de supraveghere, pentru a asigura o aplicare consecventă.</span></span></p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma, geneva, sans-serif;">În ceea ce privește sarcinile și atribuțiile CEPD, acestea sunt stabilite de art. 70 din Regulamentul General privind Protecția Datelor, dintre care evidențiem următoarele sarcini:</span></span></p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma, geneva, sans-serif;">să ofere orientări generale (inclusiv ghiduri, recomandări și bune practici) pentru a clarifica legislația în domeniul protecției datelor cu caracter personal;</span></span></p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma, geneva, sans-serif;">să ofere consiliere Comisiei Europene pe orice temă legată de protecția datelor cu caracter personal și cu privire la orice nouă legislație propusă la nivelul Uniunii Europene;</span></span></p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma, geneva, sans-serif;">să adopte constatări privind mecanismul pentru asigurarea coerenței în cazuri transfrontaliere legate de protecția datelor cu caracter personal;</span></span></p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma, geneva, sans-serif;">să promoveze cooperarea și schimbul eficient de informații și de bune practici între autoritățile naționale de supraveghere.</span></span></p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma, geneva, sans-serif;">Totodată, potrivit art. 71 din Regulamentul General privind Protection Datelor, CEPD elaborează un raport anual al activității sale privind protecția persoanelor fizice cu privire la prelucrare în Uniune și, dacă este relevant, în țări terțe și organizații internaționale.
