Über einen Verlagsvertrag oder vergleichbare Formen der Rechteübertragung treten sie sogenannte Verwertungs- bzw. Nutzungsrechte an Verlage ab.</p> <p>Formen der Rechteübertragung:</p> <ul> <li><strong>Einfache/nicht-exklusive Nutzungsrechte:</strong><br /> Ein einfaches Nutzungsrecht erlaubt, das Werk auf die genehmigte Art zu verwenden, ohne dass hierdurch eine Nutzung durch die Urheber selbst oder durch Dritte ausgeschlossen wird.<br /> <br /> <span class="Color700 fa fa-lightbulb-o fawesome140">  </span>Ein Verlag, dem Sie nur das einfache Nutzungsrecht übertragen haben, kann Ihnen nicht verbieten, das Werk auch auf weiteren <a href="https://open-access.net/informationen-zu-open-access/repositorien/">Repositorien</a> wie <a href="/kitopen.php">KITopen</a> Open Access zu publizieren.<br />  </li> <li><strong>Ausschließliche/exklusive Nutzungsrechte:</strong><br /> Vergeben Sie ausschließliche Rechte auf Ihr Werk, so kann es der Verlag unter Ausschluss aller anderen Personen nutzen.<br /> <br /> <span class="Color700 fa fa-lightbulb-o fawesome140">  </span>Die Verlagsverträge bei reinen Open-Access-Zeitschriften oder Open-Access-Verlagen erlauben in der Regel die weitere Bereitstellung der Publikationen auf Repositorien wie KITopen. Ein herkömmlicher Verlag wird jedoch standardmäßig die ausschließlichen/exklusiven Nutzungsrechte einfordern und somit weitere Open-Access-Veröffentlichungswege unterbinden wollen.<br />  </li> </ul> <h2>Vor Vertragsschluss: Optionen der Änderungen des Autorenvertrags</h2> <p>Sie können den Verlagsvertrag ändern, um eine Zweitveröffentlichung Ihrer Publikation in einem öffentlich zugänglichen Repository wie KITopen wahrnehmen zu können. Die Änderungen müssen vor dem Vertragsabschluss eingebracht werden:</p> <ul> <li><strong>Streichungen von einschränkenden Veröffentlichungsrechten</strong><br /> Wenn Sie bei Verlagsverträgen für die elektronische Version der Publikation nur die einfachen Nutzungsrechte vergeben, können Sie eine Zweitveröffentlichung in KITopen vornehmen. Im einfachsten Fall streichen Sie aus Ihrem Verlagsvertrag einschränkende Formulierungen wie "exclusive rights", "ausschließliche" bzw. "alle" Nutzungsrechte für die Online-Publikation aus dem Vertragstext heraus. In vielen Fällen werden diese Änderungen von Verlagen akzeptiert.</li> <li><strong>Vertragszusätze (Author´s Addendum)</strong><br /> Alternativ können Sie Ihrem Verlagsvertrag einen Zusatz/Addendum beifügen, um sich auf diesem Weg das einfache Nutzungsrecht für die Open-Access-Veröffentlichung über KITopen zu sichern. Bei der Wahl des <span class="faq_question">„Agreement Types“</span> <div class="faq_answer"> <p class="BColor150 imgborder" style="padding:4px">Die im anglo-amerikanischen weitverbreitete Version „Access – Reuse“ ist eine gemeinsames Angebot von <a href="https://sciencecommons.org/about/">Science Commons</a> und <a href="https://sparcopen.org/">SPARC</a> und wird in der deutschen Literatur kontrovers für das deutsche Urhaberrecht diskutiert. Daher raten wir von der Nutzung dieser Version ab.</p> </div> empfehlen wir:</li> </ol> <ul> <li>Immediate Access: ermöglicht den zeitgleichen Zugriff auf die Verlagsversion<br /> oder</li> <li>Delayed Access: ermöglicht den zeitgleichen Zugriff auf das Postprint/begutachtetes Manuskript sowie auf die Verlagsversion nach einem Embargo von 6 Monaten.</li> </ul> <ol start="2"> <li>Wichtig: Fügen Sie im Verlagsvertrag unter Ihrer Unterschrift folgenden Zusatz ein: <strong> „Subject to attached Addendum“</strong>.<br />  </li> <li>Senden Sie Ihrem Verleger den Verlagsvertrag sowie das Addendum zu. Sollte das nicht erfolgt sein, bestehen folgende Optionen zur Zweitveröffentlichung in KITopen:</p> <ul> <li><strong>Zweitveröffentlichung anhand von Verlagspolicies (Sherpa/Romeo Liste)</strong><br /> Inzwischen hat die Diskussion um Open Access den Druck auf viele Fachverlage verstärkt und sie gestatten teilweise die parallele elektronische Bereitstellung der Verlagspublikationen in Repositorien wie KITopen. Allerdings erfolgt das in den überwiegenden Fällen unter Auflagen (z.B. Embargos) und abhängig vom <a href="/publizieren-allgemein.php">Volltexttyp</a>. Die <a href="https://www.sherpa.ac.uk/romeo/index.php">SHERPA/RoMEO-Liste</a> gibt Auskunft darüber, was bestimmte Verlage im Hinblick auf die Zweitveröffentlichung wissenschaftlicher Publikationen gestatten. <p>Bei der Veröffentlichung Ihrer Publikation in KITopen orientieren wir uns routinemäßig bei Zeitschriftenaufsätzen an diesen Verlagspolicies und zeigen Ihnen diese auch im Workflow des Volltextuploads an.</p> </li> </ul> <ul> <li><strong>Zweitveröffentlichung nach dem Urheberrechtsgesetz </strong><br /> Der Gesetzgeber hat die Rechte wissenschaftlicher Autoren gegenüber den Verlagen gestärkt. Seit Beginn des Jahres 2014 können Autoren nach § <a href="https://www.gesetze-im-internet.de/urhg/__38.html">38 (4) UrhG</a> unter bestimmten Bedingungen die Postprints/begutachtete Manuskripte Ihrer im Verlag publizierten Zeitschriftenaufsätze über das Internet und in Repositorien wie KITopen mit einem Jahr Embargofrist frei zugänglich machen.
