The role of a state as the protector of individual rights requires it to frame laws that directly safeguard its citizens and ensure the integrity of personal data which people have to part with to gain access to services – both in public and private sectors. <br/><br/> India, with the world’s largest biometric data and digital payment users, is a vast depository of ubiquitous details – phone numbers, emails, and so on – which are, in effect, unique identifiers. The manner in which these are safeguarded by the agencies that collect them is a process that is barely transparent. The Digital Personal Data Protection Act, 2023 (DPDP), flows from the 2017 Puttaswamy judgment which brought to focus the right to privacy and effectively established it as a fundamental right under Art. 21-Right to Life and Personal Liberty. The Act “provides for the processing of digital personal data in a manner that recognises both the right of individuals to protect their personal data and the need to process such personal data for lawful purposes and for matters connected therewith or incidental thereto”. The framing of the Draft Rules under this Act in January marks an important step in the role of the state pertaining to data and the individual. <br/><br/> In this article, <b>Sarah Abraham, a Partner at a legal firm, Advocate/Mediator, Madras High Court, and a Certified Information Privacy Professional/Europe (CIPP/E)</b>, flags key elements of the draft DPDP Rules, such as the role of Consent Managers, the need to strengthen protection of data relating to children, addressing manipulative techniques to obtain consent, and reporting thresholds for data breaches. It has earned for itself the name, “pharmacy of the world” as the third largest producer by volume, after China of generic formulations, and a leading manufacturer of vaccines. In the international market, the low price and high quality of Indian generic formulations make them a good choice worldwide. Yet, at home, millions are pushed into poverty every year owing to expenses on healthcare, of which payment for medicines is a major component. In this article, <b>Dr. Anant Phadke, a member of the All India Drug Action Network</b>, which campaigns for affordable medicines, discusses the dynamics that direct these high prices such as marketing strategies by large pharmaceutical manufacturers, an incorrect price-regulatory framework, the plethora of irrational Fixed Dose Drug Combinations, and improper prescription practices by doctors. He draws attention to the fundamentally flawed Drug Price Control Order-2013, based on Market Based Pricing and argues for a policy of Cost Based Pricing of medicines. Dr. Phadke proposes generalisation of the well-established model of Tamil Nadu for procurement and supply of free medicines to patients in Public Health Facilities and its adoption in Kerala and Though relatively new in India and still in an emerging phase in Maharashtra, these FPCs are being viewed as a possible replacement for the old cooperative model and taken the form of new movement. The formation of FPCs in the districts of Maharashtra began in 2015 under the Maharashtra Agricultural Competitiveness Project (MACP). In Osmanabad and Solapur districts of Maharashtra, FPCs have been in operation for the past three years. As FPCs gained the attention and participation of the farmers it becomes pertinent to study their formation and performance.  This Policy Report attempts to look at the FPCs in Solapur and Osmanabad districts of Maharashtra to ascertain the level of inclusiveness and participation of the various categories of farmers in the running of the company. The study points out that caste and family hierarchies continue to hold a grip on ownership patterns, albeit in the early days of the FPCs. However, it can be said that the FPCs have the potential to overcome the difficulties faced by the farmers in selling their produce directly in the conventional market arising out of rigid vertical coordination of the middlemen based on the experiences of the farmers with the producer company model.The Report also includes an analysis of the new policy on the FPCs and attempts to assess the differences between the old cooperative Act and new Farmer Producer Companies Act.
