<p>親愛的使用者您好，歡迎來到OMIA創作內容學習服務平台(www.omia.com.tw）(以下簡稱「OMIA」)，OMIA是由春水堂科技娛樂股份有限公司所營之創作內容學習服務平台(以下簡稱「本服務」）。本服務條款，適用於所有連結至OMIA之會員或訪客（以下合稱「使用者」、「您」），透過註冊登入或使用OMIA提供之服務，即表示您已知悉且同意本條款，若您不同意本條款之部分或全部內容，您應立即停止使用OMIA。另，關於課程購買相關約定，請參閱：<a href="http://www.omia.com.tw/contract" style="font-size:20px;"><strong>會員帳號及密碼安全</strong></span></p><p>無論您是訪客或會員，都可以瀏覽OMIA上的內容，但只有註冊成為會員，始得購買線上課程並享受OMIA提供的各項服務。</p><p>為能使用本服務，使用者須同意以下事項：</p><p class="squish-padding">1. 依本服務註冊欄位之提示提供及維持使用者本人正確、最新及完整之資料。</p><p class="squish-padding">2. 若使用者提供任何錯誤、不實或不完整之資料，OMIA有權暫停或終止提供該帳號全部或部分之服務。</p><p class="squish-padding">3. 會員應妥善保管其帳號及密碼，不應將其帳號及密碼轉讓或出借給他人使用，如會員發現其帳號遭他人非法使用，應立即通知OMIA。因駭客行為或會員的保管疏忽導致帳號、密碼遭他人非法使用，OMIA不負擔任何責任。</p><p class="squish-padding">4. 您有義務妥善保管帳戶、密碼及其他相關身分驗證資訊，並為此帳號登入系統後所進行之一切活動、行為負責，包括但不限於衍生之相關費用。</p><p>5. 您同意在使用 OMIA時遵循所有適用法律，且僅可基於合法目的使用本服務。以非經 OMIA同意或指示之方式使用本服務或接觸系統，均應被嚴格禁止，OMIA有權停止提供該使用者之服務</p><p><span style="font-size:20px;"><strong>隱私權政策</strong></span></p><p>使用者提供的個人資料及OMIA保存與使用者相關之若干其它資料將受到中華民國法律和 <a href="http://www.omia.com.tw/privacy" target="_blank"><u>OMIA隱私權政策</u></a>之規範。</p><p><span style="font-size:20px;"><strong>平台及內容之所有權及智慧財產權聲明</strong></span></p><p>本服務所有內容（包括但不限於文字、說明、圖畫、圖片、圖形、檔案、頁面設計、平台規劃與安排等）之智慧財產權均屬本服務或其他權利人所有，非經OMIA或權利人同意，您不得重製、公開傳播、公開播送、轉售、或其他方式之使用，會員或使用者如有違反，將負擔所有因此侵權行為而衍生之法律責任。</p><p>會員或使用者發表、上傳、提交內容至OMIA網站或平台（包括但不限於內容、留言區、課程評價、問題討論與作業成果區等）之任何資料，一經您發表、上傳、或提供予本服務時，即表示您已同意無償授權本服務可基於公益或為宣傳、推廣或為經營本服務之目的，進而使用、修改、重製、公開播送、編輯、改作、散佈、發行、公開發表、公開傳輸、公開上映、翻譯該等資料，並得在此範圍內將前述權利再授權他人。</p><p><span style="font-size:20px;"><strong>使用守則</strong></span></p><p>除了遵守本服務條款之約定外，您同意不從事以下行為：</p><p class="squish-padding">1. 有竊取、更改、破壞他人資訊情事者。</p><p class="squish-padding">2. 有擅自複製他人資訊轉售、轉載情事者。</p><p class="squish-padding">3. 未經對方同意擅自寄發電子廣告信件至對方信箱者，或寄發未請自來之惡意電子郵件者。</p><p class="squish-padding">4. 於論壇區張貼與主題無關之訊息者。</p><p class="squish-padding">5. 蓄意破壞他人信箱或其通信設備者。</p><p class="squish-padding">6. 散播電腦病毒者。</p><p class="squish-padding">7. 上載、張貼、公布或傳送任何誹謗、侮辱、具威脅性、違背公序良俗之文字、郵件、圖片或任何形式的檔案。</p><p class="squish-padding">8. 擷取非經所有者正式開放或授權之資源者。</p><p class="squish-padding">9. 侵害他人名譽、隱私權、營業祕密、商標權、著作權、專利權、其他智慧財產權或其他權利或有侵害之虞者。</p><p class="squish-padding">10. 冒用他人名義使用本服務。</p><p class="squish-padding">11. 未經同意收集他人電子郵件位址及其他個人資料者。</p><p class="squish-padding">12. 傳送、張貼或發表或任何虛偽不實或引人錯誤之廣告或其他表示或表徵者。</p><p class="squish-padding">13. 其他有危害通信或違反法令之情事或之虞者。</p><p class="squish-padding">14. 破壞及干擾本服務所提供之各項資料、活動或功能，或以任何方式侵入、試圖侵入、破壞本服務之任何系統，或藉由本服務為任何侵害或破壞行為。</p><p class="squish-padding">15. 偽造訊息來源或以任何方式干擾傳輸來源之認定。</p><p>16. 本服務有其他正當理由認為不適當之行為。</p><p><span style="font-size:20px;"><strong>終止服務</strong></span></p><p>您瞭解並同意如您違反本服務條款之內容及精神，或有任何行為、留言等對其他第三人、本服務造成困擾或影響，或有違反中華民國法律及相關規範，本服務得逕行不附理由地隨時終止提供本服務，刪除您在本服務之帳號、密碼，並移除或刪除您所屬帳號在本服務所留下之任何相關信息、內容、文件，而毋庸事先通知。如因上述所進行之服務終止、刪除、禁止使用等行為對您造成任何損失及損害，本服務對您及任何第三人不負任何責任。<strong>而對已購課會員課程相關服務事項的終止，則另依購課合約之約定。</strong></p><p><span style="font-size:20px;"><strong>一般性條款</strong></span></p><p>本條款及使用者與OMIA之關係，均以中華民國法律為準據法。使用者與OMIA就本服務、本條款或其它有關事項發生的爭議，應以台灣台北地方法院為第一審管轄法院。</p><p><span
